
The case of the “Seventh Studio” is considered by Irina Ukakova in the Meshchansky court. She has been working as a judge for 12 years, but she has not yet had media processes - only criminal and administrative cases of general practice (this is an example of how the court was conducted by the court to expel illegal migrants).

The director Kirill Serebrennikov is protected by Dmitry Kharitonov (for example, he represented the interests of the widow of Sergei Magnitsky ). Ksenia Karpinskaya - the lawyer of the former general producer of the Seventh Studio Alexei Malobrodsky - defended the former developer Boris Shemyakin and former mayor of Yaroslavl Evgeny Urlashov, who was accused of receiving a bribe. Irina Vorovinova, who defends the former Ministry of Culture of the Ministry of Culture Sofu Apfelbaum, previously worked on ships about economic crimes and in the process of former mayor of Tambov Maxim Kosenkov - he was accused of excess of official powers. The lawyer of the former general director of the Seventh Studio Yuri Lysenko was mainly engaged in civil cases and copyright protection.

The role of the victim in the process is still minimal. During the already held interrogations, the representative of the ministry did not ask the defendants a single question and generally did not enter into discussion. On November 9, one of the accused, a former Ministry of Culture of the Ministry of Culture Sofya Apfelbaum, said to Lebedev on the grounds that he advised at least 11 witnesses to the prosecution. The court rejected the petition.
The prosecutors read out the indictment. It follows that director Kirill Serebrennikov and the former general director of the Seventh Studio Yuri Itin attracted the producers of Alexei Malobrodsky and Ekaterina Voronova, the Ministry of Culture of the Ministry of Culture Sofu Apfelbaum and accountant Nina Maslyaeva to the theft of funds that the state allocated to the Platform Contemporary Art project. All together, according to the prosecution, they stole 133 million rubles from 2011 to 2014.
After the announcement of the version of the prosecutors, the four defendants - Serebrennikov, Itin, the Malobrodsky and the Apfelbaum - and their lawyers in turn said that they did not understand what they were accused of and did not admit themselves (Ekaterina Voronova left Russia and was put on the wanted list; the case of Maslyaeva allocated a separate proceedings). They also stated that the text of the indictment contains gross errors: the investigation, according to their version, distorted their testimony.
Next, interrogations of the accused began. The first testimony was given by Kirill Serebrennikov, his interrogation lasted three days. The main thing that he said: he and other participants in the case had no intent to commit any crime.
On November 13, the court interrogated Alexei Malobrodsky; At the next two meetings, the correspondence of the former general producer of the Seventh Studio was read out.
The procedure for consideration of the case is approved by all parties. In the process in the case of the Seventh Studio, the defense and the prosecution agreed that at first the prosecutor’s office would prove the guilt of the defendants. The defendants themselves have the right to testify at any stage of the process. Kirill Serebrennikov, Alexey Malobrodsky and Sofya Apfelbaum, together with their lawyers, decided to do this before the study of evidence. Yuri Itin decided to testify later.
After the interrogation of Sophia Apfelbaum is over, the prosecutor's office will begin to prove the guilt of the defendants. Apfelbaum lawyer Irina Porovinova suggests that the prosecution will call their witnesses, and in those days when the witnesses will not come, will announce the materials of the criminal case, which, in her opinion, prove the guilt of the defendants.
Indications, data on interrogations, cannot be announced during the process by law - unless the contradictions arise in the position of the witness. “Then they [prosecutors] love and love to refer to written testimony in which there are never any contradictions,” says Porovinova.
Further protection will enter the process - and will begin to prove that the accusations are insolvent. The procedure is the same: the witnesses will be interrogated in court and the documents arguing the protection position.
“Such a stage will come when we submit a petition for the return of the case to the prosecutor,” says Porovinova. When exactly this happens, the lawyer does not specify - the defenders will still consult with each other. “After the testimony of our clients, it will become obvious that the nonsense that is in the case file proves their innocence, and not guilty,” Porovinova proves.
The final stage of the process is the debate of the parties; At this point, the prosecution will request the deadlines, to which, according to prosecutors, they must be sentenced to the defendants. After that, the judge will have to pronounce the verdict. However, as the Uvilovov says, the defense hopes that even before the debate, "the case will go to the prosecutor to eliminate errors."
According to lawyers, from 40 to 50 witnesses are mentioned in the indictment. However, according to the Uvrianov, almost every of them during the process can help prove the innocence of the defendants. “When you look into the investigator in the eye, it breaks easily, but when people come to court and see a bunch of people, they often change the testimony and begin to tell not the croyvda that they weaved during the investigation, but the truth,” she explains. “And they turn simply into witnesses - honest people.”
The defense side, according to Evorinova, intends to call about 400 people to the court (“we’ll interrogate one hundred for sure”): “These are people who participated in the projects of the Platforms, who paid money for this and who were not interrogated by investigators.”
Lawyer Kirill Serebrennikov Dmitry Kharitonov, in a conversation with Medusa, did not clarify who exactly came to the court, but said that these names are constantly sounding during the process when they were talking about events: “These are those who sang, who played, who wrote the music - famous people including. In the case of the Seventh Studio, 258 volumes. For comparison: in the loud and stylistically close trial in the case of Kirovles there were 29 volumes; The court lasted six months. In another “economic” case with the participation of the Brothers Navalny - the case “Yves Rocher” - there were 120 volumes (most of the payment documents), it was considered five months.
Lawyer Kharitonov says that the duration of the process cannot predict. “We have been interrogated for three days for three days and we’ll be another three days,” he explains. “We have a lot of questions - our clients tell about everything that happened, and what during the investigation they did not bother to ask.”
According to Irina Pornerinova, the consideration of the case can be delayed for at least six months, despite the fact that the meetings are held three times a week: “It will end earlier if the judge will send the case for the investigation on his own initiative or after our application. By her eyes, I see that she is already beginning to slowly understand what's what. ”
Perhaps one of the main points of the process will be the interrogation of the former accountant of the Seventh Studio Nina Maslyaeva - it is at her testimony that the version of the prosecution is largely built. However, the lawyer Kharitonov says that they are ready for the interrogation of any witness.
The lawyer of the Poroverov confirms: the main evidence of the prosecution is the testimony of Maslyaeva and “all its henchmen”, which cashed the money through their firms.
