At the meeting of the Vologda City Court, who was supposed to decide the future fate of Varvara Karaulova, who had already served three and a half years according to the verdict of the Moscow District Military Court, I went without any hope for a positive decision.

Until April 16, 2019, there was a stable judicial practice in Russia, according to which none of the convicts according to the so -called “terrorist articles” could count on parole, but had to sit out his term from the call to the call.

Under the control of the FSB

Varvara Karaulov was convicted on December 22, 2016 by four and a half years of the colony. The official wording of the prosecution: for preparation for entry into a terrorist organization. In fact, a 19-year-old student of the Faculty of Philosophy of Moscow State University was convicted that she tried to go to Syria to meet her fiancé with whom she met on the Internet.

I know the story of Vari well, I visited it in Lefortovo for a whole year as a member of the Moscow ONK, and I remember very well how on the first day I saw a beautiful frightened girl in the cell of the pre -trial detention center.

Varu was arrested five months after her father Pavel Karaulov took her out of the migration camp in Turkey.

Returning to Moscow, Varya began to cooperate with the FSB officers.

She provided them with passwords, logins, told whom she corresponded with social networks. Under the control of the FSB officers, she corresponded with her fiancé Airat Samatov. All correspondence later entered the materials of the criminal case. It quickly became clear that Varya needed the help of a psychiatrist, she was put in the clinic, where she spent several weeks. Having been discharged from the hospital, having gone on an academic vacation at the university, Karaulova slowly began to recover.

And at the end of summer, together with her mother, she decided to get a passport for another name. By that time, the excitement around her and her non-trivial story did not come to naught: she could not go for a walk with the dog, reporters were waiting for her near the house, because of her last name she was not taken to work.

In the investigation and trial, the change of passport was imputed by Karaulova, the prosecution claimed that she was supposedly going to flee to Syria again.

But, as the mother of Vari, Kira Karaulova told me, the FSB officers knew very well that she and her daughter went to the passport office, their whole life was controlled.

In early September 2015, Varya literally prayed: she did not want to correspond with the recruiter Samatov anymore. Kira Karaulova said that her daughter asked her to hide all the gadgets in the safe and leave her only a button phone.

But on October 27, 2015 they came to their home with a search and Daria was detained. Investigators explained the initiation of a criminal case with new circumstances: they supposedly had information that Karaulova continues to call Samatov and was going to make self -break in one of the countries of Europe, or in Kazan - here the versions, replicated media, did not coincide one of them.

After the verdict, Karaulov was sent to the Vologda women's colony and her lawyer Sergei Badamshin, having passed all the courts, began to say that Vary had only two opportunities to free himself before the “call”: presidential pardon or parole.

Unfastened button and ombudsman

Karaulov did not submit to the pardon, it soon became clear that the chance that the president would have mercy on the convicted person under a terrorist article - almost zero.

But the parole could be tried. And Varya filed a petition in March 2019. By that time, she already had two encourages, she worked as a cutter, fulfilled the production rate of 100 percent. True, they also did not “doze” in the colony: even before Karaulova filed at Udo, just in case, two penalties were imposed on her just in case.

The third penalty appeared immediately a few days after she filed at Udo. She was punished for that she lay down on the bed at an exorbitant time - in the afternoon. Thus, before considering the petition, she had two not extinguished penalties and two encouragements. And the colony did not recommend her to release.

But Tatyana Moskalkova, the Commissioner for Human Rights, decided to support her application. And this is no accident. Back in January 2018, Moskalkova visited Karaulov in the colony, and then promised to study her business and support the petition for pardon if Karaulov gives him. Since Varya did not contact the president with a pardon, the Ombudsman wrote a letter with the support of her application for parole: “When visiting a colony, as well as studying the case materials, I had an opinion that A.P. Ivanova (F.I.O. Karaulova according to the new passport. - “MBH Media”) sincerely repent of the deed, regrets that she caused her parents so much grief, shared the conclusions that she extracted from her, and positive plans for the future. ”

“Currently , she remotely receives a second higher education, maintains a connection with her family. Her mother, who was repeatedly at my personal reception, said that she and her father are on her dates, are conducting constant correspondence with her and are ready to help her social adaptation to return from places of imprisonment. ”

“The penalties that were imposed on A.P. Ivanov, are insignificant and are not a systemic nature. ”

Such a letter came to the chairman of the Vologda City Court Olga Fedoseeva on the eve of the court hearing. It was read out at the very beginning of the process by judge Alexei Koltakov.

