"The witness disappeared, the investigator will be judged"

Exactly three years ago, police officers in civilian clothes posted in the apartment of a small city of Usolye-Sibirskoye in the Irkutsk region-they asked a large mother to "fulfill their civic duty and go to the station for identifying possible killers of a neighbor." In the office of 321 of the Usolsky Internal Affairs Directorate, Marina Ruzaeva, as investigators of the Angarsk investigation department, were tortured for several hours, forcing to sign a confession in the murder: they chained the bench and began to beat with an electric shock, put on a bag on their heads and beat the head and damage to the spine and the Usolchanka still tries to cure .

For three years, Marina and her husband, who, after the torture of his wife, became a human rights activist, three times managed to get a criminal case against three operatives who tried a woman in the department. On the eve of the three -year "anniversary" they learned that the case of torture by the police for the third time was terminated in November "due to the lack of a crime event." In December, the investigator, who was investigating the torture case, opened a criminal case on the falsification of his materials.

"They burned me, burned, burned"

The attack on Marina Ruzaeva occurred on January 2, 2016. Pavel Glushchenko managed to pull his wife out of the only police department, only after 5 and a half hours. According to Glushchenko, the application for the tortures of Marina was submitted immediately - January 3, 2016, however, the initiation of a criminal case for an unknown reason was delayed for a whole month. Since then, criminal case No. 85905 twice covered Usolsky by the trace - and twice lawyers of the Public Verdict human rights fund managed to cancel these illegal decisions. In November 2018, the decision on the termination of the “torture case” (the document is at the disposal of the editorial office) already adopted the trail of the Irkutsk region with the resolution “due to the lack of a crime event”, despite the dozens of forensic expertise, which confirmed numerous injuries of the Usolsk woman, and the results of the studies of the accused police on the polygraph, fixing the fact of torture.

- The police in civilian clothes knocked on us on January 2 late in the evening. I really did not want to let my wife go even in the company of police officers, so I offered to go with them, wait for Marina in the department. The investigator Korbut swore in the fact that from Marina "and hair will not fall, they will take it back intact and preservation," recalls Marina's husband Pavel Glushchenko. - I managed to pick up my wife from the department only at half past night, after more than five hours. For the last two hours I stood in the offspring of the department, breaking off the internal phone of the office in which Marina was located. At the same time, the duty officer convinced me that there was no one in the department for a long time: "Everyone left, wait at home."

Marina herself says that the police quite logically explained her witness status by the fact that she, as a neighbor and a housewife, could notice the killer, as she lives nearby and is often at home day. Already in the department, Ruzaeva realized that they were treating her not at all as a witness in the case.

- The police brought me into the office, where an unfamiliar policeman was already sitting (later Marina identifies him in the Major of the Ministry of Internal Affairs of the Usolsky Ministry of Internal Affairs Denis Samoilov). He demanded that I take off my boots. It was already strange. Then those two police officers who brought me to the department (later identified by the victim’s operatives of the USM Ministry of Internal Affairs, Alexander Korbut and Stanislav Golchenko), stood behind me, put the handcuffs on my hands, fastened them to the bench, and put on my head a bag! - says the victim. - Here I already panicked. "Guys, what are you doing?!" They began to demand from me that I "told everything." When I asked what I should tell, one of the policemen who stood behind, applied a stun gunner, kicked on the leg. From fear, everything swam. After me and hands were beaten on the body, on the head, again with a shocker. It was so scary and painful! And it is not clear - for what?

During the “interrogation”, another “witness” of the Usolchanin Alexei Ragimov was brought to the department, whom Marina mentioned under torture as a friend, whom she might see out the window with the dead on the day of the murder.

- They dragged him: he saw Marina, her condition. After we attracted him to the case as a witness, but in 2016 he suddenly disappeared. Now nothing is known about him, ”Glushchenko tells about the oddities of the investigation. -Marina knows him from childhood at the “Hello-Proka” level, he does not have relatives in Usolie, there is no one to apply for a loss. The Angarsk investigators, when it was possible to redirect from the Usolsky between the landscape, tried to find Ragimov for an additional interrogation-it turned out that some third parties sold his apartment, then the traces break off.

