Last week, a phenomenon rare for the current Russian justice took place: the jury in the Grandmother's District Court of Moscow issued an acquittal of the accused in the infliction of serious bodily injuries that caused death, as well as to give bribes to officials and extortion of money. In December 2015, a series of strange deaths in the largest isolator of the Moscow SIZO-4 was interested in me as a member of the Moscow ONK. In less than two months, five prisoners died there in different cameras on two neighboring floors (Galygin, Tashketbaev, Grigoryev, Shiryaev, Kuzmenko), and two other suicide.

During the survey, the cellmates of those who died in the same text informed the PMC members that they went to bed in the evening, and in the morning they saw that their neighbors had died.

One, they say, had his heart, the other had sinusitis, and he suffocated in a dream, the third had nothing at all, but he fell from the second tier, hit his head and died.

Employees of the insulator also convinced the members of the PMC of the accident. But I did not believe them and found in the psychiatric department of Butyrka one of the suicide attempted in the SIZO-4 Kirill Pratko (convicted of 19 years for the production and distribution of drugs).

On the evening of December 1, 2015, Pratko was unexpectedly transferred to camera No. 307, in which the Polozheneta Evgeny Rozhkov was located. According to Pratko, the horn demanded 500 thousand rubles from it. “I told him that my brother sends me a monthly eight thousand, of which I give five“ to the landscaping of the moon ”(that is, to the common boiler). I have no more, ”Pratko told me. But the horn set the condition: “Either half a million, or you will go to the“ roostseter ”. To be saved, Cyril Pratko inflicted stab wounds on himself.

As I managed to find out then, the extortion of money from prisoners in pre-trial detention centers was put on stream. First of all, money was extorted from the accused under Art. 228 (drugs) and Art. 159 (fraud). The amounts ranged from 300 thousand to one and a half million rubles. As the prosecutors, the horn, baby, Afonya, Pasha Lyubertsky (Pavel Matveev, a member of the Lyubertsy organized crime group were repeatedly repeated, was sentenced to 15 years of strict regime for banditry, robbery, illegal storage of weapons, murder) and other elite prisoners could freely move along the isolator. When the thieves had to go to other cameras to solve their affairs, they called the operatives, and they opened the right cameras with them, and they themselves stood outside the door in the shuher. “According to information about the translations of Shchipantsev from the camera to the camera, we see that he freely moved along the isolator, as in a pioneer camp,” said the prosecutor written by me three years ago on the pages of the “new” prosecutor in the process of the baby and Afoni. “And in general it was not clear who accompanies whom - either the operational employees of the Shchipantsev, or the Wedpers are walking operational employees.”

This began, according to the prisoners, since the Powder in the SIZO-4 was a prisoner nicknamed “Don’t be a wake” (Mikhail Mikhailov, the leader of the Lyubertsy organized crime group that included the Schipants. Some operatives, according to the prisoners, themselves extorted money from the prisoners for “so that everything was fine with them (with prisoners)” in the isolator. The amount of the monthly fee was from 15 to 50 thousand rubles.

By the way, one of the former prisoners of the SIZO-4 Ildar Abdrakhmanov told me (and the same testimony, according to him, he gave the investigators) about the extortion of his money by opera Yuri Rusanovsky. I interviewed the former employee Abdrakhmanova Julia, who, under the audio recording, confirmed to me that she personally, at the request of Abdrakhmanova, handed over to Rusanovsky she bought a mobile phone and ten thousand rubles. According to Abdrakhmanov,

This was a fee to the operative to Rusanovsky for the opportunity to be in the isolation ward without raids by crime and employees.

In addition, at the direction of the roof or baby, the investigators brought the prisoners he needed to the prefabricated department to the first floor, where the horn, Afonya, Kid, Pasha Lyubertsky and others beat the prisoners, demanding money.

The prosecutors in the process also spoke about this, and it was precisely such testimonies that the former prisoner of the SIZO-4 Roman Imyschuk, who, along with other prisoners in the last days of December 2015, was taken to the assembly. The kid beat them and demanded 100-150 thousand from each. “The operative and two employees of the regime at that time were outside the door, everything heard, including screams for help, but did nothing, periodically looked into the eye, at which the Schipants said“ everything is fine with us ”and continued to beat.” The relatives of Myshshchuk transferred large amounts of money to the cards indicated by the baby and Athos (the New Gazeta published screenshots of these transfers). However, the investigation did not take into account the testimony of Myshshchuk.

