The State Duma approved in the first reading a bill on the abolition of fines for excess of average speed

The State Duma at the meeting on December 11 adopted in the first reading a bill on the ban on the ban on fine car owners for speeding, if it was recorded by cameras that measure the average speed of the machine on a certain area of ​​the road.

The bill, which was submitted to the State Duma from the LDPR, proposes to supplement the article of the Code of Administrative Offenses (Code of Administrative Offenses) "Exceeding the established speed" with a note that states that prosecution is permissible only if the speed of speed took place "in a particularly established place and at a particularly established time." The document also complements the Code of Administrative Offenses with the regulations, according to which "fixation of the excess of the established speed of the vehicle on the site of the roadway on the basis of the calculation of the average speed" cannot be considered evidence of offenses and under other articles of the Code, TASS reports.

The explanatory note to the bill states that in recent years, in a number of regions, drivers began to be fine for excess of the average speed, which is determined using cameras that fix the travel time and coordinates. “The recorded data is received by the server, after which the average speed of the vehicle is calculated, with which the distance between the points of movement of the speed was overcome,” the authors of the document explain, noting that the concept of “average speed” is absent both in traffic rules and in the Code of Administrative Offenses. "Bringing to administrative responsibility on the basis of guesses, speculations and calculations is unacceptable," the deputies believe.

The government previously opposed this bill. The government review says that traffic rules oblige drivers to observe speed restrictions not only at a particular moment, but also “throughout the entire driving period,” writes Kommersant .

"Monal speed control has shown themselves to be a very effective tool for reducing the accident rate. Many drivers, using Internet services, know about the location of the cameras, slow down in front of the control zone, and then go again with excess. To achieve traffic on the entire area of ​​the road, uses control of the average speed. Due to such technologies, we managed to reduce the number of those who died in an accident since 2013. The state set the task by 2024 to achieve an even greater reduction in the accident rate.

As RBC recalls, the first complexes of fixation of medium speed appeared on the roads of the Moscow Region in 2013, but two years later their use was stopped. Such cameras were returned to the routes of the Moscow region only in the summer of 2019, and by the fall, for the excess of average speed, they began to be fined on four federal routes of the region. In addition, such complexes are used on the tracks of Moscow - Ufa, Kazan - Orenburg and Kazan - Ulyanovsk.
