How compulsory work is carried out: stories of shares

Courts detained on protest shares can, among other things, assign mandatory work. OVD-Info talked with four people who, after the shares, worked out mandatory hours in factories, in housing and communal services and in the local administration.

"Enchanters come to them, but they have political for the first time"

Igor Azarov was detained in Krasnodar after the rally of Navalny's supporters on October 7, 2017. The court found him guilty of violating the Procedure of the Promotion (Article 20.2 Part 2 of the Code of Administrative Offenses) and appointed 20 hours of compulsory work. Igor was serving a sentence as a little worker in a construction team.

I waited for the start of public work during the year, called the bailiffs, and they told me: “What are you, so you want public work? You can be free, we will call you. " A year later, he himself arrived in the bailiff department: I had to go abroad. According to my information, not only unpaid fines restrict travel abroad, but also unfulfilled public work (also for their failure to comply with administrative arrest- OVD-info ). As a result, I received a referral to work in construction teams.

My goal was to manage all the work in four days. Therefore, it was necessary to work five hours every day.

On the first day, I was sent to the courtyard, overgrown with foliage, gave an ax and forced to cut down everything. I worked for an hour - counted for five. In the following days, the tasks were like this: they sent to screw light bulbs, change the roofs with a brigade, cut the grass. That is, the remaining three days I do not say a lot of work - they did not give tasks so many tasks. After that, they put me in the document that I passed. The bailiff department confirmed - now he could go abroad.

In this brigade, I was the only serving sentence, the rest of the people were just employees, ordinary hard workers. They told me that working people come to them, but they have political for the first time. They reacted normally, we talked to political topics - we support our position. In general, the revolutionary intelligentsia is very useful to go to the people, to communicate with simple hard workers. And public work gives such a unique opportunity.

I did not consider myself a slave, they did not force me to do anything like that. It was just a boring pastime, that's all. I did not do anything offending me. After ten days in a special -reception, everything in life is perceived calmly and simply.

"If the governor came, then we worked out in three days in three"

Nikita Shevchenko from Krasnodar was sentenced to compulsory work twice. The first time - after the action demanding to allow Navalny to participate in the elections of the President of Russia. The second time - in connection with the action “He is not a king” in May 2018. Then Nikita was found guilty of a repeated violation of the rally and appointed him 40 hours of public work. Shevchenko spent them in the local administration, performing the duties of a janitor.

I was sent by mail a prescription, I came, formed and worked. It so happened that I got to the same bailiff, after being sent to the same place to serve the work, to our local administration. All the workshops were surprised that I got there, because there are mostly alimony, drunken people who drove the car.

In fact, we worked as wipers in several suburban territories. The work demanded a quick reaction, basically, it became so when someone was the supreme, at that moment they commanded us: “Remove all this immediately.”

In one case, it was thirty hours, and for the second forty. We ripped off the announcements that were not agreed with the administration, collected garbage, swept.

If the governor came, we worked out in three days in three. They just cleaned the field, so that, God forbid, there the piece of paper was not lying around. There were no tires left in the whole village: we loaded three KamAZ, so that, God forbid, he did not see that they were. It was difficult for me, because I was not pumped up and I have scoliosis.

I worked for a couple of weeks for four hours a day. People working in the administration often asked me: "Why are you doing this, but how much do you pay for rallies?" This is my favorite question: how much do you pay for what you suffer. For the first time, the administration was told: "Tie, otherwise you will come to us again." I replied: “No, I won’t tie it,” and now, six months later: “Hello again.”

There is nothing negative in compulsory work. I do not mind working. I am against the fact that they are detaining for rallies - we still have freedom of speech, after all.

It was easy to combine with the main activity: for the first time at the university there were vacation, and the second time I was already on academic leave. You know what is strange - it seems to be written in the law that compulsory work is underway after studying or work, and in the regional administration all this is done from 8:00 to 13:00 if my memory serves me. Perhaps in other places not so. Actually, everything is as usual: the law is written, no one fulfills it.

