The Essentuki city court extended the arrest of the chairman of the council of teips of Ingushetia, Malsag Uzhakhov, for 3 months in the case of violence against security officials. This was reported to OVD-Info by his lawyer Dzhabrail Kuriev.
According to him, the documents allegedly confirming that his client can hide from the investigation were drawn up 4 days later than the application for an extension of the measure of restraint.
In addition, the investigation presented to the court materials that had already been declared inadmissible - a certificate from the Center "E" and the Main Directorate of the Ministry of Internal Affairs for the North Caucasus Federal District. At the request of Kuriev, the judge again declared these documents inadmissible.
Kuriev also said that the case file contained information from the Ministry of Internal Affairs of Ingushetia, which had nothing to do with his client. According to the lawyer, the investigation provided information about a person with a consonant name and surname, but the spelling of the name and date of birth did not match with his client.
Motivating the extension of the arrest, the court referred to the "gravity of the acts." “The law does not provide for the extension to be motivated by reference to ‘gravity’. When choosing [a preventive measure - OVD-Info], this is relevant, but it is not allowed for an extension. This was stated in the Plenum of the Supreme Court No. 41, in addition to this, there are many decisions of the European Court,” Kuriev commented.
Despite all this, the judge considered the arguments of the investigation justified and extended the arrest of Uzhakhov until March 25, 2020.