The delivery of prisoners for beating and extortion was also spoke of the delivery of the baby at the request of the baby by the prosecutors at the court meeting.

They worked for the baby

Phones, SIM cards and drugs were supplied to the SIZO-4 centrally-through Sasha-Major, who then passed all this to the horns for the sale to prisoners. Sasha-Major is, as I already wrote, Alexander Stupin, the former chief of the operator, was dismissed of his own free will. A criminal case was instituted against Stupin for extortion with causing serious harm to the health of the victim and the abuse of authority with the causing consequences. Now he is under house arrest, does not admit his guilt. His case is now listening to everything in the same Babushkinsky court. The money that extorted the horn and his team, the relatives of the prisoners were transferred to kiwi-pies, tied to certain phone numbers that were assigned to the cameras. Then the money from these accounts was transferred to the accounts of the wives of the roof and Afoni.

I repeat about all this, I wrote in my articles three years ago. The prosecutors spoke about the same facts.

By the way, prosecutors at the trial especially paid attention to the privileged position of the baby in the isolator (they called his camera “gold”), which was created by the employees of the pre -trial detention center. Employees are the chief of the isolator Alexei Khorev (the same lieutenant colonel of the internal service, who paced the isolator in a short black T -shirt with a thick golden chain on his neck. After the articles in Novye, Khorev was forced to retire, was not held criminally liable. Now he is working as the head of the CSKA sports club branches.

This is the already mentioned Stupin, at whose direction the baby at any time of the day could move freely along the insulator, go to any camera and train in the gym. Stupin supplied the baby with sports nutrition, and he, in turn, coached Stupin. And I must say, Major Stupin achieved success: in the bench press in the open championship of Russia in 2015, Stupin fulfilled the standard of master of sports. “In his free time from the service, he (Stupin) is intensively involved in sports in order to achieve even greater success in the future, thereby showing his rivals that real athletes serve in the criminal executive system,” the website of the Moscow jailers said.

These are opera xenophores and smokals, which, in the case of checks, carried out huge bags with prohibited items from the chambers (these were also burners, coffee makers, etc.) and attributed them to the office to the hub. After the inspections, the things returned back (the prosecutors were talked about in the process of the Shchipantsev -Afanasyev).

As mentioned above, a criminal case was instituted against Ksenofontov, but with respect to Grigory Smorkalov, fate was more favorable: he simply quit the pre-trial detention center-4 and returned to his native Kirov. The criminal case was not instituted against him. Although, as the prisoners of SIZO-4 told me,

The prisoner SIZO-4 Sergey Kalinin told me that one day he and several more of his cellmates did not feel well, wrote a statement to the medical unit, "so that the doctor looked, gave pills."

“The next day, these <...> 6–7 people come to the camera, well, such healthy people, crime - a horn, baby, Afonya and who sits together there, and beat for a medical university. People, they say, are tearing away from business, ”Kalinin described the situation. - It usually happens at seven o’clock in the evening when the restorations leave, only operatives remain. Here the operative gives them. They come in. Yell: "Get up, bitches!" The door remains open. The employee stands in the corridor. Waiting for them to deal with us. When these pumped up came to our camera and began to beat us, they said that if we again disturb the paramedic Irina Vyacheslavovna (paradise), then they will put us in the 309th camera (pressat).

Here I have a certificate: "Act on bodily harm from November 27, 2015." It says: "Double -sided paraorbital hematoma, a bruised wound of the right superfluous region." This certificate was given to me only because the convoy did not want to take me to court in this form. My whole face was black from beatings. And so they would not give anything. The baby and Afona beat me for writing a statement to the medical unit. The next day, the operative Grigory Smorkalov came and said that I would write an explanatory that I myself had fallen from the second tier of the bed at night, because I dreamed of nightmares. Well, I wrote. "

And here I move to another person, which ensured the comfortable existence of crime in the Bear pre -trial detention center, is the paramedic Irina Paradise.

