The prosecutor filed a protest against the decision of the Meshchansky District Court, which ordered three days of arrest for eco-activist Konstantin Fokin, who handcuffed himself to the front door of the FSB building. This was reported to OVD-Info by Fokin's lawyer Olga Pelshe.
The prosecutor motivated the protest by saying that when deciding on Fokin's case, the judge did not take into account that the activist had already been held accountable for protest actions. In this regard, the prosecutor asks to cancel the court decision and return the case for a new trial to the court of first instance.
Olga Pelshe also filed a complaint, since Fokin was brought to justice under the article on participation in an unsanctioned action that interfered with the movement of citizens (part 6.1 of article 20.2 of the Code of Administrative Offenses), although the activist held a single picket that did not require approval.
“Tomorrow at 2 p.m. we have a hearing in the Moscow City Court, and at about the same time the term of [arrest] ends. The protest of the prosecutor thus allows us to assume that tomorrow, having released him from arrest, he will be offered to appear in the court of first instance, where he will be given an additional term. This is a possible development of events, ”Pelshe said.
