At a meeting to review the measure of restraint, the investigator expressed the opinion that it was impossible to release Barshai from the pre-trial detention center, since he allegedly could hide, since he “corresponded with another defendant in the Moscow case, Aidar Gubaidulin, who left Russia after being transferred from the pre-trial detention center under house arrest” . At the same time, the investigator confirms the statement of correspondence with one post in the telegram channel dated November 21, 2019.
The meeting was started by judge Valentina Levashova, who was supposed to consider the appointment of a preventive measure for the period after January 27. She managed to interview Barshay, but after two calls to the hall on a landline phone, she announced a break.
When the break ended, the chairman of the court, Irina Vyrysheva, sat in her place, deciding to consider the materials of the case on appeal, which took place on January 22 in the Moscow City Court. Then the court of second instance declared illegal the placement of Barshai in the pre-trial detention center, which was scheduled at the meeting on December 5 due to a number of procedural errors - in particular, the meeting was held in the absence of the defendant. As recognized Novaya Gazeta explained, “the problem of ‘procedural vinaigrette’ was solved in this way - a situation was obtained in which a preventive measure for the future is first chosen (today’s meeting), and only then we review the choice of a preventive measure for the past period (a meeting whose decision was yesterday illegal in the Moscow City Court).
February 17. The Moscow City Court rejected two appeals against the measure of restraint of the person involved in the "Moscow case" Andrey Barshay.
He contested the arrest until 27 January and the extension of the arrest from 27 January to 27 February. Barshai participated in the meeting via video link from the Meshchansky Court, where a hearing on the merits of the case will take place today. One of the grounds for extending the arrest was the correspondence with Aidar Gubaidulin, a person involved in the Moscow case, who had left Russia. The defense listed numerous procedural violations committed in the district court and asked to choose a preventive measure not related to arrest.
