At the same time, it is difficult to talk about the real struggle against drug addiction in Russia. Here is dry statistics: in 2006, the number of drug users in the country, according to FSKN, was 2 million people, in 2014, according to the same department, drug addicts were already 8 million, and in 2017, the Minister of the Interior Vladimir Kolokoltsev, referring to the data of quarters, voiced a figure of 10 million.

According to the United Nations on drugs and crime, the situation is even worse - 18 million Russians use psychoactive substances.

The 228th is one of the most corruptally capacious articles of the Criminal Code, and the evidence on it is easiest to falsify: he threw drugs-and that’s all. But after the resonant cases of human rights activist Ayub Titiev and journalist Ivan Golunov, this article also became a political one - too easy a way to plant objectionable to the bars.

But this is not only this: sometimes, grabbing people for fictional crimes, the security forces sometimes do not notice that they destroy not only their reputation and people's lives, but also the infrastructure of entire settlements.

"New" tells the story of the doctor Oleg Baskakov, the only practitioner gynecologist in the city of Novy Lyalya of the Sverdlovsk region. He can go to jail for giving a hopelessly sick patient a sedative medicine that remained with his mother’s death.

Grandmother

March 24, 2019. At about 22 pm, the 74-year-old Nadezhda Arkhipov is brought to the Novolyalinsk city hospital in the ambulance (the name changed). The woman has a complete loss of the uterus, which can be visible a bleeding ulcer the size of a palm. The duties of the gynecologist Oleg Baskakov decide on hospitalization.

Back in 2018, relatives of Arkhipova submitted an application for an operation in Serov - this is a city neighboring with the new Lyalya, but the doctors said that the body would not withstand anesthesia. They were ready to accept grandmother in Yekaterinburg, but there, for 300 kilometers, her relatives did not take her.

With Baskakov, we climb the stairs of the Novolyalinsky hospital.

- I noticed that Arkhipova has a very uncomfortable diaper, as if bought for a child. Replaced it with high -quality medical, intended for adults. And processed the ulcer.

The next day, the nurse on duty complained to Baskakov that Arkhipova was sleeping well. And due to illness, Alzheimer behaves inadequately.

- Grandmother really looked very exhausted. The nurse suggested giving her diphenhydramine, but I forbade it: Dimedrol may not make a sedative, but, on the contrary, - an exciting effect. I had several ampoules of Tramadol and Sibazon in my personal drugs: my mother took them, she recently died of leukemia. I decided: I will give them my grandmother, let her rest.

Tramadol and Sibazon are medicines that were recently sold in pharmacies without a prescription. But today they are considered potent. Formally, Baskakov, before giving them to the patient, was supposed to make an appointment with the prescription of these drugs, then notify the senior nurse, who stores the keys to the hospital with list drugs, and fill out a number of forms. Only after that he could take medicines from the safe, and make injections.

- But it was evening, the senior nurse soon left. I would simply not have time to go through the whole procedure. So, the grandmother would again be left alone with her pain and Alzheimer's disease. And I just took out my personal medicines and handed them to my nurse.

This act became fatal.

The nurse, which Baskakov passed the medicine, in the corridor was stopped by the senior nurse of the surgical department Tatyana Smerdov. She took Ampoules from her colleague and stated that he would “complain to the authorities.”

Two days later, five police officers came home to Baskakov.

"Breed" as a criminal "

“Home”, however, a very loud word.

Oleg Baskakov lives right in the Novolyalinsk hospital, in one of the offices of the closed maternity hospital.

- I came here in 2017 from the city of Minyar of the Chelyabinsk region. There, medicine fell into decay, the reductions began, and I responded to the vacancy of the obstetrician-gynecologist in the New Lyala posted on the Internet. They called right away: they promised that they would give official housing. But beyond promises, as you see, it did not go.

The atmosphere in Baskakov’s room is modest: in one corner there is a table that has visited the views, in the other there is a hospital bed that replaces the bed, in the third - a closet without doors, and in the fourth shell. Between the bunk and a closet without doors - several chairs and a nightstand with the inscription “Clean vessel”, shampoos are stored there.

Baskakov, however, had already found pluses in the fact that he was not given an apartment.

- I am the only gynecologist in the city that works with emergency patients. And when an ambulance brings someone, day or night, I do not need to go far. I am always in place.

The fact that Baskakov is the only practicing gynecologist in New Lyal says a lot about the city. Officially, 12,000 people live in Lyal, but really - God forbid, that a third. The city-forming enterprise-the Novolyalinsky cellulose-paper plant-has been bankrupt for ten years. There is no work in the city, young people are running, from entertainment - the Red and White store.

When the police came to Baskakov, they turned everything over: they pulled things out of the closet without doors, examined the bed and the nightstand and found the only tramadol ampoule. The doctor had nothing more. This did not prevent a criminal case from the most difficult articles - part 1 of Art. 234 of the Criminal Code of the Russian Federation “Illegal circulation of potent substances for sales” and part 3 of Art. 30 h. 1 tbsp. 228.1 of the Criminal Code of the Russian Federation "Illegal Sales of narcotic drugs." The maximum punishment is up to 8 years in prison.

- Investigator Yaroslavtsev “pricked” me as a criminal. She said that I would be arrested and placed in the camera. She said: “You yourself signed a sentence. You will receive a real term, ”recalls Baskakov.

It is noteworthy that the police, the prosecutor’s office and the court in New Lyal are in the same building. They even have one entrance. This is very convenient: in one office, things are excited, in the other they are claimed, in the third they are sentenced. In the breaks, judges, police and prosecutors probably drink tea together.

