
By October 1, 2019, all entrepreneurs whose hostels are located in residential apartments will have to leave them. The strict conditions of new amendments to the Housing Code of the Russian Federation were commented by the expert of the housing and communal services market, the head of the investment company JSC Domkom Invest Alexander Kostyukov.
New amendments were made in Part 3 of Article 17 of the Housing Code of the Russian Federation and approved by the Federal Assembly. On April 15, the "Law on the prohibition of hostels" was signed by President Vladimir Putin.
“So the 4-year discussion ended about who is the master of the house,” expert Alexander Kostyukov believes. - They won common sense and residents. And this is clearly reflected in the capacious formulation of the new rule: "A living room in an apartment building cannot be used to provide hotel services."
The basis of many years of disputes, according to expert Alexander Kostyukov, lay two rights: the right of the owner of the premises to dispose of his discretion and the right of neighbors to silence. Legislators were looking for options for how not to harm the tourism industry and at the same time save neighbors from unscrupulous entrepreneurs.
“It was not possible to find a compromise,” the expert is sure. - “Fighters for silence” won, and hostels are now obliged to transfer their business to the first floors of high -rise buildings, and the premises into the category of commercial real estate. By October 1, the entrance to such mini-hotels should be built separately from the entrance to the entrance of a residential building so that the inhabitants do not intersect with the guests of the hostel.
The expert considers new amendments to the RF LC "uncompromising", because They unequivocally protect the rights of residents and “finally evict” noisy institutions interfering from the entrances. This position of legislators is explained by the numerous complaints of ordinary residents about the discomfort from the neighborhood with the hostel: loud music at night, rudeness when trying to make a remark, excessive loading of elevators, garbage and violators of migration legislation shooting right outside the door of the apartment.
In addition, the expert notes, the location of the hostel in a living room often leads to a violation of the rights of residents of all MKD. The neighbors are forced to pay for utility resources for hotel guests if the businessman entrepreneur has not installed utility bills.
In general, Alexander Kostyukov is sure, the new rules significantly limit the uncontrolled distribution of hostels in the housing stock and lead to the long -awaited order in this area.
