On October 15, the Supreme Court of Mordovia dismissed the administrative case of Sergey Maryin, a participant in the protest against the pension reform, due to the lack of corpus delicti. He published a copy of the text of the court decision today on his page on VKontakte.
In the protocol on an administrative offense, the police wrote that at the rally, which the local authorities refused to approve, the man held a flag, shouted slogans and spoke at the rally. On September 11, the Leninsky Court of Saransk found Maryin guilty of violating the procedure for holding a public event (part 5 of article 20.2 of the Code of Administrative Offenses) and imposed a fine of ten thousand rubles.
The man appealed the decision. As a result, the Supreme Court considered that Maryin was charged with committing acts not provided for by Part 5 of Article 20.2 of the Code of Administrative Offenses. The court also drew attention to the fact that the reclassification of the case to other parts of this article is impossible, and dismissed the case due to the lack of corpus delicti.
