"I stipulated my friends under torture"

Families from three different regions of Irkutsk are fighting for the liberation from the conclusion of their relatives. According to the relatives of the detainees, the only reason for the accusation of their sons and husbands is that they tried to stop the drug trade in their area. Human rights activists notice that in every case, in which unfamiliar residents of the city were detained or accused, there are similar moments and the same “victims”, and most importantly, the same actors from among law enforcement officials.

The pre -trial detention center of Irkutsk, according to human rights activists, contains at least three groups of young people (from 3 to 8 people in each) of three different areas of the city, which experts believe, “crossed the road” from the Topkinsky, Leninsky and Sverdlovsk regions. The detainees go through completely different cases of extortion or abduction, but the same people are witnesses and victims, and the necessary testimonies from the detainees are “knocked out” in the same “press khat”-in the office of No. 406 of the Irkutsk pre-trial detention center No. 1. “Investigators in these matters, of course, are different, but“ for the necessary testimony ”everyone is brought to the pre-trial detention center-1, where the pressers-convicts, who, in essence, should sit in the colonies for a long time,” they know by surnames and nicknames, ”says human rights activist Pavel Glushchenko.

Relatives of the detainees with each other are unfamiliar, but each of them "heard about a similar story on the other end of the city." And each family individually tells almost similar stories with a form in the form of a conflict with drug dealers in their area, with a “conversation with their“ roof ”(but with the same police officer) according to concepts, a series of attacks on especially active fighters with drug trafficking and a sudden initiation of various criminal cases on them.

The largest number of detainees, according to the estimates of human rights activists, on the "Topkin" - a small sleeping area in the right -bank part of Irkutsk. Apart from new buildings, there are only 47 apartment buildings, one school, two kindergartens - everyone knows each other, there are no strangers.

-We are an average family: a working mother and son-student. Ilya (accused of extortion of organized crime groups, Article 163 of the Criminal Code of the Russian Federation. - S.R) 20 years, he studies at the paid department of the university, I work. Ilya has always been an athlete: the first discharge in swimming, Kyokushinkai, boxing, a bunch of letters at home, the whole room is hung with medals, ”says Lyudmila Baturina, the mother of one of the accused Ilya Baturina. - He, like an ordinary twenty -year -old guy, studied in the morning, talked with his peers in the evening, all his friends - from Topkinsky. Here is Nastya ( Anastasia of the Passionate, her husband Rovshan Aliyev is also in the SIZO-1, is accused of extortion and regularly complains about torture.-S.R ) studied with my Ilya, with Dima Kulagin, with Klim, who is also in the pre-trial detention center. Nastya and Ravshan rented an apartment right in the house where we live - they will drive up, they will sit down "at home?", They will go to drink tea. So they were friends. In 2017, their friend, Maxim Plakhov, suddenly disappeared, the boy grew up in the orphanage, but he was from the neighboring area, from Marat, I knew his dead mom and dad well, his dad had an athlete, led a boxing section in which Ilya and other guys from the region were involved. And suddenly Plakhov disappears, we are sitting with his son in the kitchen, and he says to me: "Plakhov was lost." Me: “What happened?”, And he tells me this whole story that they are local to the Local Gypsies from Marat and Topkinsky, do not allow drug trafficking. I heard about this and from others, but did not attach serious significance. I know that the son is a good person - for example, he and the guys organized a regular distribution of fruits to children from orphanages and low -income residents of the district - I have no doubt in it, and therefore did not interfere. See how it turns out: the guys were all ordinary, from childhood they grew up in sight, all together, someone left their circle of communication, someone remained in the army. And for today, 9 people are prosecuted, two more on the wanted list.

According to Baturina and the courteous, the children's attempts to “block the drug trafficking in Topkinsky” began in 2014, when their common friend died from drug overdose.

