
The bills introduced by the President of the Russian Federation on partial decriminalization of Article 282 of the Criminal Code of the Russian Federation provide instead of criminal administrative punishment for extremist statements on the Internet, if they were committed for the first time.
The State Duma at a meeting on Tuesday adopted in the second reading the presidential package of bills on partial decriminalization of Art. 282 of the Criminal Code of the Russian Federation ("excitement of hatred or enmity, as well as humiliation of human dignity"). Projects of laws No. 558345-7 and No. 558351-7 partially decriminalize the “anti-extremist” article, translating a number of offenses that do not pose a public threat to the category of administrative ones.
For this violation, administrative fines are introduced for citizens in the amount of 10 thousand to 20 thousand rubles, or mandatory work for up to 100 hours, or administrative arrest for up to 15 days, for legal entities, penalties in the amount of 250 thousand to 500 thousand rubles are provided for legal entities. At the same time, the editorial office of the second reading extended the statute of limitations of administrative proceedings for offenses related to likes and reposts, from three months to one year , the head of the Committee on State Building and Legislation Pavel Krasheninnikov explained.
The criminal prosecution for this offense, according to the presidential package of bills, may occur already under the first relapse. If the offense for which the person was brought to administrative responsibility will be recorded repeatedly within a year, the punishment will be imposed on the calculation of the previous norms of the Criminal Code of the Russian Federation - imprisonment for a term of two to five years.
Krasheninnikov also confirmed that a package of bills on decriminalization of Article 282 of the Criminal Code of the Russian Federation after its adoption “will have retroactive force” and extend to previously instituted criminal cases and sentences. “This means that all the so -called criminal cases for likes and reposts should be closed, and the sentences that entered into force are revised,” he emphasized. The head of the committee clarified that it is about affairs under Part 1 of Art. 282 of the Criminal Code.
The State Duma speaker Vyacheslav Volodin believes that the adopted amendments “will exclude cases of excessively severe punishment for a one -time careless publication or repost on the Internet, on the other hand, they will retain responsibility for the manifestations of extremism on the network.”
He emphasized that the bill, supported by all political factions in the second reading, will be considered by the State Duma in the final reading on December 19. “Our legislation in this area is quite young, and it is improved, including based on its law enforcement practice,” concluded Volodin.