As the prisoners told me

When the prisoner came to the paramedic of Rayskaya, then at first she asked: are you “black” or “red”, that is, crime or cooperating with the administration? It depended on this whether it would be treated or not.

According to the prisoners, Irina Vyacheslavovna provided medical assistance to prisoners only with the permission of the baby.

In order to get a referral to the hospital of "Sailor's silence", according to prisoners, it was also necessary to get the baby's consent. Paradise unquestioningly obeyed to Schipantsev. As the prosecutor said in the process, there were no love relationships between the baby and Paradise, but the so -called friendly. In the sentence of Paradise, their relationship with the baby is called "extravagant."

In the summer and autumn of 2015, the baby twice asked the senior lieutenant of the internal service Irina Paradise to purchase in a pharmacy for him tablets from high pressure, to normalize the liver, vitamins and a remedy for fungus on the nails. The kid told Paradise that he had no cash, so he would transfer money to her to the card. But the money was not transferred to the baby, but by friends and relatives of trusted prisoners. For the first time, Paradise received 15 thousand rubles from the baby for the purchase of drugs, and the second time - 40 thousand.

The purchase of purchases amounted to 52,235 rubles 21 kopecks. The baby defined this money as a reward for troubles.

It was to the accounts of relatives close to crime that the prisoners received money that the baby, the horn, Afonya and others forced the sidelists to pay them in the form of a quarrel (this was repeatedly declared both the prisoners themselves and their relatives). This money went not only to the purchase of medicines for the baby and the Paradise bribes, but also to pay Sasha-Mayoru, and for the financial support of the baby’s family.

According to the prosecutor, in 2015, the baby's proxies more than ten times cashed out of 150 to 300 thousand rubles. And this money, according to the prosecutors,, at the direction of the baby, was given to Stupin. Paradise also, at the request of the baby, transferred large amounts of money to relatives for the relatives of Shchipantsev: the son of Shchipantsev - 70 thousand rubles, the mother of the wife of the Schipantsev - 120 thousand, the wife of Shchipantsev - 210 thousand. The prosecutor at the trial said that, in her opinion, the Schipanites wanted to have his own people everywhere: “His connections spread like a web, throughout the investigative insulator, especially taking into account the fact that he had been there for six years - from 2010 to 2016.”

When the clouds of the SIZO-4 began to thicken, and a criminal case was opened, the paradise hastened to quit, and then even supposedly sincerely admitted the deed and repented.

In December last year, the Grandmother's District Court in a special order examined the Paradise case under articles on receiving a bribe and excess of official powers. Punishment - three and a half years conditionally and imprisonment of the title of senior lieutenant. After dismissal from the pre-trial detention center-4, Paradise worked at Dobry Doctor LLC, and now he is working as a consultant in the pharmacy chain of Mobilfarma.

In connection with this sentence, I have questions: why did the paramedic Rayska is not punished for non-ordering medical care to prisoners, what did the prisoners of the SIZO-4 repeatedly spoke about? Is heavenly along with other employees of the pre -trial detention center, as well as with a mug, baby, Athos was not part of an organized crime group (organized criminal group)? And, by the way, at first the Investigative Committee was going to initiate a criminal case on SIZO-4 precisely under the article on the organization of organized crime groups (Article 210 of the Criminal Code of the Russian Federation), where the punishment was up to life, but then for some reason everything went wrong. But about the investigation a little later.

Now I want to dwell on an episode with the death of a prisoner Shiryaev. It was on this point of the prosecution (part 4 of article 111, “intentional infliction of grievous bodily harm, which entailed by negligence of the death of the victim,” provides for the punishment of up to 15 years), the jury justified both Shchipantsev and Afanasyev.

At the trial in the case of Shchipantsev, the prosecutors said that in the isolator there was a ban introduced by crime, on a demon in a pre -trial detention center in drugs. Like, this was a crime agreement with the leadership of the isolator. Да, договоренность была: запрещалось «затягивать» в изолятор наркотики через продуктовые передачи, якобы чтобы не подставлять родственников. Но это не значит, что в «Медведе» не было наркоты.

