Pskov: Activist and deputy lost the court to the head of the city

In Pskov, the city court refused activist Nikolai Kuzmin and deputy of the Pskov City Duma Dmitry Permyakov in a lawsuit against the head of the city Elena Polonskaya. This was reported to the North. Reali by the deputy Permyakov. The plaintiffs demanded that Polonskaya refuse to issue Kuzmin to be illegal as a regular assistant deputy Permyakov. The activist was refused employment due to participation in opposition actions-in the City Duma, they considered that he violated public order by this.

In court, Kuzmin said that despite the official refusal, he continued to actually work as an assistant deputy.

"I have been a civilian activist for more than 10 years, my participation in rallies is part of political activity. I want to help people and are proud when it turns out. I ask the court to satisfy my requirements, because I want my activities to protect people to be legal. It is much more pleasant to help people, but to do it in the legal field, having a status for this," the activist said.

The deputy Permyakov on the process noted that the Regulation on assistants directly says that the deputy is personal responsibility for the assistant and independently gives him instructions.

“Stop telling me who should be my assistant. The document directly says that I am making such decisions. And only I can determine whether Nikolai Kuzmin corresponds to the high rank of assistant deputy of the Pskov City Duma or not. No one else has the right to determine it,” Permyakov emphasized.

Representatives of the Pskov City Duma in court noted that the interaction of Kuzmin and Permyakov did not fall under labor relations, because the contract with the Duma was not concluded and the activist did not sign the time of accounting for working time and other regulatory documents. They called Kuzmin's work by the implementation of single instructions.

On March 11, the court announced only the resolutionary part, the motivation for refusal will be ready after March 18, but the deputy and activist have already announced that they would appeal the decision or file a new lawsuit.

“On the site of the head of the city, I would not in a hurry to open champagne. I think that, unlike Elena Polonskaya and the City Duma in this process, an unconditional advantage: we are absolutely right in our requirements. “We wanted to raise the bar between the deputy and his assistant to a fundamentally new level in our lawsuit-the level of labor, rather than civil law relations. In the case of our winning, the Duma would have to completely change the legislation on assistants and conclude new agreements with them. I will assume that the judge was embarrassed. But I continued to work in Pskov’s deputy,” Kazmin shared.

The lawsuit to the head of the city was filed on January 31. In it, the activist and the deputy proved that despite the official refusal of the head of Pskov, Kuzmin performed the duties of an assistant deputy - he worked on requests, met with voters, organized the work of the reception. This activity of Perm and Kuzmin is considered labor relations and hoped that the court recognizes them de jure and obliges Elena Polonskaya to conclude with Kuzmin as an assistant deputy Permyakov.
