If you have become a suspect in a criminal case, then you will come to you with a search at the most inappropriate moment for you. Most often - early in the morning. So two different procedural actions, search and detention, will be combined. Then you will be taken immediately and on the third - interrogation.
Dmitry Borisov was detained in a private house of parents:
We arrived very early, in the area of half of the eighth. Mom woke me up with the words: "Police around the house." There were 15 people. I realized that most likely behind me. He did not feel guilty, but understood that he had come seriously. They had a taran with them to break the doors. He did not come in handy, mom opened. I went up to the third, unfinished, floor, because I wanted to ask friends to come so that there was no lawlessness. I did not have time to write the address, as the policeman rose - he grabbed the phone, dragged me down. Then I was taken for interrogation to the Investigative Committee. The investigator asked questions, but I refused to answer, referring to the 51st article of the Constitution. In general, they behaved normally, allowed you to smoke, even advised things warm things with them when they took them out of the house. ”
Ismail Ramazanov , seeing at night in his room of armed people in camouflage, first thought that these were robbers. But then handcuffs put on him and began to beat him. Then he realized that this was not a robbery, but a detention.
“They put me in a chair, none of my relatives were allowed into the room,” says Ramazanov. - I tried to shout at the Crimean Tatar language to my parents, to report that they beat me. In response, they began to beat me again. One of the FSB officers took a towel lying by the bed, and began to strangle me. Hands were fastened by handcuffs behind behind.
Then Ramazanova, he said, was taken to a minibus, where Kirka was lying or something that he took for a pick -up. “You will arise - we rape you with this stick and say that it was,” said FSB officer Arthur Shambazov. Then the detainee was called the “black machine” and began to beat again. The FSB officers alternated questions with beatings, then put Ramazanov on the floor and jumped on his back with their feet, then raised in the seat and began to ask.
Within 48 hours from the moment of detention, if you were questioned as a suspect, the court must choose a preventive measure. You can be sent to the investigative insulator, place under house arrest or limit the unsuccessful subscription. For this, the investigation presents the court with a brief squeeze of the evidence that it already has, and justifies the need for a preventive measure.
Most likely, the court will agree with the option proposed by the investigation. It also happens that the court is not enough evidence. Then he extends the period of detention, allowing the investigation to supplement the application. So it was , for example, with a mathematician and anarchist Azat Miftakhov, and twice in a week.
As Ismail Ramazanov recalls, after beating during the detention he could not go himself, so the FSB officers dragged him into the courtroom. It was painful to sit, but I had to sit. Ramazanov told the judge that he was beaten and broke his fingers, and pointed to an employee who applied violence to him - he was just in the hall at that moment. The judge replied that Ramazanov could not show now those who beat him, since the court does not consider the question of applying violence to him. Ismail demanded a doctor, but no one called an ambulance.
Further, as Ramazanov says, everything was fast: “Everything went almost unilaterally. The court, together with the FSB, decided to send me to the pre -trial detention center. Back to the IVS (temporary detention center- OTD-info ) I was brought by the FSB Shambazov and Maksimenko. They intimidated me again, said that today I still have a chance to sleep on normal bunks, and in a pre -trial detention center I will fall into the cell to the Armenians. Like, they agreed that I would be placed in such a camera, and they will “find application” there, they said: “There are like you, Black -Mesy people are very fond of.”
A person spends the time between the detention and the pre -trial detention center. According to Borisov, in the IVS he was constantly thrown from the camera to the camera:
I spent two or three days on IvS on Petrovka. I was "poured" , managed to sit in three cells. In the first one, a simple pleasant man sat with me, it seems like a booze from someone took something, quite positive. And then they transferred to the old seat, he already had the seventh walker. Also found a common language with him. He treated me with a sandwich with a Knorr seasoning cube, it was very tasty, and shared cigarettes.
Anti-fascist Alexei Gaskarov was in a pre-trial detention center twice: in 2010 in the case of the defeat of the Khimki administration and in 2013 in the “Swamp Case”. In 2010, the employees of the Moscow Region Center for Countering Extremism detained Gaskarov because he was a famous anti-fascist. He spent several months in the insulator, and then went free. But in 2013 he was again detained, a year after the events in Bolotnaya Square. This time he was condemned and sentenced to three and a half years in prison. The impressions of Alexei from two visits to the pre -trial detention center vary:
For the first time, a rather bright feeling was that you get into some shit. From the ceiling, mold, dirt, dumb people around. The first impression: all the time, or something, to live in such conditions? There will be no normal picture before the eyes? There is a feeling that the only salvation from all this is to close internally, to abstract from everything you see. You try to imagine more. When in 2013 I was arrested for the second time and I got to the Vodnik, I thought it was a fake prison. Telk with a large screen, single -tier beds, the toilet is clean.
A person who has first ended up in a pre -trial detention center is unlikely to imagine well where he is and what awaits him. Some stereotypes or scraps of films about prison, individual replicas or words related to the prison subculture pop up in my head.
