Lawyer Benyash released on bail

The Krasnodar Regional Court released lawyer Mikhail Benyash from a pre-trial detention center on bail of 600,000 rubles.

The day before, President of the Federal Chamber of Lawyers of the Russian Federation Yuri Pilipenko asked the prosecutor of the Krasnodar Territory to facilitate the release of Benyash and take his case under personal control, RAPSI reports . He recalled that the crimes imputed to the lawyer are not serious (part 1 of article 294 of the Criminal Code of the Russian Federation is of minor gravity, part 1 of article 318 of the Criminal Code of the Russian Federation is of medium gravity), and he also has a minor child, family, permanent place of residence and registration in the region of the preliminary investigation.

According to the investigation, on September 6, Benyash called for participation in an uncoordinated rally, in connection with which an administrative offense case was opened, for which the lawyer received 14 days of arrest. During the arrest, according to the police, the defender bit one of them on the arm and hit the other three times with his elbow.

In addition, four months earlier, during a meeting in the Pervomaisky Court of Krasnodar, where Benyash acted as a defense counsel, he repeatedly interrupted, gave instructions, expressed demands and objections to the decisions of the judge, about which comments were made to him, to which the lawyer did not react and continued to violate the established order trial, indicates the investigation. In connection with the inappropriate behavior of the lawyer, the judge decided to remove him from the hall and remove him from further participation in the consideration of administrative cases. Benyash refused to leave the courtroom, so he was forcibly removed. On the same day, the defender again tried to get into the courtroom, but the police prevented him.

On September 24, the Investigation Department of the ICR for the Krasnodar Territory opened two criminal cases against Benyash - "use of violence against a representative of the authorities" and "obstruction of justice."

On September 28, the Leninsky Court of Krasnodar placed the lawyer in custody for a period of two months.
