The judicial investigation in the case of 17-year-old Nikita Kobelev, who died in the police department, is completed. The young man on whom the gas mask was put on was choked with vomiting. On Thursday, in the Supreme Court of Buryatia, a sentence was announced to the police.

8 years, 4 years, 3 years and 3 years conditionally - such sentences were received by police officers who were found guilty of the death of a young man. In order to punish them, it took almost three and a half years.

- In the coffin, my boy was all blue from bruises and abrasions. When we came to the morgue behind the body, the orderly told us immediately that we would take the package of absorbent disposable diapers. We asked: "Why are there so many?" They explained to us that Nikita had more than 30 hematomas on the body. They were all opened for examination, he oozes all therefore, - says Nikita's mother Marina Kolodina .

The police detained 17-year-old Nikita Kobelev in the evening of June 8, 2016 in Ulan-Ude-presumably on suspicion of theft of bicycles. As it turned out later, the detention of Nikita and his friend Dmitry Tutynin resembled more a special operation to capture especially dangerous criminals. On the video frames, captured by the chamber of the store where the detention took place, it is clear that the guys are grabbed by the armed OMON fighters, acting extremely tough.

The guys were planted on different cars and took them to the police department. A day later, Nikita's mother informed that her son died. It was not immediately possible to find out about what was happening during these hours with the detainees. The police denied their involvement in both the death of Nikita and to torture and beating his friend Dmitry Tyutin.

All these three years relatives demanded only one thing - to punish the guilty persons along the whole severity of the law. His family failed to achieve the investigation of Nikita’s death for a long time. However, when it became known that the 17-year-old guy died, choked on the vomiting masses during his stay in the police department, the noise rose. According to the relatives of the deceased, it is publications in local and federal media, as well as the participation of the family in the show "Let them talk", attracted attention to the case, and it was transferred to independent investigators to Novosibirsk.

- Almost 4 months, while we in Buryatia tried to achieve justice and a normal investigation of the case, we were inserted into the wheels. They argued that Dima was giving false testimonies, then these police officers were witnessed. They said that Nikita was found on the street and then taken to the hospital. They claimed that the vomiting of his son opened in their car. Different versions sounded from the lips of the police, which then officially distributed on local media, ”says Marina. -Only when the Novosibirsk arrived, they were closed to the pre-trial detention center and the investigation began to conduct a completely different way.

As a result, the operative officer Sergei Plotnikov, the former head of the property crime disclosure department and the operational cover of the sales sections of the Ministry of Internal Affairs of Russia in the city of Ulan-Ude Andrei Pavlov, the head of the crime disclosure against the ownership of the OUR OU OP No. 1 of the Ulan-Ude Oloktonov, were involved in the case. Senior Operational Council Valentin Smolin, as well as the senior operative officer OUR OUR OU No. 1 of the Ministry of Internal Affairs of Russia in the city of Ulan-Ude Tumen Manibaraev.

"According to investigators, in the evening on June 8, 2016, in the storehouse of the store on Darwin Street in Ulan-Ude, police officers, Pavlov, Oloktons, Manibraev, as well as two riot police officers detained a minor and his 18-year-old acquaintance on suspicion of theft of bicycles. At the same time, Plotnikov stole at least two shots at least two shots With his foot, and Pavlov hit him on the same day, the detainees were delivered in two cars to the building of the Russian Ministry of Internal Affairs in the Republic of Buryatia. Having received the information required by the police, Smolin and Manibraev took the young man to the "places of crime" allegedly committed by the detainee. Marina went to all the courts and assures - to this day the police did not repent of what they did.

- At one time they admitted everything, and then they began to refuse again. They say that they were forced to say, they say, the OSB came every day and made them confess. That is, while they were in a pre -trial detention center, they completely pleaded guilty, when they went out - they went back to refusal, ”says Nikita's mother. - On ships recently, they have been behaving as if they are sure that they will not be anything, that they would leave the courtroom home. There is no repentance on their faces. We also did not hear words about forgiveness.

According to Marina, to the questions that she and her lawyer asked him, the police answered defiantly and unfounded:

-When asked why OMON was attracted to the detention of two teenagers, they answer, they say, someone told them that the guys were armed, that they were professionally engaged in boxing, and therefore they supposedly prepared that way. I ask: "Why did you get it? My son never was engaged in boxing and had no weapon." In response, they shrug. So unfounded they try to substantiate that during the detention they clearly used excess force. After all, they came for Nikita with machine guns.

It is still not clear why, after all, the guys were detained that evening, did the hijackers really sought bicycles and was the theft?