- At first I was scared: I went not my own month. He began to drink Clofelin to calm down, ”Baskakov continues. - And then such anger took me: I don’t understand at all why they want to plant me! Yes, I broke the instructions, albeit because I felt sorry for my grandmother. Well, write a disciplinary sanction. But what a prison?

Baskakov began to write letters to different instances, but most of them remained unanswered. But he found support from his colleagues. Tatyana Surovneva, the head physician of the Novolyalinsk hospital, promised to stand up for him at the trial. On the specialized website vrachirf.ru - dozens of comments in defense of Baskakov from doctors from all over Russia.

I go along the corridors of the Novolyalinsky hospital and stop people in white robes. All of them support Oleg.

- A normal person and a good doctor. I myself turned to him, ”says the nurse Elena Barbashin.

- We have no more gynecologists in the new Lyal. If they put it - who will be treated for?

As for this case: I myself heard Khkhpova screaming, how bad she was. And Oleg Vladimirovich simply regretted her and did everything for her good. And the police, well, her police: they wanted to cut down the “stick”. It is as if they do not understand that they leave their wives without a doctor.

The doctor-therapist Nina Arsenyeva agrees with Barbashina. She also examined the patient Arkhipov.

- She had medical indications for the use of tramadol and sibazon. The doctor could well prescribe them. The fact that he did this is not according to the procedure is understandable. But we could convene a consultation, discuss the situation and make him a penalty. Although this, in principle, could not be done: he also helped the patient. The fact that criminal prosecution disproportionate his misconduct is obvious.

The act of the senior nurse Tatyana Smerdova, who called the police, is not understood in the hospital. I could not talk to her: on the day of my arrival in New Lyalya, she was on vacation. Baskakov himself says that they had conflicts with Smeridova - they did not agree on their characters.

Accusation

The whole criminal case of Oleg Baskakov is occupied by one volume. The plot is hard:

"Baskakov O.V. In the period from July 2016 to 03/25/2019, he acquired in an unidentified place from an unidentified person with three ampoules with a volume of 2 ml with a Trumadol drug with a total mass of 6.23 grams, which he kept in the nightstand in the office of a former maternity building. <...> 03/25/2019 Baskakov has an intent to sell potent substances, namely the drug "Tramadol". Realizing the lack of legal grounds in the appointment, Baskakov O.V. He went to the office of the former maternity ward, took two tramadol ampoules from the nightstand, after which he handed over ampoules that are not registered to the GBUZ from Novolyalinskaya RB, Nurse Tukhbatova V.A. For the subsequent introduction of an injection to the patient Arkhipova without official paperwork. However, the ampoules were seized by the senior nurse T. Smerida. "

Similar accusations are on Sibazon. As evidence: the reports of the police officers themselves, the inspection protocol in which Baskakov lives, and the examinations, which confirm that Tramadol is Tramadol, and Sibazon is Sibazon. The doctors who acted as witnesses confirmed the police that the medicines were prescribed bypassing the procedures, but also stated that Arkhipova felt bad and screamed. At the same time, they dispersed in the testimony of whether Trumadol and Sibazon in the Novolyalinsk hospital are generally in the Novolyalinsk hospital.

The questioned relative of the patient Arkhipova did not express any complaints about Baskakov.

The charge against the doctor was approved by the deputy prosecutor of the Novolyalinsky district, Georgy Bauder.

“The investigation was carried out extremely formally and incompletely,” said Georgy Krasnov, a lawyer of the Yekaterinburg Lawyer Office, representing the interests of Baskakov. - The creature of the criminal case is the answer to the question for what is the motives and for what purpose Baskakov prescribed drugs to the patient and whether there is a connection between the possible cure or relief of her ailments and prescribed drugs. The investigation did not come a single step to the answers to these questions and did not even try to establish these circumstances. The patient Baskakov was not interrogated during the criminal case, the examination of the state of her health was not carried out both of the physical and mental. Baskakov’s testimony about the difficult course of her disease, the investigation ignores. The indictment, as the final investigation document, does not meet the requirements of the criminal procedure law, since it does not contain an indication of the motives and goals of Baskakov and does not contain information about the possible effect of drugs on the patient's health. Thus, on the basis of this indictment and available materials of the case, the court will not be able to make a legal final decision in the case.

“I see in the actions of Baskakov the composition of a disciplinary offense, but not a criminal offense,” says the second physician lawyer Marina Gluzman. - He, as a doctor, could prescribe Tramadol and Sibazon to the patient, even if he had not had access to potent drugs. And he gave these medicines from his personal only because it was evening time, and if he went according to the procedure, the patient would have received medicines only the next day. In addition, we doubt whether the necessary drugs were in the hospital at that moment: now their availability is confirmed only by entries in the hospital journal, but these records can be fresh: we have not seen any overhead or other documents indicating that the hospital did not see such drugs.

The lawyer focuses on the fact that the investigation did not conduct an examination that would establish whether the patient of Arkhipova had an indication for the use of Sibazon and Tramadol. If this examination was carried out and she established that the testimony was, the matter would simply fall apart: it would be possible to remove the intent to sell from it, a purely medical story would remain.

But this is “if”.

Now Oleg Baskakov is preparing for the first court session, it will take place on Tuesday.

“The closer, the worse for me,” says Baskakov. - I have no idea about the criminal world. All his life he treated people. Yes, I had unsuccessful operations. All doctors have them. But I never wanted to harm anyone. I hope the court will still understand this ...