"I don't understand why this girl is here"

And then the meeting “rolled” along the rolled. Varvara Karaulova watched the process of video from the colony. As local human rights activists explained to me, this is the tradition of Vologda justice: when they consider the application for UDO, the convicts are not brought to court.

The judge allowed the online broadcast of the process on the press service of the Vologda City Court. The meeting was attended by correspondents of all state television channels. More than ten cameras.

Here I would be alert and think that it is for a reason. But no, I was sure that the judge would refuse and have to defend the refusal to the Vologda Regional Court.

Lawyer Sergei Badamshin read out his petition with a request to release the client’s calls. He said that there is reason to believe that Alexandra Ivanov has corrected and does not need further serving the sentence: she did not violate the regime in the pre -trial detention center, at the colony attends educational activities, has two incentives from the administration, remotely studies at the Moscow university “Synergy”, takes part in the public life of the colony, in particular in the literary circle, and the plan for the production of sewing products performs at 100 percent. Karaulova maintains ties with his mother, father, sister. In the case of her parole, she will be provided with work as a manager.

Further, the lawyer of Badamshin asked the judge to introduce several dozen letters of commodity, a red diploma of graduation. And also asked the judge to allow to interrogate several witnesses to characterize the personality.

Mom, Kira Karaulova, and Father Vari Pavel Karaulov took turns to the witness department. I also spoke, because as a member of the PMC I visited Karaulov in Lefortovo and could present her opinion about her.

When Tatyana Moskalkova came to Vologda in Vologda, she talked with Varya in the colony and, leaving her, told me: “I don’t understand why this girl is here”.

“Three penalties were imposed on Varia. First: I walked along the parade ground alone. According to the internal rules of the IR, outside the walls of the room, convicts should not move alone. This means that, for example, she does not have the right to go from the club to the dining room. But this is a completely tiny institution, the parade ground is 50 per 100 meters. I think Varya called her mother on the phone and she flew out of her head that she should not go alone, but as part of the group. But, by the way, this penalty is repaid. ”

“She received the second penalty for unbuttoned buttons on a work jacket while working in a sewing workshop. The chairman of our PMCs and I specially came to the workshop and watched whether the buttons were fastened with other workers. So, all women have the upper buttons on the jackets unfastened, and one prisoner even worked in a sweater without a special car. The third penalty: lay down on the bed during a working day. Her head fell ill. I spoke to her and Barbara said to me: “I can’t do what other convicts can do to me here.”

“In general, I want to say that if Barbara were my daughter, I would be the happiest person on earth.”

The witnesses ended and the lawyer of Badamshin asked the judge to introduce a letter to the rector of the Moscow Trinity Church in Khokhlah, Alexei Uminsky, who visited Karaulov in Lefortovo and in the colony and could not come to court.

According to the priest, during the imprisonment of Barbara, she matured and became very often oigoed, she had a desire to build a new life. “She reads a lot and reads Orthodox books. In particular, during one of my visits to the colony, we discussed with her the book of Vladyka Anthony Surozhsky, ”wrote Father Alexei Uminsky to court.

Anna Olegovna is the rich, a young woman in blue and with lush red hair to the waist, which I christened to myself with a “mermaid”, read out the conclusion of the colony administration on a piece of paper. She listed violations imposed on the convicted Karaulov-Ivanov. One of them is repaid, two remained.

The rich repeated after lawyer Badamshin that Karaulova was taking part in public life, studies at the institute.

“But she did not admit her guilt,” she said proudly, shaking her hair. The lawyer of Badamshin asked if there are violations committed by the convicted person, malicious.

The Mermaid said not, they are not malicious. But she added that the convicted person consists of preventive accounting (all convicts for terrorism and extremism are put on preventive accounting. - “MBH Media”).

The judge asked why the convict was put on a professional science. The Mermaid could not explain this, but said that Karaulova did not communicate with other convicts, consisting of vocational school. He does not read extremist books. And she concluded: “The colony does not recommend the convicted by Ivanov to parole. Given the penalties and profiles, the convicted person has not yet been corrected. ”

After listening to the objections of the representative of the colony, the lawyer Artem Valiev, who, together with Sergey Badamshin, represented her interests, stood up behind Varia. He drew the attention of the court to the fact that, according to the decision of the Plenum of the Supreme Court, to understand whether the recovery of an obstacle to liberation is to investigate each penalty. And taking into account the position set forth in the letter of Tatyana Moskalkova, the penalties imposed on his client do not interfere with parole.

