
The government opposed the proposal of State Duma deputies about the complete ban on hosting hostels in residential buildings. About this, as Izvestia writes, says in the review of the bill Peter Tolstoy, Pavel Krasheninnikov ("United Russia") and Galina Khovanskaya ("Fair Russia").
We are talking about amendments to the law "On the Fundamentals of Tourism Activities in the Russian Federation", prepared in the spring of this year . Their authors proposed to introduce a ban on the use of residential premises for hotels, hostels and other "temporary accommodation equipment". The mentioned law itself will enter into force on January 1 and, among other things, will contain the definition of the concepts of "accommodation", "hotel", etc., and will also introduce the mandatory classification of industry objects.
As the authors of the amendments noted, the entry of the law "On the basics of tourist activities in the Russian Federation" will, by force, will introduce an organization in the houses in the houses of hostels, which contradicts housing legislation. However, the government did not agree with the arguments of the deputies - the review of the bill says that the provisions of the future law are consistent with applicable law. In addition, the government noted that the Tax Code of the Russian Federation attributes residential buildings, cottages and private houses to objects of temporary accommodation.
Also in the recall of the government, an earlier draft amendments to the Housing Code of the Russian Federation, which has already proposed prohibiting the creation of hostels in residential buildings, is mentioned. It was brought to the State Duma back in 2015 and accepted in the first reading in 2016. Work on him resumed only this year after Prime Minister Dmitry Medvedev promised the leader of Fair Russia Sergei Mironov decision on this issue after the World Cup.
In this bill, the government in the spring proposed a number of mitigating amendments. In particular, the government proposed placing hotels and hostels in residential buildings only with the consent of the residents, drawn up at a general meeting. At the same time, the described procedure for making such a decision requires three quarters of the votes of all owners for the quorum, if the house has one entrance, and if more, then more than 50% of all owners, of which at least two -thirds live in the entrance, which is supposed to place the hostel. For the appearance of a hostel in the house, three quarters from participating in the meeting should be expressed, and even one owner of the apartment will be able to block the placement of such an object if it adjoins the room where it is planned to create a mini-hotel.
