The case of lawyer Mikhail Benyash was returned to the court of first instance to eliminate violations

The Krasnodar Regional Court returned the case of lawyer Mikhail Benyash, sentenced under the article on the use of violence against police officers (Part 1 of Article 318 of the Criminal Code) to a fine of 30 thousand rubles, to the Leninsky District Court to eliminate procedural violations. The Protocol reports this.

The regional court was supposed to consider an appeal against Benyash’s sentence, but he himself was not allowed into the courthouse due to quarantine.

“The case was withdrawn from consideration, that’s the whole comment. They will eliminate procedural violations, and maybe someday we will go to appeal. That's why they didn't let me in. In general, the orderlies in the regional court look very harmonious,” the publication reports Benyash’s words.

• Lawyer Mikhail Benyash was detained on September 9, 2018, when he was on his way to join those detained at a protest against pension reform. During the arrest, the lawyer was beaten. According to the investigation, during the arrest, the lawyer bit one police officer on the hand and hit the second in the face three times with his elbow. On September 21, the Investigative Committee opened a criminal case in connection with this regarding the use of violence against police officers (Part 1 of Article 318 of the Criminal Code).
• Benyash spent a month in a pre-trial detention center, but was later released on bail of 600 thousand rubles.
• On October 11, the court found lawyer Mikhail Benyash guilty under the article on the use of violence against police officers (Part 1 of Article 318 of the Criminal Code) and fined him 30 thousand rubles.
