
Viktor Filinkov, who declared on October 30 in the St. Petersburg pre-trial detention center-3 a hunger strike of solidarity with all political prisoners, was hospitalized in the hospital. This resolution was recognized as invalid paragraph 2 of paragraph 119 of the Procedure for organizing medical care to persons serving a sentence in places of imprisonment and detained (approved by order of the Ministry of Health and Social Development of the Russian Federation and the Ministry of Justice of the Russian Federation of October 17, 2005 No. 640/190). This paragraph allowed a temporary prohibition of dates and visits to the patient by other persons, including lawyers, under quarantine and on other socio-epidemiological grounds. The Supreme Court of the Russian Federation admitted that such a restriction does not comply with the current legislation and violates the human rights, including to receive legal assistance.
On November 7, members of the Public Supervisory Commission Anastasia Nekozakova and Elena Shakhova came to the hospital. But they could not meet Victor - the hospital staff said that he was contained in a separate boxing of the infectious department, excluding visiting third parties. According to the employees, Victor has a suspicion of jaundice (hepatitis), and admission to it is impossible until the tests excluding hepatitis are ready.
The arguments that hepatitis is not transmitted by airborne droplets and does not pose a danger to the PMC members were ignored.
The only thing that the PMC members were shown was the Filinkov statement dated November 6, 2019 with the refusal of the hunger strike: “I, Viktor Sergeyevich Filinkov, stop the hunger strike, I feel good.”
About 45 minutes with the members of the PMC was talked by the head of the hospital. Haaza S. Ya. Badertdinov. Then, when Elena Kuznetsova arrived, assistant to the head of the Federal Penitentiary Service in St. Petersburg and Luo for the observance of human rights in the penal system, they were allowed to go around the hospital, accompanied by Kuznetsova and her secretary. All surveyed patients together stated that there were no complaints. But they never allowed Viktor Filinkov.
Vitaly Cherkasov filed complaints with the Federal Penitentiary Service of the Russian Federation in St. Petersburg and Luo and the prosecutor's office of St. Petersburg, demanding that Viktor Sergeyevich Filinkov immediately take measures to restore the rights of the accused Filinkov. The application was also sent to the Commissioner for Human Rights in St. Petersburg Alexander Shishlov.
Recall that after the detention of Filinkov on January 23, 2018, the FSB officers neither his relatives nor his human rights activists could receive any information about the whereabouts of Victor - including when applying to the FSB, the Ministry of Internal Affairs and the prosecutor's office. As it will then become known from the statement of Filinkov, at which time he was tortured using electric current.