«Наркотиков здесь хватает, — рассказал мне один из заключенных СИЗО-4. — Метадон и героин. То, что любят ребята. Это даже не любовь, это — рычаг. То есть ты на крючке, с тобой гораздо легче работать. Это для общей массы — запрет. Только белая кость потребляет. Здесь ничего не покупается. Это — угощение. Я знаю человека, он не имел к наркотикам отношения. Встречаю через полгода… что с тобой? Расскажи правду. Да ты ж колешься! Кто тебе дал первый раз попробовать? Ага, мне все понятно. Он это делал не сам, а по команде. Подсаживают».

Как неоднократно рассказывали мне арестанты СИЗО-4, поставка наркотиков в изолятор контролировалась Рожком. Поэтому попытки родственников передать наркотики через продуктовые передачи жестко пресекались положенцем и его командой. Если в бюро передач обнаруживали наркотики в продуктах, то об этом сразу же сообщалось Рожку и Малышу. Они тут же шли в камеру, которой предназначалась передача, и, как любит выражаться Малыш, «били до поноса». Но иногда сотрудникам изолятора не удавалось обнаружить наркоту в продуктах, и она доходили до адресатов.

Именно так, через продуктовую передачу, в ноябре 2015 года заключенные Леонид Ширяев и Никита Нистратов получили метадон. Метадоном были пропитаны сухари. Ширяев с радости объелся сухарей, и у него случился передоз. Всю ночь сокамерники пытались привести его в чувство. На утренней проверке сотрудники изолятора обнаружили его в состоянии передоза и велели отнести в медсанчасть к Ирине Райской. И вот здесь я хочу задать вопрос прокурорам: почему вы не вызвали в суд для дачи свидетельских показаний бывшего заключенного СИЗО-4 Ильдара Абдрахманова? Ведь его фамилия есть в списке свидетелей!

Вот письменные свидетельства Абдрахманова, которые он мне передал, находясь в СИЗО-4:

«Так совпало, что в это же время я по записи шел в санчасть брать таблетки на всю свою 302-ю камеру (потому что наш врач Ирина Вячеславовна установила правило, что от каждой камеры выходит только один человек, чтобы, видите ли, ей было легче работать). И, зайдя в санчасть, я лично видел, как двое арестантов держали Ширяева и Ирина (врач) пыталась ему что-то уколоть.

(Прокуроры на суде говорили, что у Ширяева была большая шишка на шее, потому что ночью сокамерники кололи ему в шею соляной раствор. Но, скорее всего, эта шишка могла появиться у него после манипуляций в санчасти. — Е. М. )

Чтобы я лишнего не видел, Ирина (врач) крикнула продольному: «Уведи его отсюда!» И я, не взяв лекарство, ушел обратно с пустыми руками.

А ночью того же дня в камеру № 302 закинули Нистратова Никиту. Он был весь в синяках, у него помимо гематом были сломаны ребра. На мой вопрос, что случилось, Никита рассказал всю эту историю про себя и Ширяева и добавил, что Ирина, медсестра, все-таки привела в себя Ширяева, и его увели обратно в 313-ю камеру. А вот вечером туда зашли Малыш и Рожок и стали избивать Никиту и Ширяева. Малыш избил Ширяева до такой степени, что Ширяева увезли в больницу. Как я узнал через несколько дней у оперативника Гриши Сморкалова, Ширяева доставили в больницу, сделали трепанацию черепа, но от нанесенных ему травм он скончался. И это, поверьте, не единственный случай в СИЗО-4! Сейчас в ГСУ СК по СВАО Москвы в Бабушкинском отделе возбуждено уголовное дело по убийству Ширяева. Никита Нистратов является жизненно важным свидетелем убийства. А Сергей (Малыш), находясь в СИЗО Зеленограда, оттуда по мобильной связи пытается совместно с Рожком запугать или убрать свидетелей убийства и остальных своих преступлений».