- As they explain, supposedly the authorities gave them an order that it was urgent to develop an organized crime group. Moreover, it was necessary to close the case retroactively. And they decided to get out of the situation like this-to catch up with the guys, close, something like that, ”says Marina Kolodina. - Was there theft of bicycles? I asked this question too. If there was a theft, even if one suspect died, the second is alive, then why isn't the case? Why was there no court?

Nikita’s brother Alexander still cannot believe what happened. In an interview with the Tivik TV channel , he said that he was also subjected to violence by the police. Three months before the death of Nikita, he also visited the police department.

“I don’t know what happened there, but I supposedly stole the phone.” I naturally present documents, a check, a receipt that the phone is really bought.

This is precisely Pavlov said to me: "And we do not care if you bought it or not, this phone is wanted, so you’ll boot it now." I was tied, my hands behind my back, put me on a stool, put a bag on my head and buy the air, your happiness, if you now confess and get out of here. Of course, it is easier for them to take this kid of a 17-year-old, like my brother, to hang good for him ... And of course, he will sign everything, ”says Alexander Kobelev .

At the stage of the preliminary investigation, the suspects completely denied their guilt and gave the false testimony clearly agreed among themselves - in particular, they put forward the version that they found Nikita lying on the street and just raised it to help.

“In addition, the accused tried to influence witnesses, inclining them to give knowingly false testimonies in support of the accomplices. To establish all the circumstances of the crime, investigators of the IC of Russia conducted a significant amount of investigative actions, including 120 interrogations of witnesses, assigned more than 20 complex and laborious examinations. Their main mass was carried out in other subjects in order to prevent the possible influence on the research results As a result of large -scale work under pressure from the investigation, almost all the accused testified to them in the incriminated crimes, ” the SK reports .

The lawyer of the human rights organization "Zone Law" Roman Sukachev, who represented the interests of the Nikita family in court, is somewhat surprised by the verdict.

- Practice in the courts of Buryatia is such that in such cases they give everyone conditionally. I have never encountered that real terms were given. In our Transbaikalia, everything is different for a long time, and in Buryatia the judicial practice of the zero years flourishes. Therefore, there are such security officials, because they do not feel punishment. They are not afraid, even if the crime is not hidden and investigated. We agree with the sentence, we will not appeal. We will insist that this sentence remains in force with such a punishment, we consider it legal and fair. Later, when the decision enters into legal force, we will file a lawsuit against the Russian Federation in the person of the Federal Penitentiary Service for compensation for non -pecuniary damage caused by Kobelev’s death.

If there were people without shoulder straps, then they would be tried for the murder

The lawyer emphasizes: the guilt of police officers burden that they have not repented to this day.

- This is a pre -planned crime. They didn’t take a gas mask in the store, they already had it. This is a very serious crime, at the same time very obvious: here it is a corpse, here is an examination - he choked on the vomit. There is also a video of detention with machine guns. In general, they would repent, apologize-in a manly novel would be more correct. The criminal who did not repent should really sit in prison. It should be an axiom for judges, ”said Roman Sukachev.

Nikita’s mother is not quite satisfied with the verdict.

- For three years we have been waiting for this decision. On the one hand, this article is the maximum punishment and we are satisfied. On the other hand, I still think that Article 105 would fit more here-“Murder”. And there is already a punishment up to 15 years, if it is committed with particular cruelty all the more. In fact, I would like such a punishment for them. After all, they did not just kill him while he walked past. They beat, tortured, tormented. In the coffin he was lying gray! And the police tormentors give for all this only a few years. The 105th was really initially excited when the version was appearing that the police found him dead. And when they learned that this is the work of the current employees, it turned out that the 105th article was not applied to them, since they were in the service. If there were people without shoulder straps, then they would be tried for the murder. Let there be no intent to kill, they wanted to load them, but they still killed them. And they did not admit the deed. They obviously did not expect them to close them because they arrived in personal cars. Were confused. Honestly, I myself did not expect. Human rights activists told me that in Buryatia in such cases they give only conditional terms. Therefore, we personally will not appeal.

Recall, already in the fall of 2017, all the detainees were released on a recognizance not to leave. According to Marina Kolodina, during this time children appeared in the families of some of them - Marina is sure that this is due to the hope of the defendants to mitigate the sentence.

The court sentenced the high -ranking police Andrei Pavlov and Anatoly Oloktonov to 8 and 4 years in prison, the detective of Valentin Smolin and Tumen Manibraev Dali was 3 years old. After the sentence was announced, all four accused were arrested in the courtroom. Operational officer Sergey Plotnikov received three years in prison.

On October 31, Nikita Kobelev would be 21 years old.
