On September 3, the court will decide whether to terminate the ex-coordinator of Open Russia Yana Antonova

On September 3, the Leninsky District Court of Krasnodar will announce a decision to terminate the criminal case on an “unwanted organization” against the former coordinator of the local branch of Open Russia, Yana Antonova, said the lawyer of the Human Rights of Cards, Alexei Pryanishnikov.

“At the last meeting, lawyers asked to terminate the proceedings in view of the fact that more than a year passed between the entry into force of the decisions of 20.33 of the Code of Administrative Offenses. The prosecutor paused, the consideration was postponed until today, August 22, ”said Pryanishnikov.

At today's meeting, the prosecutor said that the deadlines should be considered from the moment the fine was paid, and not from the moment the decision under the administrative article enters into force. The court announced a break until September 3, and at the next meeting a decision will be announced.

On August 13, the lawyer “Human Rights Cards” Alexander Valyavsky filed a motion to return the case to the prosecutor's office to eliminate violations. According to him, the first administrative resolution of October 13, 2017 is illegally included in the materials of the criminal case, since for such a violation Antonov was attracted a second time later - on February 19, 2019.

The criminal case against Antonova became known in April. The activist is accused of carrying out the activities of an unwanted organization (Article 284.1 of the Criminal Code) due to the picket and publications on Facebook. This article provides for up to six years in prison.

The Open Russia movement was created in November 2016 at a conference in Helsinki. On April 26, 2017, the Prosecutor General’s Office recognized the foreign organizations OR (OTKRYTAYA ROSSIA), Open Russia Civic Movement, Open Russia (public network “Open Russia”) in the UK, as well as Institute of Modern Russia, Inc (“Institute of Modern Russia ") in the USA. Then the Ministry of Justice said that there were no branches of these organizations in Russia. Thus, the “Open Russia” operating in Russia was not related to these organizations and was not undesirable. Despite this, administrative and criminal cases about the activities of an unwanted organization were started on the members of the organization.

In March, Open Russia announced the elimination of the movement of the same name, since the Russian public organization Open Russia (ROO Open Russia), established in Moscow on February 24, 2019, has already been created.
