"Crab war" on Sakhalin

Former deputy chairman of the Sakhalin Region Government, Igor Bystrov, now in the Khabarovsk pre -trial detention center, announced that he was starting a hunger strike. He was detained in May, and recently extended the detention for another three months. The reason for the arrest was the fulfillment by the President’s commission on the withdrawal of the Ostrovnaya fish component, located on Shikotan from the crisis. The Investigative Committee considered that the president’s order was carried out "with excess of official powers" and "causing grave consequences." And although Ostrovnaya became the head enterprise of the territory of the leading development of Kurili, Bystrov threatens from 3 to 10 years in prison. Many on the island regard his arrest as another episode of the "crab war" unfolding here.

According to Bystrov, the employees of the Sakhalin UFSB regularly visited him in a pre -trial detention center, threaten to keep him in the cell for as long as long, until he testifies to persons who, the former deputy chairman of the government claims, "have nothing to do with the detention."

Igor Bystrova was detained in May in St. Petersburg, where his family lives, transferred to Khabarovsk and put in a pre-trial detention center.

He did not stole anything, did not take it away, there was no fraudulent scheme. The investigator said that he needed his explanation. Even when Igor was detained in a pre -trial detention center for the first and a half, he did not appeal this decision, I thought it took time to interview him, find out the details, and then he would come out. Now the lawyer says that the prospects are joyless. The husband is unlikely to be released even under house arrest. The term of detention can extend a year or more. It turns out that there are a lot of opportunities to keep a person in a pre -trial detention center as much as you like. For example, the case may be referred to the court, and the judge will return it to the investigation. And a person will serve his sentence before he is found guilty.

The construction of the Ostrovnaya fish complex on the small Kuril Island of Shikotan began in the 60s of the last century. The company quickly became the largest in the fish processing union. By 1974, six canning factories produced products of more than fifty items: canned food from Pacific Sayrah, salmon, and also cod liver, red caviar. In addition, seaweed, flounder, navaga, polish, cod, mackerel, herring, squid and more were processed at the fishing plant, and other. Canned are exported around the world - from Australia to Cuba, from India to Latin America.

In the late 80s, the enterprise began to decline. The 1994 earthquake accelerated the process. After it, only 3 cases out of 6 remained, and they were seriously damaged.

In 1999, on the basis of the former fish conservation factory No. 24, CJSC "The Ostrovna Fisheries" was created. The founders are several Moscow businessmen.

The fish complex has always been a city -forming enterprise for the island. And in the village of Malokurilskoye on the "island" everything is tied in general. The pier, to which the ship is suitable, until recently, the only connection of Shikotan with Sakhalin is the property of the fish factory. In the building "Ostrovnoy" the premises of the Ministry of Emergencies, police, mail, shops are rented.

The fish factory brought on an island with a population of about 2.5 thousand people more than 1000 seasonal workers.

But all the glory of the "island" in the distant past. The last time he appeared in the media space in April 2016, when, on a direct line with President Putin, former Ostrovnoy workers complained of a multi -month non -payment of salaries. The journalist, announcing the question, did not spare the epithets: "nightmare", "inhuman conditions."

The fact that the "island" is not the best employer and they constantly delay the salary there is known on Sakhalin for a long time.

- In 2014, in the fall, I got a job in the subsidiary of Ostrovnoy - the center of coastal fishing "Ostrovnaya" for the sailor for the vessel "Steel". He arrived in Malokurilskoye, came to the schooner - and it turned out that there were only three people in the crew. In addition to me, the captain and the sailor. It turned out that the ship has no quotas. Rather, they were before, but they were handed over. It is clear that we did not go on the flight, we sat like a watchman, guarded the ship. Accordingly, the salary, like the watchmen, but it was constantly detained for two to three months. In August 2015, he wrote off, bought a ticket with his money and left Shikotan. And then for another two months he knocked out a salary. He wrote to the State Property Committee and the prosecutor's office. In the company, giving out my money, they stuck that I “ran immediately to complain,” says Sergey (he asked not to name his last name).

The leaders of the Ostrovnoy preferred to recruit workers away from Sakhalin - they were brought from Buryatia, Altai, and other regions. On a direct line with Putin, the employees of the enterprise said that they had nothing to buy even return tickets for, but while they expected salaries, they calculated money from them for living in a hostel. Some went home without receiving a salary.

Just a couple of days after a straight line, the director of Ostrovnoy flew to the chicotan with a cash bag and distributed about 14.2 million rubles 503 to his employees. The rest of the Putins were then searched for the country to convey the earned.

