Magnitogorsk officials evict a whole family from an exploded house anywhere

On December 5, the Right -Bank District Court of Magnitogorsk will consider the lawsuit of the city administration against a resident of house No. 164 on Karl Marx Tatyana Pisareva and two of her children. Officials demand that the family leave one-room apartment that they provided in 2010: then the Pisarers lost their own housing due to the actions of the “black realtors”. According to representatives of the city hall, Pisarev and her children no longer need a municipal apartment, because "they inherited a share in another living room." True, the administration is silent that it is arrested. And the troubles of Tatyana Pisareva began with the fact that she, having looked at the speech of Vladimir Putin, asked her to move her from the victim from the explosion of the house No. 164.

On December 31, 2018, in Magnitogorsk, the entrance of an apartment building on Karl Marx Street, 164. The official version of the emergency gas is an explosion of domestic gas. On the day of my arrival, Tatyana is one at home: girls in class. The eldest, Daria, graduated from a school with a gold medal and is now studying at one of the country's leading universities. The youngest, Eve, the winner of the Olympiads, entered the college.

That night, December 31, 2018, fortunately, there were no pussy at home. Glasses in the kitchen and on the balcony flew out of the explosion in the apartment, kitchen cabinets fell. The boards in the floor under linoleum dispersed, now it creaks and falls underfoot.

Tatyana incurred all expenses herself, because she did not lose “property property property. The difficulties with obtaining assistance, she said, had many victims of the explosion.

“People died with whole families, and only the heirs of the first stage were recognized as those who had the right to pays for their death,” says Pisareva. - But those also had problems, because after the explosion the destroyed apartments from the real estate register began to simply disappear.

Tatyana gives an example a grandmother, whose daughter and both grandchildren died. The woman could not receive compensation for the death of her grandchildren, because she is the heir to the second stage.

For the same reason, Lidia Volchenko, living through two entrances, the city administration refused to pay compensation for the death of her sister Maria Lepkova. And Viktor Anashkevich, who lived in an exploded house with his parents, but without registration, after their tragic death had to be absent. Bureaucratic problems arose in a woman who has a share in an apartment purchased with the involvement of “maternal capital”: in order to get a certificate for new housing, you need to transfer the old administration, and write out children for this. But according to the law, they cannot be written out “to nowhere”, only to a new apartment. And where to get it if the certificate is not given? As a result, the family was forced to refuse to move.

“Many just waved their hand and decided not to receive anything at all,” says Tatyana.

Those residents who nevertheless received a certificate from the administration had to implement it before December 1, 2019, many had to acquire something, just to have time.

"Fear of people in expensive costumes"

Pisareva says that in the spring of 2019, the inhabitants of the house met with then the acting Governor of the Chelyabinsk region Alexei Texler. Everyone had difficulties, but only those who were not destroyed, and relatives did not die about them, decided to tell Texler about them. Those who lost loved ones could only cry at that meeting.

“People have such problems, and they can’t say anything: they just stand and cry,” Tatyana recalls. - I talked with Texler, he was even at my place. When he left, we stood in the yard for a long time. The neighbors told, told, told ... And then they asked me: "What did Texler tell you?" I to them: "Why didn't you ask him yourself?" And they answered: "Scary." What could be worse than losing your relatives? It turns out that it is worse - to ask the official. Where does such fear of people in expensive costumes come from?

At the end of the meeting, Tatyana offered everyone to help everyone in writing official appeals to the administration and dictated her phone number.

“I said that I don’t know how to help them, but it seems to me that you have to fight for my rights.” After that, my phone did not fall silent.

Residents decided to write about their problems to the president. The text was together: they complained that the assistance was “not in full” and “through overcoming bureaucratic barriers”, and it is impossible to acquire equal housing for the received compensation. The most announced the unsubscribes of the city administration and the need to sue even for minor amounts. “In general, we are not refused when we turn, but they do not provide any help. We are given "valuable tips." In most cases, there is only one advice: "Go to court." We regard such help as a mockery, ”wrote people.

Residents asked the president to oblige the city administration to provide specific assistance to specific families, and not get off with common phrases. Otherwise, they intended to declare a hunger strike.

On May 15, 2019, Tatyana sent the handling of her personal email. Today, the woman assumes that this is exactly what the anger of the city administration has introduced herself.

The consequences of a letter to the president

It all started with success. On May 21, the Government of the Russian Federation ordered to expand the circle of persons who could receive compensation for dead relatives: the list includes brothers and sisters, grandfathers and grandmother.

30 days after sending the appeal to Vladimir Putin Pisarev received a response from the president’s reception with a proposal to notify the leading hunger strike the leadership of the city and the region. Most of the wishes of the victims have not yet been fulfilled, and Tatyana wrote notifications.

In the editorial office of Novye, there is a response to the administration of Magnitogorsk, a copy of which was sent, among other things, to Vladimir Putin. Part of the answer of the officials is quite strange: they report that the city administration called each of the signing to the president personally and asked if they intended to take part in the hunger strike. If you believe the administration, only five out of 120. eight people confirmed a positive attitude to the hunger strike, the administration reports, and they abandoned their signatures.