And finally, the judge gave the floor to the prosecutor of the supervision of Stanislav Kuzmin. The prosecutor turned out to be the most concise participant in the process. He recalled that "Ivanova was convicted of a crime that threatens public order, she does not plead guilty, there is no repentance, consists of preventive accounting." Therefore, the prosecutor does not support the petition. Asks the court to refuse.

"What I did is the greatest stupidity"

Karaulova made the last word.

We saw a very young girl dressed in a blue prisoner robe. She spoke loudly and calmly: “It's hard for me to add something. Thanks to Zoe Feliksovna and Oleg Anatolyevich that they found time and arrived at the meeting. All these three and a half years were difficult not only for me, but for my loved ones. It is difficult to constantly be under constant attention and control, when each of your steps is analyzed, visible. It is very difficult to sometimes make a mistake. I need my loved ones, I have to be with them. It is more important for me to start working and help. I lost a lot in three years. Brother and sister grow without me. I have big plans for the future. "

“Thanks to what happened to me, I met amazing people, such as Dr. Lisa, who is very missing. I can help people and animals. I want to look optimistic at my future. If only this future has come. I have no real one. My parents motivate me that everything will change soon. What I did is the biggest stupidity that I once did in my life. I do not cease to reproach myself. It is strange to hear that I do not repent. I think that the respected prosecutor did not want to hurt me, he was just mistaken. ”

Judge Alexei Koltakov retired to the deliberation room and an hour later read out an unexpected decision: "Satisfy the petition of the convicted by Ivanova and release parole."

As soon as the judge finished reading the decision, applause and cries of “Hurray” were heard in the hall. I screamed louder than anyone.

It really was unexpected. I noticed that the parents of Varya cry. Kira Karaulova approached her ex -husband and hugged him. No one noticed how the prosecutor and the representative of the colony left the courtroom.

"Big Game" on the first and in court

I admit, I looked at Channel One.

And I heard how TV presenter Kirill Kleimenov, who acted as the producer of the film about Var Karaulova, said on the air of the Tok show “Big Game”: “Of course, Karaulova is a criminal. There is a court verdict. The decision has long entered into legal force and there is no doubt here. But, having understood her history, you begin to realize that all members of her family are victims of circumstances and those people who pushed her to these tragic steps. ”

Another participant in the show of the show, the director of the human rights center of the World Russian People’s Cathedral, Roman Silantyev was even more categorical. He said what I would not want to ever hear about herself Varya Karaulova: “Nobody recruited Karaulova. She herself wanted to join ISIS (forbidden organization in Russia. - “MBH Media”), she herself was looking for people who had to pay her a ticket. Karaulova wanted to kill. "The system worked correctly"

Kirill Kleimenov: “Roman said that we will still hear about Var. I would be glad that we would never hear about her. This film needs to be seen so that nothing like that happens to your child. ”

And on Channel One showed a film about Varvara Karaulova and her story. Three say in the film: parents and Varya herself. Their frank monologues accompany the shots of the chronicle, the Sesapes from the materials of the criminal case - its correspondence with the recruiter.

These excerpts of conversations are torn from the context and it is not very clear what is meant.

But, it seems, the authors of the film are not so important, they represent the story as the prosecution presented it. Namely: Karaulova, they say, decided to change her last name to leave for Syria again, she corresponded with the recruiter and therefore was imprisoned. And for some reason, the authors of the film do not specify that Karaulova corresponded with the recruiter exclusively under the control of the special services!

And for example, it is completely incomprehensible to me why it was to be planted if she collaborated with special services?

This is the idea of ​​producer Kirill Kleimenov: the system worked correctly. And for the “strawberries” an interview with the state prosecutor will be made after the court sentenced: “In addition to Samatov, with whom she (Karaulova) was actively corresponded, before that there was the so -called Skype wedding, as we installed, with another militant, with an unidentified person named Nadir from Dagestan. In the future, she had a new fan. We have no reason to believe that it was a romantic story. ”

Мне бы очень хотелось думать, что судья Вологодского городского суда действительно писал свое решение в совещательной комнате с 13 часов до 14 часов 16 апреля, а не раньше.

И мне бы очень хотелось считать, что показ фильма на Первом канале и последующее за ним ток-шоу о судьбе мирового терроризма с Рамзаном Кадыровым из Грозного, Дмитрием Саймсом из Вашингтона, политологом Вячеславом Никоновым и журналистом Виталием Третьяковым из Москвы, никак не связаны с решением об УДО Варвары Карауловой, вынесенном Вологодским городским судом.

Но что-то мне подсказывает, что таких совпадений в России не бывает.
