The European Court of Human Rights awarded 12,400 euros as compensation to the human rights activist and former Senator of the Novosibirsk Region Alexei Manannikov, who was forcibly placed on a psychiatric examination as part of a criminal case of insulting the judge. The text of the court decision was published by Manannikov himself on his Facebook page.
According to the Decree of the European Court, the Russian side violated Part 1 of Article 5 (right to freedom and personal integrity), as well as part 1 and 3 of Article 6 (right to a fair court) of the European Convention on Human Rights. In addition, the human rights activist was recognized as victims under Article 1 of Protocol 1 (Property Protection) and Article 2 of Protocol 4 (freedom of movement) of the European Convention.
The persecution of Alexei Manannikov began in the spring of 2006, when he was accused of insulting the traffic police (Article 319 of the Criminal Code), who stopped his car. In 2009, the Central District Court found him guilty and sentenced him to a fine. During the appeal processes, in connection with the first case, a second criminal case of insult (Article 297 of the Criminal Code) and slander (Article 298.1 of the Criminal Code) was brought to him. The case was brought after the statements of Manannikov at the meeting and on his blog in the “Live Journal” about the judge of Maria Shishkina, which he called the “Basmanny Judge”.
In the framework of the second case, Manannikov was a search in the apartment, after which two computers were seized from him, which were not returned within three years before the court’s decision.
During the meeting on the complaint of Manannikov about the seizure of technology, he was led to another judge, who, not allowing him to be a defender, decided to put Manannikov in a hospital for 30 days for a psychiatric examination. In the hospital, Manannikov announced a hunger strike, and a week later, not finding any deviations, he was released. A month later, the court rejected his complaint against the forced premises in the hospital. In a conversation with the ATS-Info , lawyer Nikolai Zboroshenko, who represented the interests of Manannikov in the ECHR, said that, in addition to the withdrawal of the defender, experts were not even interviewed at the Court of Appeal.
Zboroshenko also noted that, in addition to the already listed, in Strasbourg they paid attention to an unreasonably long ban on leaving Novosibirsk. In the framework of two criminal cases, the man remained under the subscription about the lack of departure for more than six years. In his complaints about the ban on leaving the city of Manannikov, he wrote that he needed to go to Moscow to help an elderly mother in monetary affairs.
The persecution of Manannikov lasted from 2006 to October 2012, when Manannikov was found guilty of disrespect for the court and fined 150 thousand rubles. In February 2013, the Supreme Court partially justified the human rights activist and reduced the fine five times. On a cassation appeal, the Supreme Court made a ruling that insulting a judge via the Internet is impossible.
