The bill on insulting power on the Internet is adopted in the second reading

Today, March 6, the State Duma adopted in the second reading a bill on the fight against the dissemination of information on the Internet that expresses disrespect for society, the state, the official state councils of the Russian Federation, the Constitution of the Russian Federation or the bodies exercising state power in the Russian Federation.

According to the State Duma website , the bill introduces the procedure for restrictions available to this kind of information:

• The Prosecutor General of the Russian Federation appeals to Roskomnadzor with a request to take measures to remove offensive information and to restrict access to the resource if the material is not removed.
• Roskomnadzor defines the hosting provider and sends him a notification of the violation and the requirement to remove offensive information.
• The provider, having received a notification from Roskomnadzor, must immediately inform the owner of the resource about this.
• After that, offensive information should be deleted during the day.
• If this does not happen, access to the resource is blocked. The blocking will be removed only after the owner of the resource removes the material and notify Roskomnadzor about this.

Amendments to the Code of Administrative Offenses of the Russian Federation regarding responsibility for the distribution of offensive information were also approved: an administrative fine of 30-100 thousand rubles for the first violation, a fine of 100-200 thousand rubles or administrative arrest for up to 15 days for a repeated violation.

“In the event that the actions were committed by a person who had previously been subjected to administrative punishment for a similar administrative offense more than two times - a fine of 200 thousand to 300 thousand rubles or administrative arrest for up to 15 days,” the State Duma said.

The bills on the fight against the insult of power on the Internet were developed by members of the Federation Council Andrei Klishas and Lyudmila Bokova and State Duma deputy Dmitry Vyatkin (United Russia). The bills were submitted to the State Duma in December 2018 and at the end of January 2019 were adopted in the first reading .