"Quietly, peacefully, with a broom and worked out"

Pensioner Tatyana Prishanova from Smolensk was found guilty of repeated violation of the Promotion of the Promotion (Part 8 of Article 20.2 of the Code of Administrative Offenses) after the rally “He is not a king”. She was assigned 60 hours of public works that Tatyana spent as a janitor.

After the court, for about two months I waited for the beginning of compulsory work. By mid -October, she waited. I was sent to a private shoe factory.

The boss spoke rudely with me, demanded not to shoot nothing. The staff in the factory is 35 people, and the rest are the same as me, serving a sentence. The conditions at the factory are terrible: the rickety door on the entrance, on the door handle hangs a hinged lock, the walls are covered with mold, and it looks like ruins. At the “scoop”, everything was not as killed as in this factory. I would not find it in my life, but a comrade who had already worked out the obligatory clock has been led to me.

According to rumors, berets for the Russian Guard sew in this factory. I realized that a lot of money was simply washed there. After all, at least the majority of workers are working out, work hard for free. The director grumbled for a long time: "We cannot accept you, because you were sent to us, despite age." I came with a clear intention to raise a noise so that they did not want to hire not only me, but also those to whom the judges were appointed after me.

To work at the factory, they demanded a complete medical examination from me. I went to the doctors for three days - through difficult explanations, I managed to convince the factory’s employees to give me money for an examination in a private clinic. Initially, they wanted to put me on guard, but after a couple of days they changed their minds, they said that they had an agreement with the security company.

In the employment contract was a point on non -disclosure of secrets. I crossed it and advised me not to devote me to the secrets of the factory. I worked four hours a day: it was less possible, more - it is impossible. I was asked to come by eight in the morning, but I refused to walk in the dark along an unlit path leading to the factory. As a result, she worked from 12:00 to 16:00. I was given a dressing gown, gloves, the broom constantly stood on the entrance.

How much health allowed me - so much chalk. The difficulty was that I had not worked for fifteen years, I was weaned. This is not a cottage where she was tired - she went to rest. There was constantly something to do. I needed to collect foliage. When I realized that it was difficult to remove a broom, I asked for a rake. At first they told me: "We can’t buy a rake, there is no such product in the store." And then at all: "We will not buy, the factory has no money for the inventory." As a result, quietly, peacefully, with this very broom worked. It is impossible to scare the Russian woman with work.

"Director let me go early all the time"

Sergei Belyaev was detained in St. Petersburg a month after the rally “Voter strikes” in January 2018. The court found him guilty of violating the procedure for participating in a public event (part 5 of article 20.2 of the Code of Administrative Offenses) and disobedience to the legal order of a police officer (Article 19.3 of the Code of Administrative Offenses). Sergey served the obligatory clock in the local housing and communal services.

In court they gave me seven days of arrest and twenty hours of compulsory work. The judge still said so arrogantly: "Work is a minimum measure of punishment." I probably had to tell her for that. He served seven days and realized that the time had come to do work. I turned to the bailiffs, and they told me: "There is no work, you are not assigned anything."

Six months have passed. At that time, I already had a drive for the fifth of May (the action “He is not a king” on the eve of Putin’s inauguration- OVD-info ). And, in fact, I have already been appointed 10 days and 150 thousand fine. I learned about these works. I started a Sberbank card. After a while, I blocked the card, in the bank they say: "Call the bailiffs." I call, they say: “You have a fine of 150 thousand. Give a check that the debt is repaid. ” As a result, the card was unlocked, because the fine was already paid. On the site I went to check it and saw about work.

After a month and a half, he came, the bailiff said to me: "We will now choose the housing and communal services in which you will work out." He asked to choose the one where the clock was placed correctly, because in the special projector one guy was sitting with me, who was assigned mandatory work for alimony. He worked them, but he was not put down for a couple of hours, then they detained for a day for the fact that he allegedly did not work out the clock.

They appointed me an assistant master - this is, popularly, a janitor. I ask: “Can I have any adequate work?” They say: "No, you can't."

