The Moscow City Court canceled the fine of municipal deputy Sergei Tsukasov in the amount of 170 thousand rubles for August 3

The Moscow City Court overturned the decision of the Dorogomilovsky Court to impose a fine of 170,000 rubles per share on August 3 on the municipal deputy of the Ostankinsky district of Moscow and ex-candidate for the Moscow City Duma Sergei Tsukasov. This was reported by Tsukasov's lawyer from OVD-Info, Yulia Chekunaeva.

Tsukasov's administrative case under part 8 of article 20.2 of the Code of Administrative Offenses (repeated violation at a mass rally) was canceled due to procedural violations.

Tsukasov was detained on August 3 in Moscow, when he was holding a one-man picket on Trubnaya Square. He was detained and taken to the Fili-Davydkovo police department, after which they immediately apologized and released him. Literally an hour later, the same head of the police department detained him again, and a protocol was drawn up against Tsukasov under part 5 of Article 20.2 of the Code of Administrative Offenses (violation by the participant of the action of the procedure for holding it).

When reviewing the case materials in the Dorogomilovsky court, it turned out that on August 12 another protocol was drawn up - under part 8 of article 20.2 (repeated violation at a mass rally). The police received information about the “repetition” of this article from Tsukasov. Without waiting for Tsukasov's notification (a mark on delivery of the telegram), as required by law, the police drew up a new report without him.

The Dorogomilovsky court did not take into account this procedural violation, and the court of first instance also refused to watch the video recording and interrogate police witnesses. The court's decision was based on their written reports. As a result, today the Moscow City Court canceled the decision of the Dorogomilovsky court on a fine of 170 thousand rubles.