With what speed the money was found, confirmed the conclusions of investigators who at the same time in the spring of 2016 criminal cases of non -payment of salaries and abuse of authority. They argued: the leaders of the "Ostrovnoy" had the opportunity to pay off the employees, but did not do this. As a result, six criminal cases of non -payment of wages, unlawful actions in bankruptcy, abuse of powers, and embezzlement of funds were brought to the heads of the fishing plant. Former general director Natalya Kashkarova was detained, and then sentenced to one year of imprisonment, as well as a fine of 280 thousand rubles, the founder of the enterprise Yuri Belkin, the CEO Aleksey Popov, was put into the international wanted list, and after the arrest, he was released on a millionth deposit, and then sentenced to pay a fine of 250 thousand rubles.

Giving out salary debts and starting affairs at the former leaders of the plant was the simplest. It was much more difficult to fulfill another assignment - to restore production on Shikotan. The regional government was ordered to “work out the issue and make proposals for the acquisition of an enterprise with a strategic investor within two months.” Rosrybolovstvo, which was supposed to control the execution of instructions, was obliged to think through possible mechanisms for the transfer of the property complex of the Ostrovnaya fishing complex "Strategic investor.

But by 2016, the plant almost died. The debt to banks reached 1.6 billion rubles, more than 60 million - taxes on taxes. The tax authorities began the bankruptcy procedure of the enterprise.

Debts were not accumulated simultaneously, for several years the owners of the "Ostrovnoy" deduced liquid property - since 2013 there were constant reorganization at the enterprise, and created numerous "daughters", which corresponded to all the most valuable. At the end of 2014, RKO was reorganized by allocating from it CJSC CJSC. The “coast” received property for more than 220 million rubles, including a linque in tin worth 64 million rubles.

In 2015, from the balance sheet of RKO CJSC to Eles-Vostok LLC transferred a residential building for visiting specialists and 4 land plots, with a total area of 5549 square meters. m. Banks tried to ban any transactions with the property of the creditor, but the leak of assets was in full swing.

Depressing position: crazy debts, workers left without money

- The last of the reorganizations held by the former owners occurred on June 19, 2015. Then, on the basis of Ostrovnaya Fish -Basket CJSC, LLC Ostrovnaya Fisheries was created. Between them, lease agreements were concluded, according to which almost all property crossed from CJSC to LLC - a canned food line with a capacity of 730 thousand cans per day (approximately 150 million cans per year), installations for the production of fresh -frozen fish, a mooring complex, fishing and cargo berths. And also a water intake of fresh water, treatment facilities, refrigerators, a household complex for 900 people, a factory building, a working hostel and a residential building for the plant specialists, ”said Tatyana Sheremetyeva , a lawyer who was a part of the bankruptcy trustee of the Ostrovnoy.

And only debts remained in the RCO CJSC. But the fact that the enterprise would not be allowed to close was obvious: located on the island, which Japan claims, is always considered a strategic object. And then there is a direct assignment of the president.

On "Ostrovnoy" introduced a competitive department. This project was not so much economic as political, especially for Oleg Kozhemyako.

In the Eastern Economic Forum in Vladivostok, the head of the Federal Reservoir Ilya Shestakov, then the governor of Sakhalin, and now the head of the Primorsky Territory Oleg Kozhmoyyako and the General Director of the Kuril Universal Complex LLC Alexander Kan (the new investor and son of the Sakhalin Krabovaya oligarch Oleg) signed a memorandum of the revival of Ostrovnoy.

One of the points of the presidential order was to ensure at least 7 thousand tons of cheese or frozen products in 2016 to the Ostrovnaya in 2016 for the uninterrupted functioning of the enterprise and its exiting breakless production. ”

The problem was that neither the fleet, nor, most importantly, the “island” had a quota for catching fish.

“The situation is depressing: crazy debts, workers left without money, and at the same time the owners sold all the quotas,” recalls Maxim Kozlov, head of the Association of Fish -Industrial Enterprises of the Sakhalin Region.

The quotas were taken out of the company, even before everything else. In 2009, CJSC Fisherman CJSC was saved from Ostrovnoy. Quotes were transferred to it by more than 600 tons of fish and two fishing vessels. And then the “fishing company” handed over part of the quota of CJSC Albakor, CJSC Kurilsky Spaces (then at Rosrybflot OJSC), Alfa-Fish CJSC and Laguna CJSC.

In 2011, another reorganization of RKO CJSC was held - a Pacific Fisheries Company was allocated CJSC, which transferred the rights to catch red fish with a drift in a cost worth 7.3 million rubles.

