The Krasnodar Regional Court decided to release lawyer Mikhail Benyash, accused of violence against police officers, on bail of 600 thousand rubles. Journalist Alexander Savelyev reports this on his Telegram channel.
The judge overturned the decision of the Leninsky District Court to arrest the lawyer for two months. The preventive measure was changed to house arrest.
Previously, the prosecutor asked to cancel the order to place Benyash in custody.
- Lawyer Mikhail Benyash is accused of using violence against a police officer (Part 1 of Article 318 of the Criminal Code) - in this case he was arrested for two months. The investigation believes that during the arrest on September 9, a lawyer in a police car bit one employee on the hand and hit another in the face three times with his elbow.
- Benyash told OVD-Info that on September 9 he was going to go to the detainees at a protest against the pension reform, but in the end he himself was detained. According to the lawyer, after that he was beaten in the police car, and then in the department: “He ( a law enforcement officer - OVD-Info ) began to choke me and throw me all over the car. It ended with me being handcuffed on both hands, pulled out of the car, and thrown face down on the asphalt.”
- Benyash also said that he was subsequently taken to the hospital twice: “They diagnosed abrasions on the face, arms, neck, cheekbone and jaw, hemorrhage in the left eardrum and traumatic otitis media.”
- At the end of September, it became known that another criminal case was opened against the lawyer for obstruction of justice (Article 294 of the Criminal Code).
