The Ussuri District Court sentenced the former General Director of the Ussuri Pacific Most -Building Company (TMK) Viktor Grebnev, for a major embezzlement by a conditional term. "The court sentenced him to five years in prison, and a fine of 200 thousand rubles," Interfax told in court.
The lawyer Igor Polyakov, who defended Grebnev, said that during the sentence, the court took into account numerous state and departmental awards of the defendant, his age and state of health and considered it possible to determine the measure of punishment not related to real imprisonment.
“I, as a lawyer, believe that this is a compromise of the system, his fault has not been proven, in such cases, the court, in order not to pass an acquittal, appoints a minimum punishment. If his fault were obvious, and he would have abducted that money, it would be a long -term imprisonment, with serving in a correctional colony. The defense was motivated, proved that the thefts could not be there,” Polyakov said. Whether the defense will appeal the verdict has not yet been decided.
The court in this case began in the fall of 2016. Grebnev was accused of embezzlement in an especially large scale, using an official position (part 4 of article 160 of the Criminal Code of the Russian Federation) and deliberate bankruptcy (Article 196 of the Criminal Code of the Russian Federation). According to the investigation, the defendant of the case, being the general director of TMK CJSC, using his official position, disposed of the money entrusted to him in the amount of over 407 million rubles, as well as from January 2012 to December 2014, he took actions aimed at the deliberate bankruptcy of the enterprise he headed.
So, in April 2014, he deliberately concluded and fulfilled on a voluntary basis, in the absence of legal requirements of the bank, guarantee agreements, paying funds in the amount of 288 million rubles. on the expense of repayment to the bank of loans of another company. Knowing the presence of signs of bankruptcy, the entrepreneur did not appeal to the arbitration court with the application of the debtor, and instead only aggravated insolvency, as a result of which there were problems with the payment of salary to the workers. In 2015, the workers brought to despair for help to Vladimir Putin directly from the construction site of the Cosmodrome in the Amur Region during a direct line with the President of the Russian Federation.
As a result, the Arbitration Court of the Primorsky Territory recognized TMK CJSC bankrupt, the property of the accused, as well as the property of the company, the founder of which he is, was seized in the amount of about 300 million rubles. The General Director of the Pacific Building Company Igor Nesterenko in April 2016 was sentenced to three years in a general regime on charges of fraud.