Прокурор на суде тоже говорила, что после убийства Ширяева в 313-ю камеру переводят Рожка с Афоней. После этого девять сидельцев камеры как под копирку дают показания, что Ширяев упал со второго яруса кровати и ударился затылком. Теперь становится понятным, почему, когда мы, члены ОНК, опрашивали сокамерников погибших в СИЗО-4, они говорили нам одно и то же. Возможно, Рожок с Афоней для обработки свидетелей побывали не только в камере Ширяева, но и в камерах других странным образом погибших в СИЗО-4 заключенных.

Кроме того, по указанию руководства изолятора удаляются все видеозаписи с камер наблюдения и видеорегистраторов, сделанные в день убийства Ширяева.

Фельдшер Райская делает запись в медицинской карте Ширяева, что он получил черепно-мозговую травму в результате падения на пол со второго яруса кровати. А прибывшей в СИЗО бригаде скорой помощи сотрудники изолятора изложили другую версию произошедшего, сообщив, что Ширяев упал с четвертого этажа.

Кстати, по свидетельствам заключенных СИЗО-4, сотрудники изолятора вызывали скорую лишь в крайних случаях. Да и оперативники в приватных беседах признавались, что если скорая забирает заключенного с передозировкой или травмами, то им, оперативникам, нужно разбираться, откуда наркотики, как получены телесные повреждения, кто избивал, а все это плохо влияет на статистику. А ведь, как известно, СИЗО-4 называло себя «одним из лучших изоляторов России». Поэтому никакой скорой. «Умер в СИЗО, да и хрен с ним. Нет тела, нет дела!» — любили повторять в СИЗО «Медведь».

Однако вернемся к свидетелю Нистратову, о котором рассказал заключенный Абдрахманов. Действительно, после моих статей в «Новой газете» Малыша перевели в СИЗО Зеленограда, а Рожка — в изолятор Сергиева Посада. А вот Никиту Нистратова в первых числах февраля 2016 года из СИЗО-4 направляют в СИЗО-3 г. Москвы, а потом на основании постановления следователя 4-го отдела СС УФСКН РФ по Москве освобождают под подписку о невыезде. И это весьма странное освобождение, с учетом того, что он неоднократно судим.

В истории с освобождением Нистратова есть еще один важный момент. В начале 2016 года, то есть когда он находился в СИЗО-4, ему достается по наследству квартира в Зеленограде. Нистратов, будучи в СИЗО, ее продает за 4 миллиона и из этих денег, по имеющейся у меня информации от заключенных, миллион отдает Малышу. И вдруг чудесным образом выходит на свободу под подписку. Но на свободе Нистратов пробыл чуть более четырех месяцев. Он неоднократно не являлся на заседания суда и в конце концов был взят под стражу. Бабушкинский районный суд в январе прошлого года приговорил его к 11 годам строгого режима.

Возникает закономерный вопрос: почему Никита Нистратов не был допрошен в суде по делу Малыша? Ведь он ключевой свидетель.

И, насколько мне известно, он очень хотел дать показания. Тогда почему прокуратура не настояла на доставке в суд этого свидетеля из мест лишения свободы?

История про миллион от продажи квартиры Нистратова — это не исключение. На суде сами прокуроры рассказывали, как Малыш силой и угрозами вымогал у заключенного Бортникова комнату в Москве. По данным следствия, Ступин сообщил Щипанцеву, что у заключенного Бортникова есть комната в Москве. После этого Бортникова переводят в камеру к Щипанцеву. Через некоторое время в изолятор приходит нотариус, и Бортников оформляет акт дарения квартиры на доверенное лицо Щипанцева.

Причем акты дарения квартиры были обнаружены при обыске у жены Малыша, которая, по чудесному совпадению, занимается риэлтерским бизнесом.

Малыш в обмен на дарственную якобы пообещал Бортникову квартиру в ближайшем Подмосковье и досрочное освобождение в зале суда. В итоге Бортников, выйдя на свободу (по окончании срока, а вовсе не досрочно), остался бездомным.

Будучи членом ОНК Москвы, мне неоднократно поступала информация о вымогательстве криминалом квартир в СИЗО-4. Но до суда дошел всего один эпизод. Я уверена, что информация о насильственном переоформлении квартир у следствия тоже была.

