The history of the construction of the Vostochny cosmodrome in the Amur Region is a series of loud scandals and criminal cases against the leadership of Dalspetsstroy, the general contractor of the "space" construction. The cost of building the facilities of the Cosmodrome was estimated at 300 billion rubles. The deadlines for the delivery of key objects of the Eastern were repeatedly postponed. Over the past few years, five heads of the company accused of fraud and large thefts appeared in court. The damage caused to the state of the top managers of Dalspetsstroy is estimated at 10 billion rubles.

At the same time, the company's management through the court pursues its former ordinary employees, who are suspected of embezzlement and theft of equipment from the cosmodrome.

Mechanic Sergey Barashchenko worked in Dalspetsstroy from 2010 to 2015. He could not celebrate the five -year anniversary of his work: the company accused him of shortages. Since then, the former employer drags Sergey on the courts, forcing him to prove that he had not stole anything. However, neither his arguments, nor even found at the cosmodrome, supposedly stolen, the equipment of numerous courts take into account.

- Refuse the requirements? At all? - It seems that the judge of the Zheleznodorozhny District Court of Khabarovsk is surprised by such a turn of the process.

- Yes, your honor is completely refused, we offer a settlement agreement. Here is the project, ”repeated the lawyer of Dalspetsstroy.

Anna and Sergey froze, not believing their ears. Will this nightmare end now? But it turned out that it was too early to rejoice.

- No, well, let's even write off these clamps with Barashchenko! - suggested the judge.

Monthly challenges to the court and to the investigator, negotiations with the leadership of Dalspetsstroy - to such a schedule, the wife Barashchenko has long been accustomed for three years of lawsuel with a company, in which Sergey "was lucky" to work. And at first this situation seemed a terrible dream.

“The first year was held as in a fog,” says Anna Barashchenko . -With horror, they were waiting for the bailiffs to come to us, they would begin to describe the property. We were even going to transport furniture, equipment to parents, everything that is of value. With these nerves, stresses permanent, I lay several times in the hospital. The husband was left without work, the child had problems at school - all this grew like a snowball, and the exit was not visible.

The bailiffs really could come to their house. According to the first court decisions, Sergei Barashchenko was found guilty of the shortage of equipment. The amount of "stolen" amounted to almost a million rubles. Lawyers of Dalspetsstroy initially demanded to recover 3 million rubles from Barashchenko, insisting that Sergey assigned several welding machines for the joint welding of large -diameter pipes and their spare parts.

Barashchenko did not agree with such a decision, and his colleagues suggested that some of the missing equipment should be looked for at the Vostochny cosmodrome. Prior to this, the mechanics had to deal with the “unofficial” movement of technology and the debiting of fuel: he even reported on such actions of his colleague to the head of the production base. Therefore, he insisted on a second revision. Indeed, half the shortage was immediately “found” in October 2015 at the cosmodrome.

A similar situation, Sergei says, occurred with his colleague. True, the size of the shortage of he was several times less, so he decided not to spoil his life, to give in and simply gave the money. But Barashchenko did not have extra million rubles, and why pay for if he knew for sure that the equipment was incomprehensible to the disappearance of equipment?

The case began like this. After the next inventory, Sergey called the head of the production base and offered the choice: either you quit on your own and compensate for the shortage, or you will leave the article and you are dragged on the courts. The mechanic refused to pay.

Friends advised him not to contact Dalspetsstroy. Like, what can you do against such a giant. After the first court, when the family made it clear that she would not reconcile with the accusation, they had problems.

“We have a small city, it turned out that my leader is familiar with someone from Dalspetsstroy,” recalls Anna Barashchenko . - And it began. I am writing a statement for the Riddle to be with my husband in court, but they do not give it to me without any arguments. They tried to cut the prize. Many acquaintances and friends turned away from us: it seems like not to contact us. Like, they would pay a shortage and calm down, they would live, like all people, without problems, spoke around. But if we pay, then Sergey admits that he is to blame!

When the couple turned to the media in search of protection and help, they began to put pressure on them even more. Even to their children at school, teachers began to make various complaints. Therefore, Barashchenko decided to go to the extreme measure - they changed their last name. After that, life became a little calmer. The spouses ask not to disclose their new surname.

