The World Court in the Nekrasovsky District of the Yaroslavl Region terminated the administrative case against the former prisoner of the local correctional colony No. 1, the head of the Yaroslavl branch of Rus Sitting, Ruslan Vakhapov. Vakhapov was accused of violating the rules of administrative supervision. His lawyers, lawyers of the Public Verdict Foundation, Irina Biryukova and Ernest Mezak, drew the attention of the court to the fact that the copy of the protocol on an administrative offense and its original contained different dates.
A police spokeswoman was unable to explain the different dates in the documents. "7×7" draws attention to the fact that the protocol was drawn up at night in the house of Vakhapov's mother-in-law, where, according to the police, he should spend the night under supervision.
The defenders pointed out that formally their principal is not under administrative supervision, since the decision on his appointment was appealed to the Yaroslavl Regional Court. As a result, the court did not find any corpus delicti in Vakhapov's actions and dismissed the case.
Lawyer Irina Biryukova told 7×7 that the defense intends to appeal against the illegal detention of Vakhapov.
On January 9, Vakhapov came to the police department, where he is registered for administrative supervision. There, they tried to detain the man: his car was blocked in the parking lot and a protocol was drawn up against him. According to the police, Vakhapov violated the conditions of supervision - allegedly the former prisoner did not spend the night at the declared address.
After that, he was taken to court, where he was handed a protocol on violation of administrative restrictions (Part 1 of Article 19.24). The meeting was scheduled for January 21st.
