The judge of the Smolninsky District Court of St. Petersburg, Nadezhda Koroleva, awarded Vasily Kunin 3,300 rubles in compensation for illegal detention at an agreed procession on May 1. in his telegram channel This was reported by the "Apology of Protest".
The human rights organization considers the compensation awarded unfair. The plaintiff asked for compensation in the amount of 705,000 rubles (10,000 euros).
“The amount appointed by the court raises questions, since on the one hand the court recognizes the violation of the rights of the plaintiff, and on the other hand, it does not want to assign fair compensation. We will appeal the court's decision, as we believe that the amount of compensation for violation of the fundamental right to freedom of assembly by Russian courts should be compensated in accordance with the standards of the ECtHR,” writes the human rights organization.
The reason for going to court was the termination in July 2019 of the administrative case against Kunin. The police held him for several hours and drew up a protocol against him under the article on violation of the rules for participation in the action (part 5 of article 20.2 of the Code of Administrative Offenses). However, the court considered that there was no corpus delicti in the actions of the participants in the coordinated procession.
