The Ministry of Justice of Russia ordered the “Crimean Central Bar Association” to exclude from among the founders and members of the lawyer of the “Crimean solidarity” Emil Kurbedinov, the New Gazeta reports .

The Ministry of Justice referred to the decisions of the vessels of 2017 and 2018 on the recognition of Kurbedinov guilty under Article 20.3 of the Code of Administrative Offenses (propaganda or demonstration of extremist paraphernalia or symbols). Both times, Kurbedinov was tried for the same publication in VKontakte ”and Facebook of 2013 with the image of the Hizb Ut-Tahrir forum in Simferopol. For the first time, Kurbedinov was arrested for ten days, in the second - by five.
The Novaya Gazeta journalist Anton Naumluk notes that Kurbedinov was attracted to identical posts after a Donos letter to the Crimean prosecutor's office of a certain Muallem Sahim, supposedly a former resident of Crimea, who moved to live in Dubai. Naumluk gives an examination of the output data of the letter, which was analyzed at the University of Toronto Citizen Lab. According to data analysis, the letter was written in the Crimea.
The department referred to paragraphs. 4 p. 1.2 Art. 15 of the Federal Law of 12.01.1996 No. 7-ФЗ “On Non-Profit Organizations”, according to which “cannot be the founder (member) of a non-profit organization, a person who has entered into legal force by a court decision established that it contains signs of extremist activity”.
The Ministry of Justice issued a warning to the “Crimean Central College of Lawyers” and ordered to eliminate violations of the law until March 1, 2019, that is, to exclude Kurbedinov from the founders (members) of the organization.
Kurbedinov told Novaya Gazeta that he would not voluntarily leave the organization, and also appeal the ministry’s order in court. “Anti -extremist legislation, as we have already observed, is only a tool for persecution, in this case, independent lawyers. Colleagues do not suspect which a slow -off bomb has now been laid down under our entire lawyer community, ”the lawyer quoted the publication.
Ekaterina Selezneva, legal assistance coordinator of the legal assistance of the OTS-INFO, notes that if Kurbedinova is expelled from the college, he will not be able to protect the Crimean Tatars in criminal cases.
“The lawyer is obliged to be in law. After receiving a lawyer status, he will have to inform the ward about what education he entered for three months - a collegium, a bureau or which office he established. The Ministry of Justice, it turns out, indicates that since the lawyer was twice involved in extremist offenses, he cannot be a member or founder of any non -profit education, ”Selezneva believes.
Pavel Chikov, the head of the Agora international human rights group, believes that the Crimean Directorate of the Ministry of Justice “beats all records for the creative interpretation of legislation”.
“According to the Law on NPOs, indeed, a member of the organization cannot be a person in respect of whom there is a decision of a court establishing signs of extremist activity. But in all rare cases, when the Ministry of Justice previously made claims, it was a question of convicts in criminal cases. Administrative cases for such claims never became.
