The European Court of Human Rights (ECHR) awarded compensation to Leonid Razvozzhaev and Sergei Udaltsov, convicted in the Bolotnaya case. The decision was published on the website of the court.
The ECHR ordered the Russian authorities to pay Razvozzhaev 11,000 euros and Udaltsov 9,000 euros. Ukraine must also pay Razvozzhaev 4,000 euros.
The European Court held that the right to a fair trial and within a reasonable time had been violated in respect of both applicants (Articles 5 and 6 of the Convention on Human Rights).
Following Razvozzhaev's complaint, the court found that Russia and Ukraine had failed to conduct an effective investigation into his allegations of unlawful imprisonment and humiliating treatment. This violates the prohibition of torture and the right to liberty and security of person (Articles 3 and 5 of the Convention). Also, a violation of the Convention (Articles 6 and 8) in relation to Razvozzhaev, according to the decision of the ECtHR, were long prison transfers, an excessively intensive schedule of court hearings, detention in a glass "aquarium" in court and detention in a remote colony.
In relation to Udaltsov, the court also found violations of the right to freedom of assembly (Article 11 of the Convention).
A number of judges wrote dissenting and supporting opinions to the court's decision.
