The Moscow City Court extended the period of detention and house arrest for those involved in the “New Greatness” case

The Moscow City Court extended until June 13 the period of detention and house arrest for defendants in the New Greatness case accused of organizing an extremist community.

According to the decision of judge Elena Pospelova, Anna Pavlikova, Maria Dubovik, Maxim Roshchin and Sergey Gavrilov remain under house arrest. The rest of the defendants - Ruslan Kostylenkov, Dmitry Poletaev, Pyotr Karamzin and Vyacheslav Kryukov - are in jail.

According to the investigator, the defendants in the case are accused of a serious crime and there are no grounds for changing the preventive measure. He summarized that the criminal case consists of 26 volumes, all witnesses have been interrogated, 27 examinations have been carried out - the longest one lasted three months.

The investigator asked for time to transfer the case to the prosecutor's office and familiarize himself with the case materials for the defense. The position of the investigation was fully supported by the prosecutor.

The defense, on the contrary, believes that there is no need to extend the guard and house arrest, since the investigation has been completed and all investigative actions have been carried out.

Anna Pavlikova's father, Dmitry, noted that his daughter's health was severely compromised and she needed constant medical supervision. “Her condition is only getting worse. If it is possible to apply a soft measure of restraint, this will not interfere with the case, but will testify to the humanity of the court, ”Pavlikov noted, asking to soften the preventive measure for his daughter on recognizance not to leave.

“I would like to improve my health,” she added.

In turn, Dubovik asked that she be given the opportunity to start studying at the university and pass the exam. Her defender Karinna Moskalenko is convinced that her client justified her trust when she was under house arrest. “I also ask that this girl be given the opportunity to study. She's wasting time! There is an opportunity to choose a preventive measure that is not so serious and allows you to attend school, ”added Moskalenko.

Kostylenkov's lawyer, Svetlana Sidorkina, categorically disagreed with the position of the investigation, noting that the lawyers and defendants in the case were already familiarizing themselves with the case materials. “The arguments of the investigation are unfounded and illegal,” the defender said, noting that all grounds for extending the guard had long since disappeared.

She was supported by other lawyers, they asked all the accused to mitigate the measure of restraint not related to deprivation of liberty. Lawyers for Poletaev, Karamzin, Kryukov and Kostylenkov offered to transfer their clients from the pre-trial detention center to house arrest. They submitted documents to the court, according to which they can be kept under house arrest in their apartments.

“We are now getting acquainted with the materials of the case. It will be productive if we are under house arrest. It is much more difficult to study materials in a pre-trial detention center, ”complained Kryukov.

Karamzin added that all the time that he was in the pre-trial detention center, he did not have any malicious intent to influence the investigation and other persons. “On the contrary, I’m interested in the case being investigated and a fair verdict,” concluded Karamzin.

In the New Greatness case, 10 defendants are accused of organizing an extremist community (Article 282.1 of the Criminal Code). Until August last year, Pavlikova and Dubovik were in isolation. After a wide public outcry, at the request of the investigation, the girls' preventive measure was changed to house arrest.

Last week, one of the defendants in the case, Rustam Rustamov, was sentenced to 1.5 years of probation. The court considered the case in a special manner, since the accused pleaded guilty to aiding participation in the activities of an extremist community (part 2 of article 282.1 with the application of part 5 of article 33 of the Criminal Code) and entered into a pre-trial agreement.

According to the case file, a man under the nickname "Ruslan D." invited the activists to create a political movement, wrote a charter, developed a political program and rented a meeting room. He is a key witness in the case. Although the defense insists that "Ruslan D." was an informant or possibly an agent provocateur of the special services.
