"Miting" at lunchtime: report from the trial over the janitor

The wipers of the Nagorny district on December 28 came to the Building Council, because they were not paid promised for processing the prize. About thirty people were detained, the seven made protocols: the police regarded the meeting of workers as a public action. Later, the Chertanovsky district court fined all seven. “Snow for a janitor is a bad time,” says defender Ruslan Gadzhimuradov. Listening to the judge, he looks out the window opposite. Everything is white on the street - the wipers today clearly have a lot of work.

The defender asks to call the witnesses of the detention and the very meeting of the janitors, which, according to their statements, was not a protest. On December 28, at lunchtime, they came to the district of the Nagorny district, hoping to find the head of the GBU "Housing" there. At another time, the wipers work, and due to the lack of workplace they could count the walks-therefore, everyone came to the council at the same time.

On December 27, the employees of the “Housing” were charged a salary that turned out to be less than the promised. Many of them work seven days a week, at night and in the early morning. Under the employment contract, workers should only clean the yards, but are also forced to engage in cleaning roads and garbage chambers.

The salaries are paid to the janitors in two parts: the salary itself and the bonus. In 2018, Sergey Dmitriev became the director of the State Budgetary Institution, after which interruptions began with the awards. In the summer, the wipers suffered this, but in winter they have to clean the snow, and this is difficult, and they did not want to work for free. In 2017, a criminal case of embezzlement was opened on the previous director of Vladimir Khorshov. According to investigators, he wrote out the bonuses to himself.

In April 2018, the wipers arranged a spontaneous gathering, protesting against the exemptions from the employer. The employees were paid good bonuses, but then the head of the site began to extort the money back, motivating this by order of the director Dmitriev. Having received about 60 thousand rubles, the wipers under the threat of dismissal were forced to return 35. The brigadier Shokhrukh Orolov then recorded a conversation with Orlov on the recorder. According to the employees of the State Budgetary Institution, such a practice with a return of bonuses is widespread, but this time they could not agree to this - there were too many unpaid processing.

Now Shokhrukh Orovov explains to the court in Uzbek that he did not participate in a public event on December 28, but simply came to talk to his boss. Orolov does not speak Russian very well, so there is a translator in the hall. To the question of the judge of Olga Badova, whether Oorolov finds himself guilty, he answers first in Russian “no”, and then-the translator-“yok”.

After the petition of Gadzhimuradov, the court is deleted to call witnesses. One of the witnesses that the defender listed - he came and is ready to speak into the hall. This is the head of ZhSK Igor Ermishin.

“The witness appeared - it is necessary to inform the judge,” says Gadzhimuradov to the secretary of the court session named Svetlana.

Svetlana purses her lips and instantly remarks:

- She is in the decision. That's when it comes out, then we’ll call.

Judge Badov returns, she rejects the defender’s request for the call of witnesses, but she invites the head of the housing cooperative to the meeting room. Ermishin says that Oroolova knows and that he is a law -abiding person. Gadzhimuradov invites him to voice the April history, but the judge does not allow this to do this, believing that this is not related to the subject of the trial.

During the speech of the lawyer of the human rights of Open Russia , Oksana Oparenko, the court becomes like a dictation. Oparenko says that Orolov did not violate the order of public event, and everything that was happening, in her opinion, looks like a meeting of workers with the boss, and not on a rally. Then Oparenko begins to refer to laws, partially reading them from the phone. The judge asks for a slower. The lawyer dictates: "Infusal doubts about the guilt of the face are interpreted in favor of this person." Badova carefully takes these words to paper.

Then Badova again retires to the deliberation room - this time to make a decision. It takes about ten minutes to compile the text, no surprises - to recognize the guilty, 10 thousand are a fine. Oroolov’s case is already the fourth, which is being examined in the last two days of Badov, and each time the result is the same. After Oroolov, she will finish two more janitors from the Housing Housing State Budgetary Institution of the Nagorno region.

During the break between the meetings, the defender of the gadzhimuradov puts on a blue hat, coat, and goes out with his clients to smoke. One of them shoots a cigarette at him, and Gadzhimuradov himself asks the lighter in response. He says that he works an electrician and studies in absentia for a lawyer. In the affairs of the wipers from Nagornoy, he participates for free.

“In the staffing of the GBU“ Housing ”746 people,” says Gadzhimuradov, “and we see, we see, a much smaller number.” There is a suspicion that the schedule is dead souls. But this cannot be proven until they provide an payroll. We requested, but they do not give us.

According to the defender, that is why the janitors who should remove only courtyards have to clean the roads. The janitor Bobur Mamatov, who also drew up the protocol in December, tells about it this way:

- They demand work from us. But if they demand, let them first provide a normal salary, tools, payment for processing. At 8 o’clock the foreman calls and says: "Everything is on Yalta [street- OVD-info ]-clean!" We clean the street up to 12. After that we go to clean up in the yard. Then the “portal”: if it’s dirty somewhere, residents are taking photos and sending to “ our city ”. We go to clean, remove and send it after we cleaned. They work in another site and at night, but they are afraid to complain. We do not have a weekend, such work is not paid.

On February 13, Mamatova was fined , like Oroolova, for 10 thousand rubles. And on February 12, he came to the court to the court to four other janitors. Due to the fact that Mamatov was absent in the workplace, they managed to initiate an official check against him. Someone complained about the mayor’s website that the territory that Mamatov was cleaning was not cleaned on February 12.