He arrived at the housing and communal services, they say to me: "You will clean the cellars." I think: "Op!" I clearly understand that the basements are dirt and dampness, I’m not going to kill my clothes there, this is material damage, because it will not be possible to walk in clothes after. Well, I think I will not be indignant today - I will come to work out and outraged to pass the time of workings.

I come, I ask for overalls: “If we would be for everyone who gave out clothes for twenty hours ...” That is, in theory, a warehouse with a special place should be. As a result, they give me a reflective vest: "So that we better see when and how you work."

They transferred from the basement, they said to sweep on the roadway. I began to ask for cones to protect the area that I remove so that I would not move any of the car. After all, these are safety requirements. And they began to shout: "What cones, we did not have cones, we have no cones." As a result, they sent the foliage to collect - the cars do not drive there. The problem with bags caught my eye, there were only five of them, and the foliage had to be assembled along two houses.

At first I thought that the activity was completely useless when I came there, but I cleaned it near my house. There was not laziness near his house. I began to conduct the statistics of garbage, which lies under the windows. Number one is bulls. Next - tea bags, hang from the branches of trees. Number three are condoms and uncleaning dog feces. And the fourth is not in quantity, but in amazingness: I saw how women's linen lay in the bushes.

I was not ashamed, it was not emotionally uncomfortable, but it reflected on me that they did not allow you to choose a job, and that I have to dodge, for example, from the basement. That is, if I were less active than I am, I would have to clean the basement.

They gave me a mentor who did not understand Russian. He explained to him that I was twenty hours, he nodded with his head and pushed, and then began to tell what we would do in a week. But he turned out to be cool. As a result, I gathered foliage, but I served in the army, learned to sweep correctly. For three days I worked for fifteen hours. Gathered the foliage only at one house. The director let me go early all the time.

Once the director saw a camera from me and this: “Oh, but are you working out? Come on, you will remove, and then show everyone in what conditions we work. ” She showed me her office, and there is a terrible mold on the ceiling, on the floor, the paint collapses. In the assembly hall, the ceiling is debuted. On one collapsed door is a sign: “Collection of war veterans”, which barely holds.

And here, on the last day, I come to her, we say: “Why are you working here? Why is free? What is the matter with you? " "The offense committed administrative, according to the judicial system of the Russian Federation." She says: "What?" I answer: "Miting." She looked at me so in surprise, said: “So you didn’t tell me right away, I would just write a letter to you at once, I wouldn’t work. I myself believe that Putin is not the best president. ”

To whom and how mandatory work is assigned

Mandatory work is free socially useful work. The approximate list is indicated in the appendix to the corresponding resolution of the administrations of the municipality. As a rule, it contains landscaping, construction and repair of roads, cleaning streets, yards, garbage parks, whitewashing trees, leaving lawns, cleaning public toilets and landfills, clearing sidewalks from snow, caring for patients and the like.

Mandatory work is assigned in free time from the main work or study. You can work “for the good of society” only four hours a day on weekends and two hours a day on business days - after graduation or study. However, if a person wants to work longer in order to close this watch faster, then he has the right to apply with a written statement to the bailiff. He can increase work to eight on weekends, up to four on working days.

All restrictions on compulsory work are indicated in part 3 of Article 3. 13 of the Code of Administrative Offenses. In particular, compulsory work does not apply to pregnant women, women with children under three years of age, disabled people of the I and II groups, military personnel, citizens called up for military training, as well as to those who have special ranks to the employees of the Investigative Committee, the internal affairs bodies, troops of the National Guard, the bodies and institutions of the penal system, the state fire service and customs authorities.

That is, in theory, a healthy, adequate person at least a hundred years old, found guilty of an administrative offense, can be directed as a punishment for mandatory work.

However, according to Part 7 of Article 32.13 of the Code of Administrative Offenses, a person who has been assigned mandatory work has the right to apply to the court with a petition for release from them - if he is recognized as a disabled person of the I or group II, the onset of pregnancy or a serious illness that impedes the serving of mandatory work.
