The Moscow City Court left in custody two defendants in the case of "mass riots" - Danil Beglets and Sergei Fomin. Alla Frolova, coordinator of legal assistance at OVD-Info, reports this.
The charge in the case of the Fugitive was reclassified from participation in mass riots (part 2 of article 212 of the Criminal Code) to the use of violence against a representative of the authorities (part 1 of article 318 of the Criminal Code). As . Ilnur Sharapov, the lawyer of the Agora International Human Rights Group, noted during the meeting, the investigation has no evidence of the Fugitive’s guilt, except for the testimony of three National Guardsmen who said they were injured, but did not point to the Fugitive, as well as a video recording in which it is impossible to identify the person involved in the case . The defendant himself said that it was considered “use of violence” that he picked up the headphones of a protester who was being detained by the security forces.
On the old charge, Danila Beglets was threatened with up to 8 years in prison, on the new one - up to 5 years.
Alexei Veselov, a lawyer from OVD-Info, who defends Sergei Fomin, whose case was heard simultaneously with the meeting of the Fugitive, also stated that none of the materials attached to the case contained any reference to Fomin personally.
The court left in custody both defendants in the case.
Earlier, the court had already separated into separate proceedings the cases of other defendants under the article on the use of violence against a government official (part 1 of article 318 of the Criminal Code) - Yevgeny Kovalenko and Kirill Zhukov .
In the case of "mass riots" there are currently 14 defendants. 13 of them have been charged, all of them are in custody. Three of them - Yevgeny Kovalenko, Kirill Zhukov and Samariddin Radjabov - are accused not only of participating in "mass riots" (part 2 of article 212 of the Criminal Code), but also of "using violence not dangerous to life and health to police officers and soldiers of the National Guard” (part 1 of article 318 of the Criminal Code).
