Four years ago, Pavel Ustinov came to Moscow from the Krasnoyarsk Territory, entered the theater institute here - dreamed of the theater from the school stage, and staged performances with classmates. A year ago, he returned from the army, where he served in the Russian Guard and even thought to continue the contract service, but he was still pulling more to acting. Pavel did not know about rallies and even more so about elections to the Moscow City Duma, because he was not interested in politics. On the afternoon of August 3, Ustinov arrived at the center and, buried in the phone, stood near the exit from the Pushkinskaya metro station - was waiting for a friend. After a couple of minutes, the Rosgvardists attacked him, beat with batons and pushed into a car gut. In Avtozak, Ustinov was informed that during the detention he dislocated his shoulder to the Rosgvardez. Now Pavel Ustinov is facing up to 10 years in prison.

The large family of Pavel lives in a two -story apartment in the Shchelkovo near Moscow. He himself made repairs in his room, he himself installed a decorative fireplace. The sleeves and stripes of the Ministry of Internal Affairs are hidden above the bed behind the glass - “souvenirs” from the army. Julia Ustinova worked in private security for about nine years. She does not understand why the security forces call “mass riots” what is happening on the streets of Moscow, why people are brutally beaten on the ground, and her younger brother was imprisoned: “A person had another interest in life, not a politician. Pavlik had personal life in the first place, then business and theater. ”

- There are five of us [children] in the family. We have an older brother, then I go, my sister and two brothers - Pavlik is the smallest. We lived in the north (in the Krasnoyarsk Territory), and the guys, when we entered the institute, came here. Mom decided to be closer to the children and then also moved. It was in 2016. Pavlik entered the Higher School of stage arts under the leadership of Konstantin Raikin. For four years he studied, received a diploma there. He studied and parallel to choreography was still engaged. In August, he was supposed to leave with the “Friday” program for some island there, the survival program-the [casting] was held in the reality show, and they took it.

On August 3, Pavel called a friend - he wanted to offer a job. Pavel first drove into a cafe to his girlfriend Katya (she works a barista), took coffee with him and went to Pushkinskaya.

Part 2 of Article 318 of the Criminal Code of the Russian Federation, which is charged with Ustinov, is the application of violence in relation to the representative of the authorities (dangerous to life and health), punishment - up to 10 years in prison.

“We conducted an examination, checked - there are no confirming moments that he is an active oppositionist. But for some reason they decided not to attach these conclusions in the case file. ”

Czechkov also handed over to the investigator a request for the interrogation of two defense witnesses. However, the indictment says that there are no defense witnesses.

Pavel himself at the first court hearing told the judge of the Tver District Court of Maria Sizintseva that he "physically could not cause damage to a person three times superior in terms of physical strength [...] I did not want to harm anyone." He once again emphasized that he did not participate in the rally at all.

- In almost all newspapers they write that he was a “foreman”, shouted slogans. Such a person was discredited, having no facts and ideas about this situation in general. We have a lot of videos from the side where he did not yell any slogans. He came, called, to meet a friend, - Julia recalls articles in which they wrote that "the Russian Guard hit the Russian Guard." - Even in the comments they wrote that he needed so that he used to beat people, let him beat him now. But he did not beat anyone.

In 2017, Ustinov went into the army. There he was distributed to the Russian Guard - so he turned out to be the "former Rosgvardean", as many media now call him. According to Pavel’s sister, they were not sent to protest promotions, only during the World Cup was put in the subway in Moscow last summer.

The day after the detention, on August 4, Ustinov was charged under part 1 of Article 318 of the Criminal Code of the Russian Federation - this meant that violence was applied to the police, non -hazardous to life and health, - it was said that he received a dislocation of the shoulder joint. The maximum term for this part of the article is up to 5 years in prison. True, after a day, part of the article was changed to the second - and this already meant damage that is dangerous to life and health - supposedly the Russian Guard could tear the ligaments and receive dislocation of medium severity. In this case, the term is doubled - up to 10 years. “There was an impression that the investigation took upon itself the powers of the forensic examination to determine the severity of harm to health,” lawyer Dmitry Czechkov spoke about changing part of the article.

There was no medical examination about what nevertheless happened to the representative of law enforcement agencies for almost a month. On August 29, the lawyer received it, as well as a notification of the end of investigative actions - the Rosgvardeza "caused harm to the health of medium severity."

“The media wrote that the Rosgvardists are already waiting for him back into their ranks,” says Julia. “But, forgive me, if you have a dislocation of moderate severity - how will you work further?” When you have a collision, your shoulder will fly out. In an interview [the Russian Guard] he said: “I do not want to complain, they don’t complain about this,” but yes ... - Julia grinks on this moment. - I talked with the wife of another accused under the same article, only her first part - she told me how the Russian Guard complained that he grabbed his hand - it hurt him. Although they were beaten, they also have uniforms.

“All young guys, from 20 and older. Well, where to spoil their lives and why? Did they kill someone?