- They all do not use drugs, athletes, and they saw that law enforcement agencies do not act in any way, although everyone knows who sells drugs. At times, some small performers are detained and condemned, and the tops of these clans are not touched. The guys decide for themselves that there will be no drugs in our area, they begin to drive up to the drug addicts, find out who exactly sells, and begin to say with them: "Guys, let's do not happen so that this is not." And they even manage to solve these issues peacefully-for some time (2015-2016), drugs cease to sell in our area. But then a certain "bulldozer" drives up, seems to be "watching drug trafficking." He, in turn, is supervised by law enforcement agencies, namely an operational employee of the OEP named Pashkov, known under the nickname "Paste". And as soon as they understand that the gypsies began to pay less, the “bulldozer” drives up to Rovshan and says: “Listen, friend, let's work equally - you will receive half, we will share with you, and we will receive half, but at the same time our“ business ”should not stop in this area.” Rovshan says: "No, I am for a healthy lifestyle, I do not need your money." “Well, look, they ran into it yourself,” the bulldozer tells him, and at first he continued the threats - not one meeting, but several. Among the roofing, this drug business is still a certain “half” and “German”. All three came somewhere for six months, tried to "agree" with both Rovshan and other guys so that they would not interfere with dealers. But once their common friend Plakhov Maxim disappears, he had nothing to do with this matter, just a common friend. Why was he kidnapped? Maybe because he is from an orphanage, an orphan, officially no one will go to write statements, his guys will look for themselves. A month and a half, Plakhov was taken to various apartments, hid - as soon as the guys find out where he is, he is immediately transported to another apartment, the day before or on the same day, says Baturina.

- Dmitry Sokolovsky, the nickname "French", Artem Yasenev, the nickname "half", Artem Pavlov, the nickname "German", and Rinat Fayzulin, were abducted by me, I beat me, I lost my consciousness. At first they took me to the apartment to the Pervomaisky microdistrict - I can show where, if necessary. They beat, tortured, mocked, “knocked out” of me false confessions so that I would make my friends - Rovshan, Ilya, the rest. They threatened that they would not let me go and stop torture until I say them, and they would not put the guys. The fact that they would be able to put the guys “in any case”, they explained by the fact that they have “colleagues” in the police, more precisely, mentioned Dmitry Pashkov from Rubop, Marat, 4 ( the third department for the investigation of especially important cases of the Investigative Department of the Investigative Committee of the Russian Federation for the Irkutsk Region. - S.R ). I was constantly transported from an apartment to an apartment - during one of these “transfer” I personally saw this Pashkov, ”says Maxim Plakhov. - In the end, I could not stand it and after a month and a half I signed these torture, there I stipulated my friends that they allegedly engaged in extortion. This is perfect untruth, ready to confirm that the signatures were knocked out under my torture.

Immediately after this, the guys from Topkinsky began to detain one after another - Aliyev Rovshan, Baturin Ilya, Kulagin Dmitry, Strelova Kirill, Ibrahimov Said, Vyacheslav Khandyuk, Ildar Gajiyev, Artem Yakupov and Ararat Vardazaryan.

A few days after the first detentions, Plakhov was released, however, not one of his statements about the abduction, beatings, torture and coercion to give false evidence led to the initiation of a criminal case.

- When Plakhov was abducted, he was practically thrown out of his own car - this car still cannot be found. As a result, from a mass of applications, they have opened only one criminal case - under Article 161, 2 about the robbery of the car! The abduction is not categorically excited. The head of the investigative department for Marat ( the third department for the investigation of the particularly important cases of the Investigative Department of the Investigative Committee of the Russian Federation for the Irkutsk Region. - S.R ) Safaryan, then he was the deputy head of the department in the Kuibyshevsky district, answered one of the complaints: “Yes, you, Plakhov, were kidnapped and kept you a month and a half, but there was no crime under Article No. 126 (Crime Man), ”says Baturina. The most “interesting” is that all these attackers are in the case of our guys to be victims! After attacks, there are photos - they are shown that they were literally shot, a photo of the tracks, wounds, for example, from the last year, there are photographs (at the disposal of the editorial office), where it is clearly visible that the bodies of the guys are like that This car is still at the parking lot, each of the guys entered the hospital with injuries, and as a result, they were not even interviewed by these attacks, although hospitals, of course, reported all cases to the police.

Anna Balakhnichova’s lawyer and Baturina began this case literally on the eve of the approval of the conviction - in November 2018 and had already noted a number of violations by the prosecution.

