
Former defendants in Moscow Affairs Sergey Abanichev and Alexei Minyailo filed a lawsuit in the Tver court of Moscow on compensation for moral damage for illegal criminal prosecution. The case against them and several other people I recall, I reminded me in September, blinning in a pre-trial detention center for a month and a half, but without collecting at least some evidence to voice them in public. Of course, no one apologized to them (and when we apologize?!) - neither Bastrykin, nor the speaker of SK Petrenko, nor the head of the Moscow City Court Olga Egorov, whose subordinates arrested and left arrests without any legal basis.
And then Abanichev for such a mistake, which cost him and his family a month of life, requested 500 thousand rubles from the Ministry of Finance, Minyailo, who sat in a pre -trial detention center for almost two months - 1.5 million rubles.
The news here is actually only in the fact that the claims of the “Moscow business” filed about rehabilitation. In Russia, citizens - well -known and unknown - daily filed such claims in accordance with the Constitution and the European Convention on Human Rights. In most cases, Russian courts, of course, satisfy (after all, if the case is officially closed, you can’t be ahead of fact),
Only now they award the amounts of the sums and the miserable and disproportionate suffering suffered by them during the period of their location in a pre -trial detention center or colonies.
A fresh example is the chemist Olga Zelenina, who, together with another 12 defendants in a loud “poppyard business” last year, justified the jury. Over the 7 years of criminal prosecution (namely, the investigation lasted) Zelenin, having calculated every day in accordance with the norms and laws, demanded 6 million rubles from the state: for pre -trial detention centers, searches, house arrest, undermined health, money spent and the death of a mother, with whom they did not even let her say goodbye. The Tver court of Moscow awarded her 700 thousand rubles, without explaining what he made of the amount from.
Russian courts, of course, admit that citizens suffer from unprofessional investigators and judges and have the right to compensation, but the judge’s amounts completely requested by citizens are strongly cut out on the basis of their incomprehensible prices and taxes.
Supporting courts in most cases agree with district colleagues. And then citizens have a Supreme Court (sometimes he sides the victims and obliges them to pay the requested amount completely), and after him - the European for human rights.
And here, of course, the key question is that the Ministry of Finance has to do with it, when unlawful decisions are made by specific investigators and judges. From their salaries, it would be necessary to hold. For example, it would be nice to ask the investigator from the salary of the investigator for particularly important cases Dmitry Yeremin, who heads the investigation in the Moscow case, as well as from salaries by Judge Avdotina and Kirichenko from the Presnensky court, who listened to the investigator and arrested Mineilo and Abanichev at one time.
About such a law - to remove responsibility from the Ministry of Finance and transfer to specific officials - by the way, they think in parliament.
But the most important thing is that in any case, compensation does not solve in the country the problem of illegal content of people in custody. For this you need an independent court, but where to get it?
As for Abanichev and Minyailo, let's wait for the court decision. But the most striking here will be not in the amount of compensation, but in the fact that the decision will be made by some conditional judge Krivoruchko, who continues to work in the Tver court, or his colleagues Sizintsev and Belyakov, who, like Krivoruchko, sent participants in rallies to the pre-trial detention center and colony in one day of the trial. And this labyrinth without exit.