About half past two Marina was pushed from the stairs of the department - she literally fell into her husband's hands. Already in the car she cried, repeated: "They burned me, burned, burned and burned me." To the indignation of Paul and the desire to immediately write a statement to the tortures, the woman assured that "it would end badly for us and the children" - so she was intimidated.

It was scary to return home: the battered and frightened Marina with soothing, behind her back - frightened children. What will happen next

- They threatened her that in the case of the disclosure of the details of the “interrogation”, the problems would not only be with us, but also the relatives (they listed Marina's exact addresses, surnames and places of work of our relatives) and the children of Marina, who are now 18, 11 and 7 years old. When the mother and sister of Marina Julia were running to us after our call, the sister said that before they went to Marina and almost already stood at the door, they knocked on the door ... The accused Korbut and Golchenko, with the question where to find Ragimov. Julia said: "How do I know? What, will I also put on my head on my head, and will you torture?" The employees looked at each other, and Julia heard that one another said: “She already told them everything!”, The operatives ran out of the entrance. Then in January, at the family council, my mother and my wife and I managed to convince Marina that these "werewolves in uniform" should be judged, and about an hour after the bowls in the police we were already in the emergency room, where they recorded bodily injuries and numerous burns, Glushchenko recalls.

On the same night, at 00.20, employees of the emergency room, fixing the bodily and burns from the stun gun, were informed of the police department about the crime committed there, after which the district police officer arrived at the Ruzaev home. Marina submitted an application to the police, and in the morning Pavel took her application to the Investigative Committee. Then Ruzaeva turned to Irkutsk doctors, who recorded in a woman a bruise of soft tissues of the head, neck, chest, lower leg and forearms, hips, as well as several electric burners on the body.

- The threats of the police were not empty: our classmate, an employee of the special forces detachment, who was outraged by Marina’s tortures in social networks, was brutally beaten. After he sent us a photo of his terrible beatings, and later, in the presence of a lawyer, he handed over to the “Hello” and the promise ”you, Glushchenko, already a corpse” - we demanded state protection for himself and him, asked us to ensure security at a personal reception. As a result, he was forced to say that he did not know who the messages came from, but he did not send a photo of the beatings. In some period, everything went so far that we themselves had to hide with the children. On January 5, at 8 a.m. we were punished by three cars near the house (later when checking the testimony on the spot, we saw all three cars standing in the parking lot at the police department!). From the persecution, we managed to tear ourselves only in the forest, where we drove along the way to Irkutsk. In Irkutsk, we did not get to the examination, and for the third time we recorded bodily injuries in the regional hospital. It was scary to return home: the battered and frightened Marina with soothing, behind her back - frightened children. What will happen next, will they lead at all? Complete unknown. Given the threats to relatives, it was dangerous to go to them, there was no weapon, there was nothing to defend himself. For the third day we did not sleep at all, ”the husband recalls the victim.

There are many violations

The excitation of the case of official powers and the application of violence under Part 3 of Article 286 of the Criminal Code of Russia managed to achieve only a month after the attack, and the beginning of this investigation - six months later, when in July 2016 they managed to transfer the case to the investigative committee of the neighboring Angarsk.

“This was done only after the related relationship was proved between the head of the investigation department of the Usolian investigator Denis Zaretsky and one of the suspects - the operative of the Usolsky Ministry of Internal Affairs Denis Samoilov,” says Glushchenko. - Moreover, the trace confirmed that the deputy chief of the investigation department of the Usolian investigation of Anokhin was the wife of the direct head of the accused - the head of the threat of the Ministry of Internal Affairs of the "Usolsky" Anokhin. As a result, after the transfer of the case and the creation of a new investigative group, Angarsk investigators had already prepared an indictment by December against all three suspects: Major Denis Samoilov and two operatives of the Ministry of Internal Affairs of Alexander Korbut and Stanislav Golchenko. This accusation is the result of the huge work of Angarsk investigators and laboratory staff, because they had to re -conduct many examinations that were previously not previously done. They convicted the suspects in the lie, after testing the polygraph, and also confirmed the veracity of Marina’s testimony, conducting several investigative experiments. For example, it was allegedly established that as she said, it was impossible to fix her hands under a bench. We checked on the spot - they confirmed that it was possible that the bruises from this remain just the same as she was then. Nevertheless, the Usolsky prosecutor found several shortcomings in the case and returned the materials at the place of registration - to Usolsky by 10 days, so that after eliminating violations the case was transferred to the court. It is clear that we suspected something was wrong, despite the fact that the relative of the suspect, Denis Zaretsky, was no longer in the Usolsky TFR, he was retired - but we, of course, did not expect such impudence: they stole the case for a whole year (!), In December we made a decision to terminate it, and we were informed, despite our constant requests, only in April! How can you trust the new chapter of the Investigative Committee, if we had to run for 4 months after this decision?!