- I am a new person in this matter, but I already see violations. On the same arson of the pavilion - there are videos, there are witnesses, even you can clearly see who sets it on, it can be identified - and these persons are now undergoing the guys who were allegedly suffered in the case. That is, those who attacked the guys, in fact and who are victims, are now passing like victims! This is nonsense. And the guys are charged with attacks on those persons who actually attacked them. At the same time, the party has no evidence - only the testimony that the victims supposedly give. Here, for example, according to the episode of the victim Fayzulin, the situation is interesting. A certain Fayzulin, who constantly participated in attacks on guys, shootings, stroke of Plakhov, writes a statement of abduction. And when the guys are detained, the testimony of this dubious Fayzulin became the basis (!) To choose a preventive measure. Further even more interesting - Fayzulin writes a statement, indicating the place and time of the crime. Subsequently, on the materials of the criminal case, it turns out that the place and the time of supposedly the crime indicated by him is not confirmed by either the telephone conversations of him and the guys, or the billing of their phones. In fact, at this time, the victim himself was not in this place, and there were no guys there either! All of them were at different points of the city. That is, Fayzulin gives false testimonies, on the basis of which the guys are arrested - all this is recorded in the materials of the criminal case. And when the guys begin to tell their version, when the time and place does not “beat” based on the materials of the investigation, Fayzulin simply changes (!) Indications and says that he did not want to talk about some facts so as not to substitute a friend, or he confused the Oktyabrsky district with Kuibyshevsky.

I saw him already in shackles. Accused of non -urban things

In general, the victims are very interesting - for example, one, nicknamed Mexico, was detained in Bryansk for today in their crime, we are not allowed to talk with him or to conduct a confrontation with him. At the same time, “Mexico” gives such interesting testimonies: I personally did not see anything, I heard anything, but I know everything from the words of the third friend of the fifth man, which was exactly the case - this extinct money, I kidnapped it, but I was not present. And thus "proved" 10 episodes (!). At the same time, confrontation with almost no one, including the victims, were not carried out, ”says Anna Balakhnichova.

The main argument of the innocence of her clients, says the lawyer, the lack of basic signs of organized crime groups of which they are accused of.

- I have repeatedly worked on gang affairs, and here I do not see its slightest signs. To impose banditry, there should be such a sign as profit, as well as cohesion. Neither one nor the other. The suspects themselves have been familiar from childhood, and those who accuse them also know them since childhood, ”explains Balakhnichova. - And completely different articles go along the organized crime group - there is no extortion in any way.

The mother of the other detainee - Tatyana Isaeva, who lived with her son Ruslan on the other side of the city in the microdistrict of Sinyushin Gora, tells a similar story. In June 2018, police officers with witnesses broke into the house of Tatyana, a search was arranged, all phones and equipment were taken, and Ruslan himself, as she found out later, was detained in his wife’s apartment.

- I saw him already in shackles. They accused of non -urban things - supposedly the son abducted people. They put them under arrest for 2 months, then they extended the arrest, ”says Tatyana Isaeva. - Before that, in March, they attacked him and shot his car. They shot the whole clip in the car, then returned - and the second time. On the tangent, they hit a 5-year-old girl who accidentally turned out to be nearby. The case was not brought. Then my son admitted to me that he and the guys declared war on the district drug dealers and the police who cover them.

According to Isaeva, the fight against drug dealers began with his son and his friends after the death of a friend from an overdose.

- From small drug dealers, according to him, the money was collected by a certain Aleksey Knyazev nicknamed “Prince”, Alexander Barychev, nicknamed “Baryga”, Sergey Tyshchenko, or “Pack”. And their policeman, known as the Paste, "roofed". When Ruslan and the guys began to interfere with their "trade", they first suggested that they share the "Navar" equally. They began to threaten the refusal, and then this execution was and the detention began, ”Isaev recalls.

Torture in "Press Hata"

First of all, after the detention of Ruslan in pre-trial detention in pre-trial detention center, according to his lawyer and mother, he was led to camera No. 406, known in the isolator as “torture” or “press khata”.

They are mocking me

- With difficulty, after a week, we got a meeting with Ruslan - to show his newborn son, and he only squeezed out: "They are mocking me." A lawyer made his way to him and handed over terrible things, says Tatyana Isaeva.

