Kostya is a very strong guy: an interview with a lawyer and girl Konstantin Saltykov

Konstantin Saltykov was detained during the “Broke of Voters” on January 28 and placed under administrative arrest. Two hours before its end, Saltykov was again detained. The next day, February 28, the court arrested him already as part of a criminal case under Article 318 of the Criminal Code. In June, the Investigative Committee charged Saltykov with the final edition.

According to investigators, the young man prevented the detention of Alexei Navalny, grabbed the policeman by the uniform, hit him on his thigh and tore his pocket. After that, Saltykov allegedly hit another policeman with a fist on the cheekbone and twice more on the back.

During the last speech at the hearing of October 18, Konstantin Saltykov said that he had no intentions to harm police officers. According to him, he saw only a person who needed help (Alexei Navalny- ATS-Info ).

What is Kostya a man?

- Absolutely peaceful. Kostya is generally against violence. Here we have known each other for three years, and I have never heard that he would get involved in a fight in life. Kostya is kind and responsive. For me, the most dear and beloved. Always ready to help. Very appreciates friends. Loves to read. Interested in everyone - philosophy, history, psychology, nature, space. Where without world classics. He also loves video games, anime. He is for a healthy lifestyle, always tries to keep himself in shape.

In what conditions is it contained?

- In a pre -trial detention center, there are more people in the cell than beds. 24–25 people - who calls, who leaves, the figure hesitates. They have to sleep in turn. Because of this, lack of sleep. Kostya comes to the trial. The Cory epidemic was in the summer. Kostya was ill. I order vitamins to him to maintain immunity. With his grandmother, we still transfer fruits and vegetables. Now for him in a pre -trial detention center the main leisure is books and reading letters from friends and colleagues.

Now, in a pre -trial detention center, only lawyers are allowed to be allowed to be allowed?

- Yes. I also communicate with him by correspondence. Officially, I am nobody to him. There were ideas about the wedding, but so far the most important thing is that he is nearby. When he comes out, then we will already think.

You study together at MPGU. Kostya wanted to become a teacher after release?

- Yes. He acted with interest in history and philosophy. But now, in this situation, he is not sure that he will be able to teach later. Kostya is studying at the Faculty of History, in the direction "History and Law."

And how did the search at his house?

- I could not be present there as a witness. When I entered there after the search ... it was trampled. All things were taken out of the cabinets. They even looked under the bath and forgot to push the plastic curtain back. Friends should have been as witnesses, but they were not allowed, and there was only a concierge.

After all, Konstantin was fulfilled for 20 years. Do you know, did he celebrate his birthday?

- On this day, Kostya was still under administrative arrest. Colleagues and friends handed him a bunch of letters with congratulations. He read them all. We came with his childhood friend. They brought some things, products. And his grandmother handed him a small gift.

What are your forecasts about the outcome of the case?

- Judicial practice in Russia does not develop in favor of the defendants, it wears a purely accusatory slope. About 99.8% of convictions are carried out in the country. Unfortunately, if it came to court, it is extremely little likely that the defendant will be justified. A similar practice has developed under Article 318 of the Criminal Code. However, I always advise my client to fight with all available legal methods, to defend my position and build a protection line. It is necessary to seek a fair sentence of the court.

If you speak directly about the case of Saltykov’s bones, then the whole position of the prosecution is based on the testimonies of the victims of Golovkov and Makhonin, as well as the testimony of witnesses who are all, without exception, police officers. The investigation has no other evidence.

The Investigative Committee, in my opinion, conducted a preliminary investigation unilaterally, witnesses from among civilians who were direct eyewitnesses to the detention of Alexei Navalny and Kostya Saltykov on January 28, 2018 were not questioned, and there were more than 30 people.

Not so long ago, the prosecutor's office asked to transfer Saltykov under house arrest. What is it connected with?

- Indeed, on the next extension of the guard, the position of the prosecutor's office has changed dramatically. If at the end of February the prosecutor's office supported the investigator’s request for detention, then in May 2018 it changed its position and announced a change in the preventive measure for house arrest.

I think this is due to the fact that after some time they understood and agreed with the position of protection, which initially asked to choose house arrest because the most severe preventive measure is not applicable in this case. Saltykov Kostya is only 20 years old, he has a permanent place of residence in Moscow. He is a second -year student at the MPSU. It has a number of positive characteristics, diplomas. His help is needed by a grandmother, whose relative he is. Previously, he was not prosecuted.

Moreover, the term of investigation of the criminal case began to exceed the general practice under Part 1 of Article 318 of the Criminal Code, which, as a rule, are investigated two months. I think these several factors forced to change the opinion of the prosecutor's office (however, the court left Saltykov in custody- the OVD-Info ).

It is known that Alexei Navalny was interrogated in this case. Have you turned on the video with the moment of detention from Navalny’s telegram in the case file?

- Alexei Navalny was interrogated by the investigator of the UK as a witness to the prosecution. However, they did not interrogate him in court. The state accusation abandoned this witness, since he refuted the position of the prosecution and said that it was really: Saltykov did not apply a hit by any of the police, did not apply violence against police officers.

The video with the moment of the detention of Alexei Navalny was not presented at the hearing.

In July, policeman Alexander Makhonin demanded to reimburse 50 thousand rubles for the damage caused to him. Did this affect the main thing?

- Makhonin really at the stage of preliminary investigation said that he estimates his moral suffering at 50 thousand rubles. However, at the hearing, the statement of claim did not apply. According to the norms of the current legislation, without a statement of claim, the requirement to compensate for damage is impossible. In this connection, the application cannot affect the court verdict.

What are the well -being and mood of Constantine now?

- Kostya Saltykov since February 27 is in jail No. 2 “Butyrka”. For any person, the content of detention is a huge test. Kostya has been detained for eight months, for a month before that he was in a special detention center for administratively detainees, was also isolated from society. Now his health status is satisfactory. The conditions for the detention of prisoners in the pre -trial detention center leave much to be desired, but Saltykov holds. Kostya is a very strong guy, not everyone will withstand such a test.
