The defendants in the Moscow business remained under arrest

On September 30, the metropolitan courts left without changing the measure of restraint to the defendants in the “Moscow case”. The Moscow City Court recognized the arrest of Nikita Chirtsov as legitimate, and the Basmanny court extended the house arrest Sergey Fomin. On the same day, the court was supposed to consider an appeal for the verdict of Ivan Podkopaev. However, the hearings were postponed to observe the formalities: the convict for three years Podkopaev did not notify the meeting in time. Although Podkopaev himself objected to the transfer, he did not want to delay the process and was ready to defend himself. But the court insisted on his own - a complaint about the verdict will be considered on Wednesday, October 2.

While the Moscow City Court was considering an appeal to actor Pavel Ustinov, in another room they listened to a complaint of protection as it was stopped by 22-year-old Nikita Chirtsov. On August 28, he was detained in Minsk by the local security forces, who reported that he was wanted to participate in the Moscow campaign on July 27. He was transferred to the migration service to return to Russia.

Upon arrival in Moscow, no one began to detain him. They caught Chirtsov only on September 2, was charged with the use of violence to a representative of the authorities (part 1 of article 318 of the Criminal Code of the Russian Federation). The next day, September 3, the Basmanny Court arrested Chirtsov for two months. According to investigators, during an inconsistent campaign on Tverskaya Street, the accused

"He pushed the policeman with both hands into the chest area, thereby causing him physical pain."

Chirtsov threatens up to five years in prison.

The defender of Chirtsov Alexander Borkov asked to cancel the arrest and release his client. According to the lawyer, all investigative actions have already been carried out, so there is no need to keep Chirtsov in custody.

“I ask you to pay attention, we are considering a precedent case. All materials and evidence are collected. The case belongs to the category of moderate severity, and my client, being outside the pre -trial detention center, can no longer affect the investigation and witnesses. The chosen preventive measure is excessive, ”Borkov explained, and added that in the near future they will begin to get acquainted with the case file with Chirtsov.

The court questioned the father of the accused Maxim Chirtsov, who presented the characteristic of his son. “Good guy, kind, polite, not arrogant, fair. I played sports. He never had problems with the law in his life.

They never even called me to school. I am shocked that this happened to him, ”said Chirtsov Sr..

The accused himself asked not to be in prison. Now it is contained in SIZO-5, according to the decision adopted by the judge of the Moscow City Court Marina Selina, will remain there until November 2.

At the same time, a meeting was held in the Basmanny court at a different person involved in the “Moscow case” Sergei Fomin. He is the last of the defendants in the case to whom only participation in the riots is charged with (part 2 of article 212 of the Criminal Code of the Russian Federation). The investigation petitioned for the extension of house arrest due to the fact that "the accused could continue to engage in particularly dangerous activities, hide or destroy evidence." On August 5, Fomin was put on the wanted list, and on August 9, having learned that they were looking for him, he surrendered to the police on his own. According to his lawyer Alexei Veselov, "since then no investigative actions have been carried out, he has never even been interrogated."

The accused Sergei Fomin came to the court with the flag of Russia and a T -shirt with a quote from Art. 2 of the Constitution of the Russian Federation: "Man, his rights and freedoms are the highest value." The defense and Fomin himself asked to cancel the house arrest and release him in the courtroom.

“Firstly, there were no riots, on July 27 I went to a peaceful action. The criminal case was instituted on me because of the propaganda video, where I was exhibited by a terrorist who came out of the cordon using a small child. The federal channels did not bother to check it. Secondly, when I found out that I was on the federal wanted list, I myself came to the police.

I have no need to run away because I am innocent. If they put me down, then it will be on the conscience of the Russian government, she will not get used to it, ”said Fomin.

However, judge Natalya Dudar considered the arguments of the prosecution convincing and extended house arrest until January 8, 2020.

Former defendants in the case Daniil Konon, Vladislav Barabanov, Alexey Minyailo and Aidar Gubaidullin came to support Fomin. After the decision was announced, they went straight to the Moscow City Court to support Ivan Podkopaev.

On September 3, the Tver court sentenced him to three years in a general regime colony for the fact that during the action on July 27 he sprayed a gas spray towards the Russian Guard. He was found guilty under Part 1 of Art. 318 of the Criminal Code of the Russian Federation ("Application of violence in relation to a representative of the authorities not dangerous to health"). The Podkopaev case was considered in a special manner - without researching evidence, since he pleaded guilty.

The Moscow City Court was supposed to consider its appeal for the verdict, but the meeting did not take place. Judge Elena Ivanova postponed the hearing to October 2 due to the fact that Podkopaeva was not informed about the date of appeal. Podkopaev himself objected to the transfer.

In standby mode, other persons are still defendants. Next week, the Moscow City Court will consider the appeals of Yevgeny Kovalenko, the Danila fugitive, Konstantin Kotov and Vladislav Sinitsa. In the pre-trial detention center, the 318th remains Eduard Malyshevsky. Egor Zhukov, accused of calling for extremism, remains under house arrest.
