Electronic book publishers are offered to protect the new memorandum

According to Roskomnadzor, the document will regulate the relationship between book publishers and Internet search engines.

Roskomnadzor is ready to discuss with the book publishers the creation of a new anti -Pirate memorandum, follows from a letter from the department to the President of the Russian Book Union Sergei Stepashin. The Union sent an appeal to Roskomnadzor in early November of this year, and received a response in December.

“To regulate the extrajudicial mechanism for the protection of copyright and related rights to electronic and audiobooks, it is necessary to prepare a separate document establishing the procedure of interaction between copyright holders in the field of the book industry and the owners of information resources,” the Roskomnadzor’s answer, a copy of which has Kommersant.

The agency explains its decision to create a separate document to one of the points of the already existing memorandum, which establishes that only owners of rights to audiovisual works, television chores, video hosting and search engines can join it, the newspaper writes. At the same time, the letter confirms the readiness of Roskomnadzor to help in the negotiations of book publishers and search engines.

The general director of the copyright protection association on the Internet (Azapi) Maxim Ryabyko carefully evaluates the prospect of signing a new memorandum. At the same time, the key participant of the Memorandum, Yandex, did not answer the proposals of the association, adds Mr. Ryabyko.

Recall that the first anti-Pirate memorandum was signed by the largest media holdings, search engines, online cinemas and producers in early November of this year. It was concluded to “prevent violation of exclusive rights, confirming a mutual understanding of the need to ensure compliance with copyright and related rights to audiovisual works on the Internet and creating conditions for the termination of their violation”.

“Firstly, the alleged memorandum itself is a miserable semblance of DMCA, which RAEK proposed to make publishers (in the person of Eksmo) by amendments to the Civil Code of the Russian Federation six years ago. When everything has already been agreed, Eksmo went out of negotiations without comment and the epic began with amendments to “eternal blocks”. Now publishers want search engines to work “according to concepts”, and not by law.

Secondly, for the main unauthorized content aggregators, the disappearance of links from the search results does not threaten anything special, because the traffic to their sites is organic. Users already know where to look for content without search engines. This is easily confirmed by the statistics of the attendance of Phlibusta and Libruseca, which have long been “blocked” by Roskomnadzor. After a slight decline, traffic in just a month or two returns to the previous level. That is, the betting of publishers - on completely naive users - reveals their complete misunderstanding of the psychology of content consumers. If they are used to doing something like that, and not otherwise, then by prohibition, blocking or restriction of the search you will not force them to change habits. The share of users who do not understand anything on the Internet at all is not so great that the disappearance of links takes at least some serious economic effect. In the end, the user always has the opportunity to ask another user. If publishers really want to defeat unauthorized distribution, then they need to invest additional efforts in increasing the loyalty and adherence of users to authors and authorized distributors. There is no other way. But this path is much more effective economically. ”