At first, while the manager Anna and the mechanic Sergey have not yet figured out all the intricacies of the trials, they hired lawyers. And each time they had the impression that lawyers also did not believe in the success of this matter. And there was a lot of money from the meager family budget for the services of defenders.

“Some lawyers immediately refused our case, someone proposed to make a deal, conclude the“ world, ”recalls Anna. - Then I myself tried to make one statement - it turned out. Then the second. So it went.

Now Anna protects her husband and represents his interests in court without the help of lawyers. At the same time, she studies at the university and is going to get a degree of a master of jurisprudence this year.

At the appointment of the Khabarovsk garrison, which is investigating the activities of Dalspetsstroy, the couple go to work as a job. Every week, if they did not receive an answer to their next statement or do not agree with the receipt received, they are again and again to the prosecutor.

- I studied the pile of legal documents and came to the conclusion that all the inventory took place with violations of the regulations. I wrote a petition about this, but they didn’t even want to listen to us, every time the same answer: to reject, ” Anna recalls. - We have already passed all the “circles”, up to the Supreme Court. Once we sent a court decision exactly the same as a month earlier. The text was repeated word for word, under a carbon copy. I had to complain and demand the replacement of the judge. At that time, the decision was immediately canceled.

To find the missing equipment, the family for two years has sought to initiate a criminal case and opening several containers on the basis of the cosmodrome. In containers, investigators discovered the same welding machine, of the theft of which Sergey was accused, only without an inventory number:

"In addition to the welding machine, the equipment was found at the Vostochny cosmodrome as the missing and registered by S.A. Barashchenko in the amount of about 1.5 million rubles ... the sheet was written off in 2012, but now this sheet was imputed in the shortage of S. Barashchenko for some reason, for some reason, the equipment of the unfortunate persons was changed by unspecified persons. Inventory numbers ” - as the investigator from the military department of the Russian Investigative Committee on the Khabarovsk garrison described the results of the audit.

The fact that for the Barashchenko family seemed obvious: here, there were equipment - the courts did not accept as new circumstances of the case. Appeals, petitions, an attempt to change the judge for two years, but each time they have come across a blank wall.

They told me directly: I'm sorry, we learned about your courts and cannot take you, so problematic.

In parallel to the process of recovering the shortage that Dalspetsstroy began, Barashchenko is also conducting another matter. They are trying to remove the article "On Farily" in the work book of the head of the family and to obscure illegal dismissal. After all, all these years, the family budget consists of Anna's salary alone. From time to time, Sergey is working as a taxi driver, but he cannot find official work, and even with a good salary.

-The judge tried to somehow shame me, they say that you don’t work anywhere, you sit on your wife’s neck. And what if they do not take to work? - says Sergey. - Once everything seems to be already, got a job in a good company. And then they told me directly: sorry, we learned about your courts and cannot take you, so problematic.

As Anna found out, compensation is laid for her husband for illegal dismissal. According to her, the compensation already exceeds the amount of the shortage that they are trying to recover from Sergei. Perhaps that is why this summer, during one of the meetings, the lawyer of Dalspetsstroy unexpectedly invited the family to conclude a settlement agreement, completely abandoning financial requirements.

True, right during the court hearing, the judge advised to impose Barashchenko at least 3,000 rubles “shortages” and sent a draft settlement for revision.

- The wording is such, they say, they understand the difficult material situation of the family and therefore refuse all the requirements. But if I sign this agreement and pay three thousand, then I come out, I admit my guilt! Then they can challenge this amicable agreement and again begin to recover from me those old 1.5 million rubles, and maybe all three that were with the first revision, ”says Sergey, who lost all faith in the honesty of employees of his former company.

The spouses did not agree to a settlement agreement under such conditions, and it all started in a circle: cassation, appeal, return to the court of first instance, and again appeal. But until Sergey return his honest name, they will not give up.

“Last week, I still“ squeezed ”the investigators-they had to start a criminal case on the leadership of the base,” Anna tells about her achievements. - Now the court is simply obliged to send the case for a review due to newly discovered circumstances. And if not, well, we will appeal again. I write these claims at a time. Only here are the state exams next week, you need to prepare. While we are judging, I have already graduated from the university.
