In Moscow, the Nikulinsky court arrested the detained park defender for 12 days

The Nikulinsky District Court of Moscow arrested Ivan Rozhkov, the defender of the square on Bolshaya Ochakovskaya Street, for 12 days under Part 8 of Article 20.2 of the Code of Administrative Offenses (repeated violation of the procedure for holding a public event). The case under part 6.1 of article 20.2 of the Code of Administrative Offenses (participation in an uncoordinated event that interfered with traffic) in relation to another Nadezhda Chizhova, who was detained on May 27, was closed due to the lack of corpus delicti. Rozhkov and Chizhova were defended by lawyers from OVD-Info, Yulia Chekunaeva and Mikhail Biryukov.

According to Biryukov, the head of the inquiry department first came to the court. With the materials of the cases, she entered the room of judge Sergei Dubkov, and 15 minutes later she left with a piece of paper on which half a page of text was printed.

“Then she disappeared for an hour and a half,” says Biryukov. - As I understand it, at the direction of the judge, I went to redo the case materials. After that, she returned and, with a blue eye, suggested that we sign a new protocol on an administrative offense. Naturally, we refused, since we had an old, signed Chizhova in our hands. To say that the head of the inquiry department was upset is an understatement. During the hearing, I drew the judge's attention to the fact that the protocol in the case file was without Chizhova's signature. I stated that the evidence was falsified and the case should be dismissed. The judge left to deliberate for another hour and a half, after which she granted my request.

After the case was closed, Chizhova was released. According to Biryukov, the new protocol, which the police tried to complete right in court, added notes that Chizhova, during a meeting of citizens on Bolshaya Ochakovskaya, allegedly climbed onto a truck and shouted slogans. “Accordingly, this would allow accusing her of taking part in an uncoordinated rally. Without these indications of slogans, the court could not qualify the meeting of citizens as a rally, since there was no sound-amplifying equipment or posters,” says the lawyer.

After the policemen were told in court to remake the materials of the administrative case against Chizhova, they rewrote the protocol also for the second defender of the square, Ivan Rozhkov, who was detained on May 27. The new protocol was shown to Rozhkov while he was still at the police department, and records of slogans were also added to it. In this case, the court found the policemen's claims justified and sent Rozhkov to a special detention center for 12 days.
