Earlier, the prosecution provided Spacey lawyers allegedly received from the specified smartphone, however, representatives of the actor’s defense insisted that they have the right to personally study the phone. In their opinion, recordings could be removed from his memory that would confirm the innocence of Spacey. At the same time, Little and his family members claimed that the phone was lost, so it is impossible to provide it for examination.

The phone and messages sent to the young man to his girlfriend and friends in 2016 right in those few minutes when harassment allegedly took place, were the main evidence in this matter. But the defense claimed that the mother of the young man Heather UNRA, who filed a lawsuit before transferring the police apparatus, removed part of the contents, which could give a more clear idea of ​​his hobbies. According to Spacey’s lawyers, this can be regarded as the destruction of evidence.

Little's parents admitted that some photographs related to their son’s student life were deleted. But, claiming that now the phone has disappeared, they say that this happened through the fault of the police. In turn, the police assure that they handed the apparatus to Father Little. And he, testing in court, said that he did not remember this.

The young man himself, who first said that he personally did not remove anything from his smartphone, then decided to take advantage of the fifth correction to the US Constitution, which gives citizens the right not to testify against himself. For this reason, the testimonies of the young Little on the content of the records in the smartphone were generally completely removed from the case file by the decision of the judge.