According to human rights activists, the detainee was tied on a winch and lifted upside down under the ceiling, drove needles under the nails and poured hot fat in the anus (later the mother of Ruslan Tatiaan Isaev will clarify that the hot fat was poured into his mouth, which, however, does not cancel the very fact of torture).

- And they threatened him with even worse things. The son did not admit anything, he did not take the guilt of a stranger. I don't know how I stood it myself. He was not approved, in early March we are waiting for a court to sanction, we hope for release during the investigation. But now, in the same way, in a pre -trial detention center, his friend Jamol Sobirov is trying to stipulate Ruslan. Will he withstand these torture? - says Tatyana Isaeva.

Anna Balakhnichova’s lawyer confirms the Topkinsky’s lawyer that at the time when they were in custody and when they were detained, they were “physical and moral pressure from both the employees and from the side of the cellmates.”

- Those of them who did not give the “necessary” testimony were taken to other colonies, for example, to Angarsk, to “tear” from relatives, to deprive lawyers. Rovshan was directly taken to Krasnoyarsk, where, from his words, they beat, humiliated and tried in every possible way to knock out readings from him. To do this, our investigator Kulkov with operational employees specially came there to provide physical pressure, the deputy and head of the Krasnoyarsk investigator came. Let me remind you that you can’t just take and transport the detainee from the colony to the colony, the basis is necessary - the basis for “our” movements is always allegedly undergoing that the detainee passes in the case as a witness. And in the end, at first they are taken out for 2 months, then a few more. А поскольку у нас замруководителя ведомства Кудрявцев ( капитан юстиции А.И. Кудрявцев, замруководителя третьего отдела по расследованию особо важных дел СУ Следственного комитета по Иркутской области. – С.Р ) из Красноярска, и друзья его в Следственном комитете тоже оттуда – у них договоренность, что задержанного везут в Красноярск, где будут оказывать давление для того, чтобы тот подписал сотрудничество со следствием. В итоге задержанного, конкретно Ровшана, вывезли свидетелем по делу об убийстве, о котором он вообще ничего не знает, и там его ни разу(!) не допрашивали по этому делу. В итоге он ничего по этому делу в Красноярске не говорил и не подписывал – его вернули в Иркутск и здесь продолжили оказывать на него давление, из-за которого и появилась вот эта 209-я статья (о бандитизме, ст. 209 УК РФ). На этой основе его и еще одного парня уже этапировали на 2 месяца в Ангарск, не предупредив об этом даже адвокатов. Мы нашли ему адвоката там, но в СИЗО ей прямо врали, что Ровшана вывезли, но куда – неизвестно, на какие-то следственные действия. А в это время следователь скидывал ее звонки прямо при Ровшане: мол, достала твоя адвокатша. В это время оставшихся в Иркутске "прессингуют" – мол, твой друг уже ушел отсюда, дает на тебя показания.

– Какой-то есть у них кабинет, где "Паштет", как говорил один из задержанных, шокером его бил, – рассказывает Людмила Батурина. – Насколько я знаю, Дима Кулагин говорит, что ему "пальцы сушат" (бьют по ногтям пальцев) – синяков от этого не будет. Такое продолжалось первые два месяца, под таким давлением они, конечно, давали ложные показания, но потом начали говорить правду. Вообще, их начали бить сразу при задержании: в Братске били прямо лопатами, пока их везли оттуда в Иркутск, останавливались по дороге и опять избивали. Когда Илью привезли на ИВС, их же там осматривают, вот у меня есть акт осмотра из временного изолятора (он мне его передал тайно вместе с курткой): согласно этому документу, у моего ребенка по приезде в Иркутск были изрезаны все колени и живот".

"Кабинет в СИЗО", упомянутый матерью Ильи, хорошо известен иркутским правозащитникам по многочисленным жалобам задержанных. По словам адвоката Дмитрия Дмитриева, его подзащитного Джамола Собирова сразу после задержания повели в камеру №406, известную в СИЗО как "пресс-хата" или пыточная.

– Там группа заключенных во главе с Андреем Бевзюком, который согласно приговору уже 2 года как должен отбывать наказание в колонии строгого режима, и Антоном Яровым жестко запугивают и пытают вновь прибывших задержанных, вынуждая их подписать признания в преступлениях, которых они не совершали, или другие показания. Так, Собирова "прессуют" для того, чтобы он дал показания против своего друга Исаева, пытавшегося бороться с наркодилерами Свердловского района и перешедшего дорогу крышующим их полицейским, – рассказывает Дмитриев.

