The Moscow City Court refused to satisfy the complaint about the preventive measure for the convicted defendant in the “Moscow case”

The Moscow City Court refused to change the measure of restraint for the person involved in the "Moscow case" Maxim Martintsov, who was sentenced to two and a half years in prison. This was reported by the telegram channel "Arrested 212".

The meeting considered a complaint filed in October, but subsequently lost. In it, the defense side pointed out that the measure of restraint was chosen a day after the arrest, and also asked to recognize the measure as disproportionate and mitigate it, releasing Martintsov on bail.

During the debate, the prosecutor stated that he did not agree with the motions of the defense, and did not give reasons for his point of view. In response to this, the lawyer Vasily Ocheret objected that in his twenty years of practice he had not seen anything like this, because the prosecutor, like the lawyer, must argue his position, since the equality of the parties in court is fixed in Russia. However, the judge interrupted the defense lawyer, and the prosecutor said that he was dissatisfied with the fact that the lawyer was commenting on his work.

According to investigators, Martintsov, along with other defendants in the case, Yegor Lesnykh and Alexander Mylnikov, kicked National Guardsman Maksim Kosov during a rally on July 27, and then knocked him to the sidewalk. Their criminal cases were combined into one proceeding under Part 1 of Article 318 of the Criminal Code (the use of violence that is not hazardous to health against a representative of the authorities). In addition, Lesnykh is accused of allegedly kicking police officer Alexei Fedorov. The defense provided a video at the trial, which shows that Lesnykh did not hit the law enforcement officer. All three pleaded not guilty.

January 21, 2019. The Moscow City Court rejected the appeal against the measure of restraint of the defendants in the "Moscow case" Maxim Martintsov and Alexander Mylnikov. Martintsov will remain in jail. Mylnikov is under house arrest, today the complaint against house arrest, filed before the verdict, was considered. On the day of the verdict, he was released on bail. Martintsov was defended against OVD-Info by lawyer Mikhail Ignatiev, and Mylnikov by lawyer Tatyana Tyatova.

• On December 6, the Meshchansky District Court sentenced Yegor Lesnykh to three years in a penal colony, Maxim Martintsov to two and a half years in prison, and Alexander Mylnikov to a two-year suspended sentence.
• On July 27, protests were held in Moscow in support of independent candidates in the elections to the Moscow City Duma, during which, according to OVD-Info, were detained 1,373 people . Three days after the action, the Investigative Committee opened a criminal case on the riots. Several people have already been sentenced to real terms on charges of using violence against the police and the National Guard.