Late per month upon receipt of the next two decisions on the termination of the criminal case on the torture of Marina, human rights activists were no longer surprised - many violations during the investigation, according to Glushchenko, were committed. So, in early August, the Usolya court admitted that the employees of the Usolsky Squint are to blame for the disappearance of the two petitions of Marina Ruzaeva. The internal order of the department of the head of the investigative department and his subordinate was found guilty of the loss of documents, but they were punished only by reading the instructions. The investigator herself, the allegedly “lost” petitions, which human rights activists personally handed over to the head of the Usolian investigation of V. N. Khangayev, resigned in June 2018 of her own free will.

On December 29, 2018, human rights activists were informed that the investigator Sergei Lysy, who was engaged in the case of the torture of Ruzaeva in the Usolye police, was opened.

- He is suspected of falsifying the protocol and substitution of material evidence seized in the case of the torture of Marina. I was informed about this by telephone by the investigator engaged in our application for the substitution of material evidence. She said that they started the case on Lysykh under the 303rd article ( "Falsification of evidence and results of operational-search activities."-SR ). I won’t be surprised if it turns out that they were forced to do this, because his boss at that time was Denis Zaretsky, the head of the Usolsky investigative department and a relative of Samoilov, one of the police officers who attacked Marina, says Glushchenko.

The human rights activist suspected the replacement of important material evidence and the falsification of the protocol on its seizure in mid -2018 - a photo of a down jacket, in which Marina was supposedly in the police on the day of torture, did not coincide with the photographer from the chambers of the department, on which the victim was recorded.

-A gun coat, in which Marina was taken to the police and tortured with a shocker, is a very important evidence: traces of Shocar had to remain on the real down jacket, because Marina was beaten directly through the outerwear, apparently in the hope that there would be almost no traces (traces remained, which confirmed the medical examination). And then the expert issues the conclusion that there are no traces of clothes! We look at the protocols, and there is time - the first protocol of inspection of things before the examination is 8 a.m., despite the fact that the second protocol, when we only brought the down jacket to the investigator, only at 14 o’clock in the afternoon! - explains Glushchenko.

There is a fake of the materials of the criminal case. What is the impudence, huh? And how are they not afraid?

Later, the Investigative Committee of the Angara region confirmed the incorrect dating of the protocol, but the investigators said that they “just mixed up the time”, writing “0” instead of “1” - that is, according to them, the protocol was drawn up at 18 hours instead of 8. However, then Glushchenko discovered, interviewed that their signatures in the protocols were fed, and in both documents - the morning and evening - different surnames of the witnesses are different.

- The witnesses themselves did not sign them! I went to them, the benefit of the address are indicated - everyone denies that they signed the protocol. And one “understood” even put her signature nearby, so that it became clear that this was not at all signed. There is a fake of the materials of the criminal case. What is the impudence, huh? And how are they not afraid?! - Glushchenko is indignant.

Despite the falsification of the case file and the initiation of a criminal case on the investigator, on December 26, 2018, the injured by Marina Ruzaeva, they announced that the trace of the Irkutsk region in the person of the investigator for especially important cases of the first department for the investigation of the particularly important cases of the regional investigation department of the Lieutenant Colonel of Justice R.V. As early as November 25, 2018, he decided to terminate the criminal case No. 85905 on the torture of Marina Ruzaeva by “unknown employees of the Usolsky Ministry of Internal Affairs.” At the same time, the investigator referred to the words of the police accused of torture by the woman who “did not torture” Ruzaev. The testimonies of the injured Nazirov called “her husband” - “inaccurate”, but at the same time for the words of her husband, but at the same time A false denunciation, in his opinion, is not necessary to attract the victim and her husband.

