In Crimea, the case under Article 282 against the daughter of a defendant in the Yalta Hizb ut-Tahrir case was dropped

The Alushta investigative department dropped the criminal case against Gulsum Aliyeva, who was accused of inciting hatred or enmity (Article 282 of the Criminal Code) for reposting on Facebook. The head of the international human rights group Agora, Pavel Chikov, announced this in his Telegram channel.

The case was closed at the request of lawyer Alexey Ladin in connection with the decriminalization of the article. The court made this decision because Part 1 of Article 282 of the Criminal Code was partially decriminalized in December 2018.

The case against the daughter of one of the defendants in the Yalta Hizb ut-Tahrir case, Muslim Aliyev, Gulsum Aliyeva, was opened in August 2018. The reason was a repost on Facebook of a “fake quote from the philosopher Ivan Ilyin.”

• On July 19, security forces conducted a search in the house where Aliyeva lives. They tried to find the phone from which, according to investigators, the repost on the girl’s page was made, but as a result they found nothing. After this, Aliyeva was taken for questioning to the Investigative Committee, where she refused to testify. Then she was released.
• Six defendants in the Yalta Hizb ut-Tahrir case, including Muslim Aliyev, were arrested in February 2016. They are accused of preparing for a violent seizure of power (Article 278 using Article 30 of the Criminal Code), five of them are accused of participating in the activities of a terrorist organization (Part 2 of Article 205.5 of the Criminal Code). Muslim Aliyev is accused of organizing the activities of a terrorist organization (Part 1 of Article 205.5 of the Criminal Code). None of the defendants in the case admitted guilt .