И поначалу старший следователь 2-го управления по расследованию особо важных дел (преступления против государственной власти и в сфере экономики) следственного управления ГСУ СКР по Москве Денис Кондратенко очень рьяно взялся за расследование. Как я уже сказала выше, речь шла о возбуждении уголовного дела по статье об организации преступного сообщества. Но очень быстро дело передали другому следователю — Аббязу Пякшеву, и с делом начали происходить странные вещи. Из него стали выделяться отдельные производства, эпизод за эпизодом. В итоге за два года расследования до суда дошли обвинения в отношении всего четырех сотрудников изолятора.

Начальник изолятора Хорев (о котором на суде много говорили прокуроры), его заместитель по оперативной работе Горбачев (который после увольнения из СИЗО-4 возглавил СИЗО-5 Москвы), положенец Евгений Рожков и другие криминальные авторитеты оказались вне уголовного преследования.

Почему расследовалось только убийство Ширяева? Почему не дана юридическая оценка принуждения к суициду двух заключенных изолятора (произошедшее в тот же период), в том числе совершившего попытку самоубийства Кирилла Пратько?

Из 126 свидетелей в суде были допрошены не более десяти. В том числе не был опрошен ключевой свидетель по факту убийства Ширяева Никита Нистратов. Кому выгодно слить дело по четвертому изолятору?

В последнем слове Малыш был немногословен, сказал, что все, что ему вменяется, — это не его. «Прокурор говорит, что я сатана… Вы меня видите, я таким не являюсь. За долгие годы, проведенные в камере СИЗО, я не потерял человеческого лица, на моих руках нет крови. Моя судьба и судьба моей семьи сейчас находится в ваших руках. Я вас прошу распорядиться ею правильно. Большое вам человеческое спасибо за большую работу, которую вы провели».

Надо сказать, Серей Щипанцев умеет произвести впечатление. Когда я впервые пришла к нему в камеру СИЗО-4, то он тоже хотел казаться таким добрым великаном.

И на суде по делу Люберецкой ОПГ, которое, кстати, тоже слушалось коллегией присяжных, Малыш получил вердикт — «виновен, но заслуживает снисхождения».

Так и сейчас: присяжные оправдали его по факту нанесения тяжких телесных повреждений, повлекших смерть заключенного Ширяева, по факту вымогательства жилплощади у заключенного Бортникова, но вынуждены были признать виновным по фактам взятки должностному лицу — фельдшеру Райской. И то, видимо, только потому, что Райская призналась в получении денег от Щипанцева и уже осуждена тем же Бабушкинским судом.

И в колонии № 4 Владимирской области, где Малыш отбывал срок за ограбление обменного пункта, к Щипанцеву подошли с большим сочувствием. Спустя всего три месяца пребывания в колонии он обратился в суд за УДО. Вязниковский городской суд принял решение освободить Сергея Щипанцева. И решение это принимал не рядовой судья, а председатель Вязниковского городского суда, председатель Совета судей Владимирской области, член президиума Совета судей Российской Федерации Ольга Черненко. Правда, выйти на свободу Малышу помешало возбужденное уголовное дело по факту совершенных им преступлений в СИЗО-4.

Будучи членом ОНК Москвы, осенью 2016 года я навестила Малыша в «Кремлевском централе» и спросила, как ему удалось получить УДО, может, за хорошую работу?

- I did not work in the colony at all, not a day. Я там участвовал в спортивных соревнованиях по жиму лежа ( да-да, тот самый жим лежа, которому Малыш учил Сашу-майора в СИЗО «Медведь». — Е. М. ). He participated three times, won three times. Поэтому у меня была положительная характеристика.

“Didn't you have reprimands to the SIZO-4?”

- Well, they were. Ten reprimands for six and a half years. Я считаю, что это немного. Но с меня их сняли. Six months later, the reprimand is extinguished. And in the colony I had no reprimands, only gratitude.

Прокурор, напутствуя присяжных перед вынесением вердикта, заявила: «Я не поступлюсь ни совестью, ни честью, сказав о том, что на скамье подсудимых сидят виновные лица».

Присяжные решили иначе.

13 марта 2019 года досрочно освобожденный за предыдущее преступление и оправданный за все последующие бывший член Люберецкой ОПГ, скорее всего, окажется на свободе. То есть среди нас.