According to Glushchenko, the document on the refusal has many obvious deceptions: for example, the investigator calls the accused by "unknown persons", although Ruzaeva identified all three at full -time bets, and the polygraph confirmed their involvement in the woman’s torture. At the same time, Nazirov in the resolution announced “the absence of an event of a crime”, but mentions the document in the document, who proved that Marina could not get these terrible injuries at another time and in another place.

She still screams at night, nightmares dream

-But in the end, he takes only medical examinations made by Usol investigators at the very beginning-with violations, without lines, dating, etc. Due to these incorrectly designed examinations, all subsequent ones made on their basis, Marina’s injuries are put with a scatter of 3-10 days. Angarsk investigators confirm that the date of torture is January 2, but their opinion is not taken into account for some reason. In addition, Lieutenant Colonel Nazirov describes in detail in the decision that Korbut, Samoilov and Golchenko were done on January 2, 2016 until 18.42 and after 21.42, but what they did between this - he was silent, although they threw Marina at these 3 hours, says Glushchenko. - At the same time, investigator Nazirov refused to introduce important evidence of the crime to the materials of the criminal case - traces on the bench that were abandoned by handcuffs fastened on Marina: she twitched from the shocker and blows, and there were characteristic damage on the bench in the office of the ATS, proving including the place of torture and suspects in the torture. And with all this, Nazirov did not establish the sudden appearance of traces of torture on the body of Marina, limiting himself only to what he confirmed - there were torture, but where and when - he has only strange options - "just before delivering to the police department, or when he was in the police, but when the accused left the office, or on the way to the trauma." To take into account the testimonies of the children of Marina, her mother and sisters, who did not see such injuries before the police and saw immediately after, they refuse, and the only witness who saw the beaten Marina in the area after torture disappeared unknown. What happened to him, only God knows.

There is no crime

Марина Рузаева вынуждена до сих пор лечиться в надежде избавиться от физических и психических травм, полученных в полицейском участке. После истязания Марине полгода пришлось заново учиться разговаривать, а также залечивать ожоги от электрошокера. Травма спины, нанесенная во время "допроса", мучает ее до сих пор.

– Она кричит по ночам до сих пор, кошмары снятся. Вздрагивает, когда к ней неожиданно подходят, – говорит Павел. – Но мы, конечно, не остановимся в своей борьбе, столько пути уже пройдено, нет, будем до конца идти. После новогодних праздников подаем жалобу на постановление о прекращении дела, раз оно вынесено областным Следкомом, обращаться будем уже в Центральный аппарат ведомства.

По словам юриста правозащитного фонда "Общественный вердикт" Святослава Хроменкова, шансы обжаловать прекращение "пыточного дела" очень высоки: самый весомый аргумент – возбуждение уголовного дела об умышленной фальсификации улик на следователя, который вел расследование.

– Формулировка прекращенки – это бред, при наличии признаков криминальности, то есть повреждений, которые кто-то нанес. Есть же повреждения, значит, их появление следствие должно объяснить. Следствие просто не намерено работать, – комментирует "Сибирь.Реалиям" Хроменков. – Вот многие обвиняют власть, правительство, президента, а на самом деле надо начать с того, чтобы привлекать маленьких чиновников, ведомственных сотрудников на местах, которые конкретно виновны в конкретных нарушениях. А не покрывать.

​Сейчас, по словам правозащитников, пытавшие Марину оперативники Александр Корбут и Станислав Гольченко по-прежнему работают в усольском УМВД, майор Денис Самойлов отправлен на пенсию "с почестями". В постановлении о прекращении дела подполковник Назыров пишет о том, что уголовное преследование всех троих следует прекратить, ввиду отсутствия события преступления, а также Гольченко, Корбуту и Самойлову нужно "разъяснить право на реабилитацию, а также право на возмещение имущественного и морального вреда".