По его данным, Собирова связывали скотчем, продержав так несколько часов, не давали спать и запугивали изнасилованием. Иркутские правозащитники, получившие аналогичные признания от других задержанных, сообщают о пытках, во время которых истязаемого "случайно" роняют с высоты человеческого роста или насилуют, записывая это на камеру телефона, а после шантажируя видеосъемкой.

По сведениям правозащитников, показания всех пострадавших совпадают: упомянутые Бевзюк (кличка – "Мафия") и Яровой находятся в СИЗО и "работают" в камере №406. При этом в конце января правозащитники заметили в "спортзале" иркутского изолятора двух человек, подходящих под описание Бевзюка и Ярового. "Но они назвать свои имена отказались, а после их не удалось найти ни в одной из камер", – говорит правозащитник Павел Глущенко.

"СИЗО –​ это не к нам"

О перспективах дела в суде адвокат "топкинских" говорит со сдержанным оптимизмом, отмечая множество юридических нарушений, допущенных во время следствия и при утверждении обвинения.

– Обвинение в отношении Ровшана предъявлено с грубейшими нарушениями норм уголовно-процессуального права. Нарушено его право на защиту, ему не разъяснена суть обвинения. Более того, переводчик, присутствовавший при предъявлении обвинения, является по национальности талышом, когда как Ровшан – азербайджанец. И Ровшан ссылается на то, что переводчика вообще не понимает. Если честно, я сама слышала, как разговаривает переводчик, я тоже его не понимаю. Ровшан лучше, чем он, разговаривает по-русски, – рассказывает адвокат Анна Балахничова. – Тем не менее, ему не предъявлен перевод, соответственно, постановление о привлечении в качестве обвиняемого. Кроме того, не участвовал адвокат при предъявлении обвинения Ровшану – меня еще не было в деле, они просили адвоката по назначению, так адвокат по назначению просто убежал оттуда, заявив: "Что вы здесь творите?! Я не собираюсь участвовать в ваших махинациях".

Однако остальные адвокаты оптимизм Анны не разделяют. В этом месяце Дмитрию Дмитриеву, ранее заявившему о пытках в СИЗО №1, начали угрожать по телефону. По словам адвоката, по телефону его принуждают к встрече с неизвестным "уважаемым человеком, отсидевшим 32 года", которого он якобы опорочил в одной из публикаций, когда занимался делом Развозжаева ( оппозиционер Леонид Развозжаев , осужденный на 4,5 года колонии по так называемому "Болотному делу" в 2014 году. – С.Р ) 5 лет назад, а параллельно угрожают "проблемами" и "посылками". Сам Дмитриев убежден, что дело Развозжаева – только повод, а реальная причина угроз – его заявления о пытках задержанных в СИЗО №1, которых истязают осужденные к большим срокам, обязанные сидеть в колониях, а не в изоляторе.

Родственники задержанных тоже напуганы. "На днях мне Илья передал, что этот "Паштет" лично к нему подходил и в глаза глядя сказал: "Никакой статьи о вас не выйдет ни в одном издании области. А вы сядете!" – рассказывает Людмила Батурина.

Примечательно, что возможность незаконного присутствия сотрудника РУБОП или ОБЭП в Следственном изоляторе или изоляторе временного содержания редакции "Сибирь.Реалий" подтвердили сразу несколько правозащитников из не связанных между собой организаций. Так, по словам председателя иркутской региональной общественной организации "Граждане против коррупции и наркотиков" Валерия Кугая, "Пашков по СИЗО как дома ходит".

– Дмитрий Пашков, майор ОРЧ – оперативно-разыскной части – выводит из камеры человека, на которого нужно оказать давление, подводит к камере "прессовщиков", а те орут: "Давай его сюда, сейчас мы его изнасилуем!" – рассказывает Кугай. – Человек тут же начинает подписывать нужные документы. Почему этот Пашков так спокоен и даже не скрывается? У него серьезные покровители: ко мне толпами идут люди, отсидевшие свой срок, они прямо называют фамилию и кличку Пашкова-Паштета, его звание, точно описывают его внешне – и указывают на него как начальника "прессовщиков", и в целом доказательств по пыточным у меня целая папка, на 57-ю тянет ( пожизненное заключение. – С.Р ). И был у нас в ноябре в Иркутской области нашумевший приезд главного инспектора УМВД России генерал-майора полиции Романа Зайцева – он документы у меня взял-почитал, сказал: разберемся. С тех пор прошло два с половиной месяца".