“I remembered some tales,” says Dmitry Borisov. -I remembered: if someone plays chess while you sleep, you must brutally jump on the table and scatter these chess. This is such a wild advice, as if it were specially created to complicate life. I also remembered the film with Gosha Kutsenko. The man met with a thief in law and had the imprudence with him to spit on the floor. The thief told him: “You can’t do not care about the hut,” and this turned into fatal consequences for humans. I don’t know how effective these tips are, but it is also clear that in the hut you don’t need to spit on the floor. You won’t do not care and at home on the floor.
Here the FSIN employee removes the upper closing chain from the door into the camera, inserts the key into the lock, turn it and opens the door in front of the new one. Ahead is the hut.
“The brakes open and I see the people standing in a semicircle in front of the entrance to the camera,” Borisov recalls. “They greet me kindly.” Offer Chifir . This is such a tradition, a mug of Chify rises for arrival or departure, each drinks in a circle twice. "Welcome. Our hut is fraternal, bright, seek help, do not be alarmed, do not strain, you are at home, ”they say.
A pre -trial detention center is an amazing place where you will meet amazing people whom you would hardly meet in your free life. The defendants in high -profile criminal cases always become heroes of news, and it happens - and entire media campaigns. Today you will see on TV a fight of football fans with police in Biryulev, and a week later the accused in this case will cross the threshold of your hut. But even without celebrities from the criminal chronicle of the pre -trial detention center - a kaleidoscope of lives. The guilty and innocent, killers and smugglers, choreographers, mayors, prefects, lawyers, activists and all-all-all.
Ismail Ramazanov says that in every cell of the Simferopol pre-trial detention center, in which he was sitting, there was one of the Crimean Tatar political prisoners. He heard about one of them, while still in the wild, and with the champion of Ukraine in Taekwondo Uzeir Abdullaev even met at sports. In the pre -trial detention center, Abdullaev was very ill, and Ismail tried to help him, demanding from the FSIN to bring a doctor. But they did not provide medical assistance. Ramazanov believes that he was transferred from this camera to another precisely because of constant complaints about the absence of a doctor.
The defendant of the “Swamp business” Alexander Margolin got into the Moscow pre -trial detention center No. 5 “Vodnik” already with the experience of administrative arrest for the action on December 5, as well as after 12 days for the IVS and ten days in a quarantine chamber. When he got into the hut, where he spent the whole next year, the effect of novelty has already dulled.
“There was no overpopulation, 8 people at first, then they added a skin, it became 14,” recalls Margolin. -Socialists as usual: 228th-drugs, one fraudster, someone has a “hooligan”. Mostly visitors. There was one Balt, they took him with cocaine. Although he was more on another topic - cigarettes in the European Union dragged. It was interesting to talk to him. There was also a peasant-kyrgiz. He was a plastic surgeon, then he fell into a car accident, broke his hands and went to the scammers. They played chess a lot.
Alexei Gaskarov, having hit the cell, ran into a strong desire of the TSPE operatives to find out who ordered the pogrom in Khimki. Different people came to Gaskarov, who seemed “thieves” or “authorities”. They asked how much they paid him, said that someone should “answer for lawlessness” and that “the thieves' gang is concerned about in Khimki,” and that this “kipish” provoked the activity of the police, which is why thieves suffer losses.
So the conflict with the Sideltsi is described in the book of Peter Silaev “The Gaskarov correspondent in hell and other stories”:
Gaskarov began to wait for a black mark - and very soon she knocked out the window. A note came on the road , officially notifying it that today a “serious conversation” will be held at the walking courtyard with him. Lesha looked around his camera. It was stupid, funny and disgusting - is it really the end?
But no “serious conversation” happened because the international campaign began in defense of the “Khimki hostages” and the pressure on Gaskarov in the pre -trial detention center stopped.
By sending a person to a pre -trial detention center, the state suggests that he will be isolated from connections with the outside world. By law, the investigator may allow dates with relatives once every two months. Dates occur without physical contact, through glass, as in American films. The conversation is broadcast through the pipes of interconnected phones.
“For a long time, the trace froze for a long time, I had no dates for three or four months,” says Alexander Margolin. - Then they began to give. They came in turn - a wife with children and parents. Was it necessary to drive children to prison - the question is difficult for me. It strongly depends on the age, on how children perceive it all. It depends on the pre -trial detention center. At the "sailor silence" a huge hall, on Butyrka is also more or less decent. On the "Vodnik" - some cells, the prisoners smoke. The volume is small - if in the second group you go on a date, and not in the first, then there is naughty and smoked, there is no oxygen. A date is, of course, an emotional blow. There were dates at the Vodnik in the morning. About three or four hours I sausated, then I fell asleep, woke up for an evening check, and then went to bed again. In fact, they fell out for a day.