But although legally the quotas of the "Ostrovnoy" no longer belonged, they remained in the hands of the same people. For example, Yuri Kulish, one of the founders of Ostrovnoy was also the general director of Albacora, the general director of the Fish -Lower Company and the owner of the Vostok YUK company, who also received the Ostrovnoy quota.

And after the direct line and the instruction given by the president, the deputy chairman of the regional government, Igor Bystrov, began to meet with the owners of the Ostrovnoy quota, convincing to sell them to the new leadership of the fish factory so that the plant could resume work.

Then it was presented as a success that allowed, among other things, to breathe a new life into the plant. After more than two years, the same was the reason for the initiation of a criminal case under paragraph "in" Part 3 of Article 286 of the Criminal Code of the Russian Federation - "exceeding official powers with causing grave consequences." The defendant of the case has now become a pensioner, and a former deputy chairman of the Government of the Sakhalin Region, who oversaw the issues of a fisheries complex, Igor Bystrov.

The decision on the search says “Bystrov I. M. under the pretext of ensuring the uninterrupted functioning of CJSC“ The Ostrovna Fisheries ”and its breeding production by the strategic investor, Kan O.K., who was the actual head of a significant number of organizations for the extraction, processing and implementation of aquatic biological resources in the Sakhalin Region, decided to exceed his official authority and, clearly leaving the For their borders, to compel the owner of Albacaku CJSC and Vykhok YUK LLC transfer the indicated organizations with quotas assigned to them for the production of aquatic biological resources previously owned by O. K. Kan's fish component CJSC.

The testimony for Bystrov was given by Yuri Kulish, as the former owner of the Substance of the YUK, and Lukyan Solomko, to whom Kulish by that time had sold Albacco. They told investigators that Bystrov threatened that if they did not sell their quotas, he would send inspections to their company, including law enforcement agencies, they would still lose violations and quotas there. As a result, Kulish sold his company for 18 million rubles, although, according to him, the market value at that time amounted to 56,285,000 rubles.

It was not possible to contact Yuri Kulish at the time of the publication. The phones of companies in which he is listed as a founder or manager does not answer.

Lukyan Solomko "Albacco" refused to sell, but, also, according to him, he suffered: supposedly investors, having heard about the problems of the company, refused to give the previously promised 25 million rubles for the construction of a seafood processing workshop.

- These are absurd accusations. It is absolutely not clear where the figure of 56 million rubles came from. Who evaluated the company? By what criteria? It is incomprehensible. Based on the results of financial activities in 2015, "Sunrise of the YUK" has no profit, only losses of 5 thousand rubles, in 2016 losses of 31 thousand rubles. 25 million losses Solomko are also taken from nowhere, because they did not even interview investors who did not give money. There is no evidence that he was promised at all, ”says Igor Byvili Ivanov , who was not hired by the Fastrov family, his services are paid by some“ fishermen ”. Who exactly, Ivanov refused to name.

There are a lot of strange things in this matter. For example, why did the accusations appear only now, more than two years after those events? After all, the FSB was already led by the operational development of Bystrov. Lukyan Solomko, according to the case file, went to negotiations, hung with sound recording, which was fixed by the FSB operatives on it. According to Solomko, after the first conversation about the sale of quotas, the department employees came to him and offered to record negotiations. The decoding of these negotiations is now appearing in the case.

There are no mentioning amounts in these records. Nastrov had the task of obtaining consent to the sale of quotas to an investor, businessmen agreed on the amounts to each other, without his participation. Nevertheless, it is he who is accused of damage.

During the interrogation, the investigator asked her husband how he, the son of a diver and a plaster, was able to become the deputy chairman of the government

- In the case there are testimonies of the head of the company "Laguna", with whom Bystrov also discussed the sale of a company with quotas. He said that Bystrov did not threaten him, but the conversation was unpleasant, uncomfortable. The businessman refused to sell the company. The consequences for the business, according to him, had no refusal, says Vasily Ivanov.

The detention of Bystrov in the political and business circles of Sakhalin is now one of the main topics. No one believes that the purpose of the actions of the security forces is the former deputy chairman himself. His arrest and the decision to extend the detention for three months (Solomko’s words helped to justify this, who stated that he said, remaining at large, to have psychological and physical impact) is perceived as the fact that they are waiting for testimonies on others.

