The court found Gudkov guilty of organizing a rally in December 2018, when the court considered the previous administrative case in relation to the politician.
Gudkov said that at that time he was in the court building, so "he could not organize a rally from the outside."

According to human rights activists, Article 212.1 of the Criminal Code of the Russian Federation violates the fundamental principles of law and is aimed at restricting freedom of assembly, contrary to Art. 31 of the Constitution of the Russian Federation, Art. 11 of the Convention on the Protection of Human Rights and Fundamental Freedoms, as well as the positions of the European Court of Human Rights (ECHR).

Before Egorov’s case, the only convicted person under Article 212.1 of the Criminal Code remained oppositionist Ildar Dadin. Dmitry Gudkov noted that Article 212.1 is used "only in important political cases."