Dmitry Borisov had the first date with his mother:
I was very happy, of course. You are taken to another case, first you hang out on the assembly , wait until you are called into the booth where the date goes. You are a little worried. Many begin to be sad after a meeting. Some even refuse to date, because they are encouraged by negativity. I had it, but it was a light sad. Blues light sadness. A date is a sip of freedom, you are very fueled from free people. Mom was worried about whether they were hitting me, whether they wipe me the floor. Well, mom is always like that.
Over the months in the isolator, the prisoner gets used to his cell and begins to associate it with the house. Returning after the meetings of the vessels or investigative actions to the insulator, he rushes to himself the driver of the car, so that he will reach faster. And even the sour smell of the Baland, and the noise of the “brakes” that lock you in the hut, and the faces of the “longitudinal” in shape - everything becomes familiar, soothing, comfortable. Therefore, to leave for the colony after the sentence, in the unknown is exciting.
The movement of the prisoner from the institution to the institution is called the stage, the stage to the zone is a “ large stage ”. Usually, the FSIN does not tell a person where he is taken, but according to indirect signs, one can guess at least a direction. Autosak brings prisoners to the station, puts it in a special car, then the composition goes to the region, the prisoners are unloaded there, they are planted again to the autozak, delivered to the local pre -trial detention center, where they begin to wait for the passing stage in the colony. In the regional insulator, the prisoner can sit for a couple of weeks until he finally finds himself in the zone.
Alexei Gaskarov was sent to the colony at the end of December:
I was pulled out right before the New Year, I, consider it, met in the "Stapka" in the zone. The standard compartment, there are many people, 14 people. Dogs, dashes, people who go by unknown where. I took food with me, because it seemed that we could hang out in the regional pre-trial detention center for a long time due to holidays. And the rest did not do that. On the first day, we ate everything that was, as a result, the New Year we had from black bread and balija. It was funny there, all this atmosphere, all these people are in the form of ridiculous, a blat committee that brings Grev , congratulates: sweets, tea, cookies. It was all as if you were not living your life now.
Alexander Margolin left the Moscow pre -trial detention center at about the same time as Gaskarov:
Malyava from Gaskarov comes to me on the “road” that we were “ordered” . I think: "Stage-finally!" You are sitting in the “Surrok Day”, and here is the stage. I spent two years at ten meters and already really wanted to go to the zone. Well, you always hope for something, for parole, for example. The air is clean, again. And they don’t order me. I pull the longitudinal. “They didn’t order you,” he says. I sat more for another two weeks, it was strange. Then they still ordered me. I cut his hair, began to prepare. I had three scammers in the hut, there were dofiga products. I left with two bauls of clothes and food.
“Visually, the colony is better than a pre -trial detention center,” says Alexei Gaskarov. - But the first impression is not clear how you can spend a long time here. How a thousand people can live in such a relatively small territory. And then, when I went into the detachment, I felt terribly: a lot of people, very very, and the feeling that nowhere to put myself. The first week I filed. The cops come in constantly, and at first you sleep in the most uncomfortable places, there is some kind of “consumption” nearby, screams constantly.
Dmitry Borisov was sent to the colony, although he had to sit for less than a month. He never reached the colony: he was left to sit down the last days in the single chamber of the Belgorod pre -trial detention center:
It was hard for me there, there was not enough communication, one is really hard to sit alone. I did not reach the colony, but I felt the spirit of the “red” camps there from the first steps. When we arrived only, we were thrown into the assembly, and it seems like an old, provincial, wooden uneven floors, but everything is very clean and licked. This immediately strained me on the assembly, and, as it turned out, not in vain. We lit a cigarette, an employee of the FSIN ran to us, grabbed one young Belarus with some funny article like 228–1, dragged into the corridor. We heard how he was beaten simply because he lit a cigarette in the wrong place. Compared to Butyrka and Water, the wildness was hellish. Then they ran in, grabbed another guy, such a sporting one, we heard such strong cries, through iron doors clearly and chattering of a stamper. The Belgorod Central is some kind of horror, flower-vasilers outside, and inside-Adesche, "red". Someone experienced suggested that they thus want to drag this healthy man into his gulture world, so that later he himself already in the hozot detachment would already carry out “acceptance” .
The itchy thought of liberation is constantly pestering the prisoner. Everyone wants to free himself, although it’s scary, like a first date with a lover. And the closer to the release - if you know the exact date, the more difficult it is to restrain, endure and wait. Dmitry Borisov came out at the end of the deadline, Alexander Margolin was released by parole, Ismail Ramazanov was released after the decriminalization of the 282nd article of the Criminal Code from the Simferopol pre-trial detention center, and Alexei Gaskarov was released for the first time due to the complete lack of evidence of his guilt, in the second-already from the zone, having served a full term.
“The second time there was no euphoria at all,” Gaskarov recalls. “I was guided by the time when everyone usually comes out.” As a result, I was taken out an hour earlier, I did not have time to say goodbye to everyone, to collect things. Visually, everything changes sharply. We stood at that place at large, which I all the time I saw from the case in the colony. The first to see the building where it was necessary to receive a passport. He was released already in a civilian, in advance “tightened” his clothes.
