On April 14, journalists drew attention to the vacancy that appeared on the website of the Higher Qualification Collegium of Judges to the post of chairman of the Moscow City Court. Since 2000, this post has been occupied by Olga Egorova.

She has been heading the Moscow City Court for three deadlines: the first, eight-year-old, ended in 2008, then two six-year-olds-until 2014, and the current one ending in October 2020. All three times, Egorov was appointed by Egorov to the post of chairman of the Moscow City Court by Russian President Vladimir Putin.

The Moscow City Court said that the publication of the vacancy is a “ordinary procedure”.

Clause 14 of Article 6.1 of the Federal Law “On the Status of Judges” prohibits the same person to occupy the post of chairman of the court for more than two terms in a row.

But in July 2018, the Parliament adopted the Federal Constitutional Law on amendments to the Law “On the Judicial System”. Clause 6 of Article 7 of this Federal Constitutional Law implies that the chairmen of the courts after the entry of these amendments can be reassigned to no more than one more period, if before that they were in their position two or more times in a row.

Thus, Olga Egorova can be appointed for one more period, says Kirill Koroteev, lawyer of the Agora international human rights group.

“The law on the status of judges is a federal law, and these amendments are a federal constitutional law, it has great legal force,” the lawyer explains. - Moreover, Article 6.1 [Federal Law "On the Status of Judges"] refers to the Federal Constitutional Law. Accordingly, the norm of the federal constitutional law has priority. Accordingly, the 6th part 7 of the article allows [reassignment] at least one more period. ”

In June, Egorova will be 65 years old. The maximum age for the judge is 70 years, and by the expiration of a possible new six -year period she will be a year more. This means that Egorova will have to resign authority ahead of schedule - but this is if the legislation is not corrected again.

In the spring of 2012, President Vladimir Putin proposed canceling the maximum age for the chairman of the Supreme Court - the same 70 years as for other judges. At that time, the position was held by 68-year-old Vyacheslav Lebedev. In the summer of 2012, the amendments were adopted and signed , and Lebedev has since been reassigned twice - the last time in 2019. Vyacheslav Lebedev became the chairman of the Armed Forces back in 1989.

In addition, since 2010, there has been no limiting age for the chairman of the Constitutional Court. At the end of January 2018, Valery Zorkin became the chairman of the KS for the sixth time. Now he is 77 years old.
