
October 30, acting The prosecutor of the Central District of Krasnodar Ilya Labashev instituted administrative production against human rights activist Julia Fedotova.
The prosecutor accused the lawyer of the fact that in May of this year she filed a lawsuit (!) To the Krasnodar Regional Court to cancel the two provisions of the regional law on rallies. Moreover, she did, according to the state prosecutor, in the framework of the “Human Rights Procedure” project, which Labashev reckoned with the programs of the “unwanted” British organization “Open Russia”.
The filing of a lawsuit in the framework of the “human rights cards”, according to the Krasnodar prosecutor, is an offense provided for in Article 20.33 of the Administrative Code of the Russian Federation “The implementation of activities in the territory of the Russian Federation“ undesirable ”organization”. The peculiarity of this article is that for a person held liable for it twice within one year, the path to criminal prosecution under Article 284.1 of the Criminal Code of the Russian Federation is opened to the age of six years in prison.
And the decision of the prosecutor Labashev for Fedotova is just the second.
Court for lawsuit
Fedotova does not even deny that until January 2019 she took the affairs of "human rights cards."
“But the lawsuit in question was filed in May of this year,” she says. - I gave it because I, like a lawyer, had an agreement with a resident of Krasnodar Viktor Chirikov. He hired me - I filed a statement.
In the resolution of Labashev prosecutor “Human Rights Cards” to the “undesirable” “Open Russia” is tied through the conclusion of Professor Kuban State University Viktor Yurchenko. According to the conclusion, he studied the site en.openrussia.org, which considered the official Internet page of the British organization Open Russia and found that it has the Human Rights Open Russia program.
As a professor of KubSU (and, by the way, a member of the United Russia Regional Political Council) it succeeded - it was not clear: the site en.openrussia.org is under development, the only record that can be found on it is Under Construction.
Be that as it may, Yurchenko’s conclusion does not say anything about the connection of “Human Rights Open Russia” with the “human rights of the postcard”. The prosecutor Labashev, in a decision on the initiation of an administrative case, writes: “According to the expert’s conclusion, the Open Russia organization has a project called“ Human Rights Open Russia ”,“ Human Rights Cards ”is an alternative name for this project.”
““ Human rights of postcards ”to the British organization“ Open Russia ”, as well as“ open Russia ”has nothing to do,” says Julia Fedotova. -And “human rights cards” are not some kind of prohibited organization. This is not an organization at all. This is the Internet community that exists on Facebook and VKontakte, in which you can really get legal assistance.
According to Fedotova, prosecutors bring her under criminal prosecution.

Response
For the first time, the case under Art. 20.33 Code of Administrative Offenses against Fedotova was excited only three weeks ago - October 7. It is also associated with the “open Russia”, and the prosecutor Leonid Mogilny, who may have “personal scores”, is the prosecutor of it.
“In May of this year, I won the grave case in the magistrate,” recalls Fedotova. - He tried to bring to justice under Article 20.33 of the Code of Administrative Offenses of the poet Maxim Drozdov. Drozdov read poetry on the cabbage of “Open Russia”, and then replaced the video from these readings on his Facebook page. And on the video there was an open Russia logo. The prosecutor found that Drozdov was also a member of the “undesirable” organization. But we managed to fight back.

However, to the surprise of Fedotova, in early October, the same Prosecutor Mogilny called her already herself. And he announced that she was suspected of connections with an “unwanted organization” because of the repost of the same video with Drozdov’s poems.
- When my lawyer Alexei Avanesyan asked Mogilny if it was a matter of revenge on me, he did not answer. It seems to me that these two cases on 20.33 Code of Administrative Offenses are not only and not so much on me.
For some reason, the prosecutor’s office is fundamentally cleaned out of the public space everything related to “open Russia”.

The meeting in the first administrative case against Julia Fedotova is scheduled for November 5, for the second - to the 6th. 11 lawyers have already volunteered to protect her Pro Bono.