The most common version is that Oleg Kan should become others. Now the "crab king" is at war for its most valuable resource - quotas on crab. Kang is the largest mining and exporter of expensive seafood. But the “Russian Fish -Industrial Company” became interested in the booty of the crab. Her son -in -law of Gennady Timchenko Gleb Frank and brother of the governor of the Moscow Region Andrei Vorobyov Maxim. RRC actively lobbying for changes in the order of quotas from the historical (when companies received the right to fishing for 10, and then for 15 years) for auction, when quotas should be bought at auctions every year.

At the same time, the offensive began on the Kan itself. An investigation of Eduard Petrov appeared on the Russia TV channel, where a fish producer was accused of organizing a murder. Searches were held in the subordinates, he himself managed to escape to Japan on a personal plane. So it is quite possible that the arrest of Bystrov is only an episode in the unfolding "crab war."

“It is unfortunate Bystrova, he is just an episode in the struggle for a crab,” says Oleg Kan, a businessman from the neighboring environment of Oleg Kan, on a condition of anonymity. – Понятно же, что дело заказное и нужен на самом деле Кан. Но его даже не признали потерпевшим по делу. Я уверен, что у дела экономическая подоплека, а не политическая. Конечно, силы задействованы серьезные, но, если бы тут была бы политика, то ему просто не дали бы уехать.

Стоит оговориться, что РРК пока не находится под санкциями. В санкционный список одной из первых попала группа "Русское море", которую создавал Геннадий Тимченко (потом перепродал свою долю зятю). До 2014 года РРК называлась "Русское море. Добыча". По данным "Ведомостей" из-за санкций под угрозой оказалось до 60% выручки "Русского моря".

В том, что арест экс-зампреда правительства – способ добраться до Кана, уверен и сам Быстров.

– На допросе следователь расспрашивал мужа, как он, сын водолаза и штукатурщицы, смог стать зампредом правительства. "Вы же с Каном из одного года?". Мол, это рыбопромышленник "выращивал" себе лоббиста. Но муж старше Кана на 10 лет, Игорь стал работать в администрации области почти 20 лет назад, когда Кан еще не создал свою империю. Они и знакомы лично не были до ситуации с "Островным". Игорь говорит, что отпустят его, только если доберутся до Кана, но тот в Японии, а значит, недосягаем для следствия, – говорит жена Быстрова Ольга.

Сейчас Кан юридически к "Островному" отношения не имеет. Рыбокомбинат входит в Акционерное общество Управляющая компания "Дальневосточный рыбак", где основную роль играет крупная приморская компания "Интеррыбфлот". "Островной" успешно развивается, в него уже вложено больше 4 млрд рублей инвестиций. Планируется вложить еще примерно столько же. "Островной" презентовали на Восточном экономическом форуме как якорное предприятие Территории опережающего развития "Курилы".

– Разница между тем, что было до обращения к президенту, и тем, что стало, огромная. Тогда все только ветшало и приходило в упадок. Сейчас в бухте ( где расположен рыбзавод. – СР ) вовсю идет стройка – береговая линия укрепляется, поставили металлоконструкции – каркас будущего здания, появилась таможенная зона, идет речь о возведении нового причального комплекса. С прошлого года говорят, что в планах покупка судна, которое будет перевозить грузы, а заодно и пассажиров с Шикотана во Владивосток. Для жителей острова это стало бы настоящим подарком. Пока мы путешествуем на материк только через Сахалин, – говорит депутат местного собрания Юлия Натенок .

Об успехах по выполнению поручения президента регулярно отчитывались полпред президента в ДФО Юрий Трутнев, экс-министр по развитию Дальнего Востока Александр Галушка и губернатор Олег Кожемяко. Сейчас в самом "Островном" довольно нервно реагируют на вопросы об аресте бывшего зампреда правительства.

Еще одна, обсуждаемая сейчас на Сахалине версия задержания Быстрова гласит, что целью силовиков является Олег Кожемяко – самый влиятельный в регионе политик.

– Совещания по квотам проходили много раз, причем участвовали в них и губернатор Олег Кожемяко, и глава ДФО Юрий Трутнев, и представители Росрыболовства, в том числе и руководитель ( Илья Шестаков. – прим. С.Р..) . Я не понимаю, как ситуация, когда обвиняют Быстрова, может не затронуть их, – говорит президент Ассоциации рыбопромышленных предприятий Сахалинской области Максим Козлов.

В любом случае у курирующих рыбную отрасль сахалинских чиновников настроения сейчас нервные. Следователь, ходатайствуя о продлении ареста Быстрову, написал, что есть основания полагать, что к совершению преступления причастны другие лица, которые пока не допрошены.