It remains only to assume why officials spent time on calls to people who had already expressed their opinion, but the very fact of refusing to sign the signatures after these calls is not an isolated case.

And for the history of Tatyana Pisareva, this is extremely important.

A necessary condition for receiving payments and material assistance for people who do not have a residence permit, but living in a house on Karl Marx, is the establishment of the fact of living in this house through the court.

At the disposal of the editorial office there is a photocopy of the Act of Living, which Pisarev issued. On the original document are signatures of three neighbors. And then there is a copy of this act, where two of the three signed reports: “I call my signature.” Tatyana claims that this is a consequence of the direct pressure of the administration on her neighbors. Only one woman of the three signers showed firmness and did not withdraw the signature.

On July 19, the residents of the blown up house nevertheless announced the promised hunger strike in Pisareva’s apartment: they demanded to recognize the sixth entrance - neighboring with the epicenter of the explosion.

The only result of this action was Pisareva’s violent premises in a mental hospital for two days. There was no prerequisites, the woman emphasizes, for this there was no.

"She has her own business and three apartments!"

Returning from the "hospital", Tatyana was faced with a new form of pressure - a series of publications in local media, exposing her almost an apartment fraud. For example, the Magnitogorsk Worker newspaper wrote that Pisareva allegedly did not live in the ill -fated house, but launched the tenants there. Other media reported that Tatyana had not two or three apartments that the dead relatives inherited her. But she does not inherit, because "she dreams of taking possession of an apartment from the state."

Pisareva really does not really have any three apartments. There is not even one. In the apartment, remaining from the dead mother and grandmother, there is only a share. And she was arrested for debts of late relatives. According to Tatyana, the amount of debt exceeds the cost of her share. Therefore, she does not enter into the rights of the inheritance.

If on December 5 the court decides to evict the Pisareva family from the house to Karl Marx, then the family will actually be on the street.

"Business Women"

The New Gazeta sent a request to the administration of Magnitogorsk, in which she asked the situation with the resettlement of the house and specifically the fate of the Pisarev family. The administration reported that the apartment was provided to the family in 2010 “for temporary use”.

However, the “temporary” stay of residents, according to the law, means gratuitous use of the premises, and the life of such residents cannot exceed six months. Pisarevs lived in the apartment for almost 10 years, while there is no talk of any “free” use: they opened a personal account and regularly charged a rent. When asked why the family was not registered at the actual place of residence within 10 days, as the law requires, the press service did not respond.

The response of the administration’s press service also says that “at present Pisarev and her family members are not recognized in the living room.” At the same time, the administration for some reason reported that Tatyana "has her own business."

“My business is the sale of colors,” Pisareva says. - He brings 25–27 thousand rubles a month.

"We will check the governor for nobility!"

The only person who decided to publicly join Pisarev is a former Chelyabinsk Ombudsman Alexei Sevastyanov. In the 2010s, he personally oversaw the victims of the “black realtors”-more than a hundred people in the region. He confirms Tatyana's story.

Solving the problem of Pisarevs with apartment fraud in 2010, says Sevastyanov, could be a quick reaction of law enforcement agencies and providing interim measures. But the affairs of fraud are excited very reluctantly and with great delay, the attackers manage to sell the apartments during this time. So it was that time. The fraudster was exposed and imprisoned, but Pisarev’s apartment remained with the new owners. It was not possible to recover any losses from the criminal, because after the release he did not get a job. Tatyana and her children, after eviction, were forced to live right in the entrance for some time until they were given municipal housing "as a family with gifted children."

“We promised to issue a warrant for the apartment then vice-governor Oleg Grachev,” recalls Alexei Sevastyanov. - Under me, he called the head of the city to Teftelev and gave the order to prescribe Pisarev. Gifted children grew up in the family, there were every reason! But the warrant was never decorated. In fact, now from Tatyana they make anti-heroes, press services in the region are blocking the dissemination of information, I know from practice how to do it.

According to Sevastyanov, now only the Governor of the Chelyabinsk Region Alexei Texler, who personally is responsible to Putin, can resolve this situation for the execution of an order to resettle the house in Magnitogorsk.

“The governor now has all the cards,” says Sevastyanov. - Let's check it for nobility: he said that he was for people. Here - there is a specific opportunity to show yourself. She is charged with her that she did not inherit somewhere, she found some shares, but I know for sure, we checked on the papers that she had no other housing, and what the Magnitogorsk media write is from ignorance of the city administration to protect herself.

According to Alexei Sevastyanov, the governor has the right to provide one -time financial assistance to one and a half million rubles to a person who fell into a difficult life situation.

- Enough for an apartment in Magnitogorsk. There are reasons until the court is recognized that this is not her housing, ”says the Ombudsman.

The New Gazeta appealed to the governor’s administration with a request to tell if he knows about the situation with the eviction of the Pisarev family, and how he plans to solve this issue. There is no answer yet.
