The Moscow City Court withdrew from consideration the appeal against the sentence of Pavel Rebrovsky, a defendant in the “New Greatness” case. The interests of the defendant were represented by lawyer from OVD-Info Maria Eismont and Agora lawyer Ivan Sustin.
Instead of considering the complaint, the court ordered a prosecutor's inspection to ensure compliance with the pre-trial agreement that Rebrovsky initially concluded. Sustin believes that in this way the court went beyond its powers, since neither the defense nor the prosecutor himself asked at the meeting to conduct an inspection. Lawyers are planning to appeal this decision.
Initially, Pavel Rebrovsky entered into a pre-trial agreement, admitted guilt and testified against the other defendants, after which he was sentenced to two and a half years in a general regime colony, having been found guilty of organizing an extremist community (Part 1 of Article 282.1 of the Criminal Code).
Later, at a meeting on the cases of other defendants, Rebrovsky stated that he had confessed under threat of terrorism charges (Article 205 of the Criminal Code). In addition, according to him, one of the conditions of the pre-trial agreement was a suspended sentence, but in the end he was sentenced to a real one.
At the same meeting, Rebrovsky gave other testimony. “He told the court the whole truth, how it all happened,” Nikolai Fomin, lawyer of the accused Anna Pavlikova, reported to OVD-Info. - That there was no extremist community as such, it was all just, in his words, like a farce. Yes, there was a discussion of political, social, economic issues, but there was no talk of any overthrow of power, or of any violence against police and other law enforcement agencies.”