В региональном МВД редакции "Сибирь.Реалий" прокомментировать обвинения в "выбивании показаний" отказались: "СИЗО – это не к нам", – заявил глава пресс-службы ведомства Герман Струглин. Примечательно, что начальник пресс-службы ГУФСИН по Иркутской области Ольга Хинданова жалобу задержанного на истязания прокомментировала схожим образом. "Очевидно, что речь идет о возможных нарушениях в работе следственных органов, – ответила Хинданова. – Работа СУ СК РФ по Иркутской области не входит в сферу компетенции ГУФСИН России по Иркутской области, поэтому рекомендуем вам обратиться с запросом в СУ СК РФ по Иркутской области".

По поводу жалобы Джамола Собирова и его адвоката Дмитриева на пытки задержанного в пресс-службе регионального ГУФСИН заявили, что "30 января с обвиняемым Собировым Д.Ю. беседовали представители Общественной наблюдательной комиссии по контролю за соблюдением прав человека в местах принудительного содержания в Иркутской области. С жалобами и заявлениями обвиняемый к правозащитникам не обращался".

– Конечно, 30 января Джамола уже запугали, он отказался от всех обвинений. В пыточной он сидел с 18 по 29 января. 28 января в СИЗО пришли правозащитники ОНК, его нигде не нашли, следователи (какое совпадение) увозили его как раз на "следственные действия". 30 января Джамол на скайп-сессии в присутствии судьи жалуется на истязания и пытки, его в тот же день переводят в "обычную" камеру и в этот же день он, наконец, встречает правозащитников, говорит им как есть – в этой камере меня уже не бьют. Заявление о пытках он сам так и не написал – запугали. Его написал я, с его слов – 29 января направил в прокуратуру Иркутской области", – говорит адвокат Собирова Дмитриев.

Один из свидетелей обвинения Мехроч Зайниддинов признался Анастасии Любезных, что оговорил ее мужа, Ровшана Алиева, из-за пыток в СИЗО-1. И даже написал соответствующее заявление.

– Мехроч мне признался в наговоре на Ровшана, когда был уже в безопасности, вернулся на родину. Долго просил прощения. Потом согласился официальное заявление написать, я направила его в прокуратуру – ответа по нему до сих пор нет, – говорит Анастасия Любезных.

В начале марта состоится суд по санкциям в отношении Руслана Исаева. Его мама Татьяна надеется, что на этот раз его освободят хотя бы на время следствия. Обвинение ему и Джамолу Собирову еще не утверждено. Однако предыдущие суды продлевали аресты как Исаеву, так и всем другим "топкинским" задержанным.

UPD. Уже после того, как этот материал вышел ГУФСИН по Иркутской области прислал корреспонденту ответ на ранее направленный запрос, в котором сообщается, что "заявления отдельных граждан о наличии "пыточных камер" не соответствуют действительности". При этом врио начальника ГУФСИН России по Иркутской области С.А.Закорко упоминает, что "обвиняемый Алиев Р.Г. 18 февраля 2019 года был осмотрен медицинским работником, телесных повреждений и заболеваний не выявлено". Со своей стороны напомним , что на пытки и отказ зафиксировать травмы медиками СИЗО Ровшан Алиев жаловался в конце октября прошлого года.

На следующий день глава пресс-службы ГУФСИН Ольга Хиндинова сообщила, что обвиняемого Ровшана Алиева медики в последние полгода осматривали ежедневно(!): "Подняли документацию за последние полгода, медицинские осмотры проводились ежедневно, травм не выявлялось. Обвиняемые Исаев Р., Кулагин Д., Батурин И. также ежедневно проходят медосмотры, травм нет, регулярно работают с адвокатами, жалоб на работу сотрудников администрации СИЗО и условия содержания в СИЗО не поступало".
